Recall of Pechanga Chairman Mark Macarro: Attempt by Splinter Group Fails; Child Molester Unsuccessful

UPDATE:  It's been 52 days and STILL no word of the recall attempt on the news, newspaper or the pechanga.net website run by Macarro's cousin, Rocha.  He's had plenty of time to research the story, since he must have heard about it here and via our emails.   Why keep it secret?  

UPDATE II: I've heard back from Rocha's assistant and he said: " I forwarded your link to Victor in case he wanted post it. He didn't."  I also heard back from Rocha and he said he didn't think my site was a legitimate news source.  Luckily for those of us that have been harmed by corrupt tribal councils, including the one led by Rocha's cousin Mark Macarro, the Feds do, we are regularly visited by the House, the Senate, The Office of the POTUS, BIA, Dept. of Justice and Dept. of Interior.



Pechanga Tribal Chairman Mark Macarro came under fire at the recent General Membership meeting of the Pechanga Band of Luiseno Indians in Temecula, CA.

Macarro, who is well known in Indian Country for presiding over the disenrollment and genocide of 25% of his tribe, was the subject of a recall attempt by a group known as the CPP (Concerned Pechanga People).   This group allied themselves previously with the diminutive chairman in eliminated two large voting blocs from the  Manuela Miranda and Paulina Hunter descendents.
Miranda was a descendent of Pablo Apis, on whose land grant the Pechanga Resort & Casino is on, and Paulina Hunter is an Original Pechanga Person, who received an allotment on the reservation as a tribal person.

The CPP group, this time fronted by:  Raymond Basquez Sr.,  Ed Burbee, Gloria Wright & convicted child molester Vince Ibanez.  At a meeting that was designed to elect new PDC (Pechanga Development Corporation) leaders, the CPP presented a petition recalling Pechanga Chairman Mark Macarro for nepotism in hiring his wife Holly Cook Macarro as the tribe's lobbyist.  

Holly Cook Macarro is a principal in IETAN Consulting, but was formerly employed by the tribes's then lobbying firm, Holland & Knight.

Macarro presented paperwork at the meeting that showed that the tribe had approved Holly as a lobbyist while at Holland and Knight in 2002.   This was prior their marriage, we believe,  and it was Holland & Knight that was chosen, not Holly.  Was the switch to IETAN Consulting ever brought before the tribe?

There was a vote on the validity of the recall petition and the tribe voted down the petition as invalid.   This is one time that Macarro, I'm sure will follow the will of the tribe. (/snark)    Macarro had previously overturned the will of the people in the Hunter disenrollment.

The die is cast, however and there is a new Macarro Enemies List.   Macarro now knows who is against him.    It might be a good idea for local citizens to stay away from Pechanga, exercising moral outrage at what Pechanga has become.

MR. MACARRO, there are 250 possible votes for your survival out here, simply re-visit your unlawful overruling of the people and reinstate the Hunters and Manuelas.  And while you are at it, undo the unconstitutional moratorium, I'm sure 100 of the Tosobols would vote in your favor.   It would have the added feature of reducing your enemies income.....hmm.

    I know some people think we are making a bigger deal out of what happened to us by comparing the people who violated our rights to Hitler and Nazi Germany and while the regime at Pechanga is nowhere near as evil as what happened in Germmany in the 1930's and 1940's, wrong is still wrong even if to a lessor degree.

    Regarding Hitler and the Nazis, if they and the Axis powers had won World War 2 would it have been any surprise if Hitler and the Germans would have turned on Italy and Mussolini and Japan and Togo next?

  3. One more thing, does the CPP have any concept of tribal law?

    Because if they brought this recall petition at a PDC meeting, it isn't the proper forum to do so as it would have to be done at a General Memberhip meeting and I believe it would have to be at a single subject special meeting.

    So even if the petition was justified, then it still wouldn't be legal but since when has that stopped them from doing something before?

    If you are referring to our, the Hunters disenrollment, no that is not what happened as the tribe had voted to end disenrollment as a part of tribal law and to stop our disenrollment in 2005 but the tribal council allowed the enrollment committee to go forward against us in 2006 in spite of the new law.

  6. I am posting shorter posts as I think it will make it more likely for people to read what I am saying even if there are more of them.

    You better believe the CPP isn't through with Macarro as once someone is on their hit list they keep at it until they get what they want.

    As seen by the situtation in 2005 after I thought our disenrollment was defeated and I went to Norman Pico Sr. and I spoke to him about helping me draft a petition to end the moratorium.

    His response was that even though he was against the moratorium, he said, "we have to stop the disenrollments first and then take on the moratorium because they are going to come after you (the Hunters) again and they aren't going to stop coming after you."

    You know he was right because if we had stopped our disenrollment, we may very well have had to votes to end the moratorium then.

    Well we did stop our disenrollment but the rouge elements in the tribe ignored the wishes of the people and Macarro helped them.

    Look into their past tax returns and "claimed earnings".

    Ironic that before our disenrollment the CPP accused us of trying to overthrow the tribal government by recalling the tribal council which was never in our plans even though we had ample reason to do so and now they are trying to recall Macarro.

    I agree with White Buffalo but let’s not just limit the focus on the tribal leaders: They are the little pigs at the trough. There are tracks leading back to Partners in Major Law Firms, Accounting firms and Lobbing firms, Banks and Government Officials who have been stealing with both hands from Pechanga too. There is enough blame to go around, and there are plenty of jail cells to fill. Pechanga is a target rich environment for the IRS and Feds. I hope everyone understands that the last one to rat out his frinds and family looses.

    They are the Masiels and Basquez line.

    Their ancestor was Francisca Leyva (Leyvas) who they claim is a descendant of Josepha Garcia but there are questions about whether they are actually related by blood to her or not.

