Joe Liska received good news in court today. The Pechanga Band of Luiseno Indians hired attorney's tried to get the Judge to toss the case today.
The tribe had told the judge that Mr. Liska was guilty of trespass. It was news to Joe, as he never had a trial, never presented a defense. Anyone hear of due process?
There seems to be reckless conduct in Pechanga's handling of this matter. Not to mention the possible conspiracy to defraud Mr. Liska of his tribal heritage. The Judge couldn't believe that there has been a moratorium for 14 years, which was designed to help the tribe "catch up" on a backlog of requests.
The judge want to lean more and the case is continued. She will have orders next week. Congratulations Joe, keep up your fight for what is right. Let's see, maybe the Boy Scouts will rethink giving Pechanga an award for ethics and family values?
And Rep. Nick Rahall, how about those hearings?

This one man's case will not win it for all, and Pechanga will continue to fight until they can't anymore. Even if Joe wins, will each case that follows lead to the same result?
I've been following what has been going on for several years now, and, I must say, am angry that nothing has really changed. Justice has not been restored to the "Original" Pechanga people.
What will it take to MOVE the forgotten Pechanga people? Or even all of the disenrolled Luiseño?
For so long, I've read or heard about petitions and protests, and talks, and court battles (kangaroo court battles), but NO ACTION. How many are disenrolled? Not just from Pechanga, but all of your Luiseño brothers and sisters? How long can you be ignored?
How many times will you stand on a street corner with signs, and still do nothing? Nothing has ever changed without direct action. If you want change, then look to the defiant civil rights leaders of the past. Non-violent action, sit-ins, civil disobedience (without violent lawlessness) won. Without these acts, laws would never have been moved to change.
My Native American Tribal ancestors and my African Tribal ancestors had to fight for their civil rights to be where they are today. Though I am not of your tribe (yes YOUR tribe), I am moved to want action. It isn't my place to organize, but one of YOU to organize! What would the New Pechanga do if hundreds, or even thousands of you sat in their government building? What could they do if hundreds or even thousands marched onto the reservation? Would they shoot you? Would they arrest you? Would they hurt you in front of television cameras? I promise you that the rest of the world would start listening, because THEY AREN'T RIGHT NOW.
My people died for their rights. Your petitions aren't working. Your complaints in the kangaroo courts are a joke to them. They have unlimited funds to fight off any hint of a legal problem. You will only win this battle through the hearts of the rest of the members if they can see past the paycheck. If their paychecks aren't being processed, then the ones that only care about the money will start listening.
Would you die for your cause? Would you unite with the other disenrolled state-wide, or even country-wide, to march onto the reservations that are denying you your history? Maybe it's time for a little disobedience. Maybe it's time to look beyond just the disenrolled "Original" Pechanga.
Maybe if you work hand in hand with the other forsaken tribal members, and take a stand for direct action, then maybe you will be heard.

3.she could pull the tribe in for another settlement hearing.
4.the tribes attorney tried to get it dismissed and she stated "were not there yet" unknown whats going to happen. Might no in a week.

The thing is regarding Mr. Liska's lawsuit. While it is good for people to show up at the court to give him moral support, them being there has no bearing on how the judge is going to rule as judges just go by what the law is and legal precedant.
People showing up is more to make him feel good, which is a good thing, then it is to help his case be succesful.
moral support is good,we are talking about a show of many that have been wronged.
And yes it has no bearing on the ruling,however one could argue that point if the judge wants to bring in a enrollment committee member as a result of many caught up in a moratorium or abuse ,then this could be as a result of many showing up!

Do you know this case? This was a non tribal member charged with resisting arrest and battery on a tribal police officer. He filed a writ of habeas corpus against the tribe and stated he does not argue about the charge but the tribe cannot try him in their tribal court ,he is not a member of the tribe. The u.s supreme court granted him his writ of habeas corpus they stated indian tribes cannot try and punish non members.
This is the same thing for Liska ,he was charged with trespass (clearly stated on the exclusion letter)he was charged punished thru the tribal court or hearing system, violating his civil rights.
This was part of Liska's oral argument.The judge stated if they are putting him thru the tribal court they are treating him like a member!
Furthermore in Duro v. Reina in 1990 the u.s supreme court ruled tribes cannot try and punish other indians from other tribes that live on their rez.
Arelene macarro can file a writ against the tribe for doing the same thing to her!
John gomez could also do the same,he went thru a tribal hearing process as a non member.
