Pechanga Chairman Mark Macarro and Tribal Council Member Andrew Masiel Fail to Answer on Liska Lawsuit

Pechanga Band of Luiseno Indians Chairman Mark Macarro and Andrew Masiel Sr. a tribal councilman, refused to respond to a complaint in the Case of Liska V. Macarro.

Macarro and Masiel, who were served had 21 days to respond to the suit of Joe Liska, son of Pechanga member Fred Magee and brother to two sisters, Mary Bear Magee and Gloria Wright, who were instrumental in having 300 people ripped from the tribe via disenrollments. This could result in a default judgement for Mr. Liska.

Tribal Council members Russell "I'm a White Man who tried to break away from Pechanga" Murphy, Marc Calac, Mark Luker and John Magee have avoided the process server, thus far and the judge, Irma Gonzalez has granted Joe Liska more time.

Mr. Liska, who was banished from the reservation where his father is buried, is asking that the banishment be lifted and his RIGHTFUL back trust proceeds be restored.

  1. I wish I could have been there for Joe's hearing - I intended to be there but I was not able to leave Washington. We are remembering this case in our prayers.

  5. I heard it was lawyer gladiator school,the tribe had three lawyers and one side and the us attorneys had three and their side and joe liska in the middle,,,(people thought it was another case but they were writing down everything joe liska said ,and the judge)holy cow,,,,,,

  6. saninglyIf I had the chance to run against m macaro I would stop DISENROLLMENT BANISHMENT AND MORATORIUMS. So we could STOP
    wasting the court and Judges time
    Iwould take care of all elders and make sure they are all taken care of and happy and that all Childern
    were learning the indian way
    I would make sure all Indian people were taken care of.Instead of paying attention to politics. I would have enrollment committe look in to everyones lineage to make sure they belong Iwould make sure everyone knew of everyones linages so it would stop the threat of people being desenrolled
    Iwould follow the true indian way. Were if you belong you would never be threatened of being disenrolled Its time for a change.
    All indians laws need to be fallowed. Lets get back to were we can be proud to be called temecula indians and stop talking bad about each other NOW IS THE TIME TO START SOMETHING NEW. Its time for someone to take charge and do what is right were he could walk among the people and be proud to say he is a leader. to asure all indians that they would all have a voice and would be heard . and to asure all with alottments that they to could build a home on their land .
    Its time to get rid of mark macaro show him were the rock is that he climbed out from when the casino opened buy the way mark did you live in a shack like everone else and were you on welfare who payed for your schooling. ITS TIME TO DO SOMETHING NOW INSTEAD OF LIVING IN FEAR

THIS IS JOE LISKA I TRIED TO RESOLVE THIS ISSUE AND TOLD THE TRIBES LAWYERS I WOULD COME TO THE TABLE IF THEY WERE FAIR WITH ME AND MY TWO CHILDREN,,,,,,I THINK THE CASINO I GOING TO BE SHUT DOWN ITS HEADED THAT WAY THE US ATTORNEYS OFFICE IS IN DEEP HERE,,,THE TRIBE CANNOT DEFEAT THE US ATTORNEYS OFFICE (STOP WASTING THE COURTS AND JUDGES TIME)?????

  17. The reason the tribe does not settle with Joe is they are afraid of the backlash from the illegal moratorium. It would be something of a precident. If the acknowledge his court hearings and a federal judge, then they become a US citizen just like everyone else. I think they believe by ignoring the hearing it will go away.

    Let's hope this judge has a sense of right and wrong and is not afraid to make history.

I agree to part of above comment BUT I Believe that MM has commented many times that what the tribe does is no Business of the white MANS --And also commented in the press Enteprise when AIRRO John. did his interveiw MARK commented that the united states government has has empowered the tribe with federal LAWS , dont you get it they feel above the law OR UNTOUCHABLE SO THEY DO NOT BOTHER THEMSELVES WITH RESPONDING TO ANY THING THEY HAVE ONLY GOTTEN AWAY WITH THE COURTS NOT HEARING THE ISSUES AS OF YET NO COURT HAS RULED IN FAVOR ,The criminal actions of the tribal government BANISHMENTS AND MUCH MUCH MORE WILL COME OUT Then they will respond but it will be too LATE!

  19. Tribes have a legitimate right to banish members, instill moratoriums, and disenroll based on the majority rule of individual tribes. It is a sovereign right of a Government within a Government, like the military reservations. No Tribe want's their sovereign right abolished! When the Federal Government handled enrollment issues for the Tribes, they screwed up, that is why in some cases tribal members are getting disenrolled, because they never were ndn. Federal Govt. let non-Indians into Tribes without a valid check. The Pechanga fight is within their own Government or with the Federal Government concerning their own Tribe - They need to coax the Government to terminate Pechangas Federal Recognition - Do Not Change Native American Sovereign Rights Status for enorollment for your own selfish Sake!! When you stir this can-o-warms up you gonna have all us ndns on you like white on rice!

  25. From where I sit certain tribes are abusing their "sovereign" rights to govern their own. By tribes using soveriegn rights to commit discord amongst themselves, they need to lose that right. Not all people can handle power and as seen within this tribe as well as others, they can't.

    Indians as a rule, took people in, helped eachother, etc.... Is this happening at Pechanga??

    Not. Instead they are not following their own rules for membership, bringing discord amonst themselves, breaking tribal law that they created? Next the money grubbing teenagers are going to quit school and wait for their "trustfund" money AND GET IT.

    If Pechanga as well as other tribes just followed their own rules none of this would be happening today. So instead of getting angry fix the inner workings and problems going on and most will be happy. Spend as much time trying to make it work instead of creating ways to destroy our history even further.

    I belong in this tribe, I assume I am in moratorium, maybe maybe not, I deserve to donate my time to helping make a difference within the tribe. Shame on those of you who want this to continue.

Well Said BUT it is too late now the damage has been done and thier is no way the tribe can fix the damage they have done to own peoples there must be government intervention as much as some tribes will blame us the ones that have been victimized it is what they have allowed to take place and history will be changed forever

    But what if a tribal leadership doesn't follow the will of the people and do what the majority voted to do?

    On July 17, 2005 the Pechanga general membership voted to outlaw disenrollment and the disenrollment procedures no longer existed as a part of tribal law.

    Everyone as of the date the petition for the new law was justified, June 19, 2005, was to continue to be tribal members.

    However, the Hunter family was disenrolled on March 16, 2006 despite the new law.

    So what are we supposed to do if the tribe doesn't follow their own laws?

    It is the current regime at Pechanga that will bring sovereignty down, not us.

    So put the blame where the blame belongs and come down on the Band's rogue leadership like "white on rice" and leave us alone.