    As there are conflciting reports such as duplicate 1928 applications and several applications for a small per capita payment from a California judgement roll in the 1950's also with conflicting information

    Also, she isn't listed with her 'mother' on any of the census records until several years after her birth and her 'mother' was not married to her father but to another man the year of her birth.

    Ironic that they have more questions about their linage than we the Hunters had and some of them sat in judgement of us?

    1. The Basquez Crime family was unprepared.
    2. Even some Masiels don't trust Raymond Sr.
    3. Mark's still got the gift of gab, lies flow like...buttah.
    4. Even the weak-willed tribal members don't want to have Gloria Wright as a leader.
    5. The tribe was willing to accept a child molester to do their dirty work of eliminating tribal members, but not to take over.
    6. Only 300 members attended the meeting for PDC elections.

    Interesting though that the Macarros are mentioned in Dr. Johnsons report on the ancestry of Paulina Hunter showing her connection to other Pechanga families and that Juan Macarro, from his marriage document to Isabel (Tapia) Kengnish taken from the San Rey Luis mission records, is shown to be from Pauma but that Isabel is from Pechanga.

    The connection to the Hunters is that Isabel was from the same clan as Paulina's maternal grandmother Restituta.

    Johnson in this report says that Paulinario Macarro was the son of Juan and Isabel but does anyone know if the Macarros alive now are not his direct descendants but are from Juan's first wife?

  77. I believe the Hunters to be Pechanga as even though there are legitimate questions about their linage, there are enough documents to answer those questions in this family's favor.

    I think the problem is that they really didn't have a direct presence on the reservation for years after the death of Paulina. None of her children or grandchildren are listed on any census records after her death in 1899.

    O.P. has said that Hunters have lived there since the 1940's and and 1950's but still that is a large gap from the generation of the 1800's.

    So it is possible that some people from the generation after the reservation was created didn't really know the Hunters and don't consider them part of their tribe.

    So it could be that people who testified against them in their disenrollment are not a bunch of money hungry crooks but really believe what they did was right.

    I also think the Masiel/Basquez are likely Pechanga but their ancestor may have been born out of wedlock so that could explain some of the questions people may have about their line.

    The problem is how to somehow reconcile the two groups in a way that is fair to all concerned.

    Perhaps, but when you concider statements made by members such as Ed Burbee (made to myself and my brother just before the first disenrollments were started by himself) "I want more money, and I don't care what I have to do to get it".

    Or by enrollment committee members to Hunter Family members such as "you are going to be disenrolled NO MATTER WHAT information you provide".

  81. There is some evidence that some really believed what they did was right, and that was the hiring of Dr. John Johnson to make a study of Paulina Hunters linage. But it seems if this was so, why didn't they believe the report that he came back with?

    I this it was a combination of some who really believe what they did was right, and some who did it for monetary gain.

But meanwhile nothng has changed. There have been no interesting new developments. What any interested observer can already see is that the truth has already come out... about six years ago.

  83. Dr Johnson wrote another report back in the 70's, it was about human sexuality. Wait, maybe that was a different Dr Johnson. But the similarites of these two reports are in the irelevance to how they have had any effect on the Pechanga Tribe. Governments pay for reports all the time, some are used to shape policy and law, others are not.

    The alleged quote which has not been shown to actually be a part of any report "nobody is more Pechanga..." actually makes litle sense. It has no context. It offers no more value to any argument than if aomeone were to say, "Nobody is more a carbon based life form than a Tosobol."

    I suppose any group who is fighting for what they believe is justice must have something to hang onto for hope. This group here appears to hang all their hope on a shelved report and some alleged heresay quotes which even if true have no context, or validity, or even traction.

    Ed Burbee is irrelevant. He hasn't held an elected position since what, the 70's? He's just a windbag with no backing. He's one single vote, that's all. Who the fuck cares if Ed said, "I want more per-capita and I will do anything to get it." I've actually heard Ed say that myself. The fact is, if Ed ever actually said this to anyones face, there is no way it was intended as any kind of threat because Ed is a physical coward. If you've been around, you know that. Point being sure, Easy Money Ed may have said that, but if this quote is an example of the corruption you claim exists, well it's pretty weak.

    First of all we proved we are legitimate tribal members even without the Johnson report which did clarify some points but hardly is the end all of our claim but simply reinforced our position.

    Legal notarized statements from elders of the generation that the reservation was created that are in our favor are not hearsay but bonefide evidence acceptable in any legitimate court proceeding.

    On the other hand the statements against our membership were actual hearsay with no proof whatsoever that what the people, all from the CPP faction of the tribe and mainly from one family in particular, were saying is true.

    One of the those statements against us quoted elders from previous generations who allegedly said that we the Hunters are not Pechanga but with no proof they actually said what the current tribal members said they said and in fact one of those previous generation elders actually gave legal testimony in favor of three of Paulina Hunter's children in probate hearings taken in 1938.

    Plus we had legal notarized statements from other current tribal elders in our support not from the CPP faction that was in direct opposition to the claims of the CPP.

    As far as Ed Burbee is concerned you are right he really has no real relevance but I don't believe his statement was a threat but that he was scouting potential allies in his (and others) quest to get a bigger share of the pie and it shows the mindset of some of the people who orcastrated the disenrollments.

    Really what any interested unbiased observer with no self interest in what transpired can see is that we didn't get fair hearings in any way, shape, or form and that biased people with a clear conflict of interest who never should have been allowed to sit in judgement of our disenrollment case ignored every piece of evidence in our favor and merely rubberstamped their own foregone conclusion.

    We can document that the deciding votes on the enrollment committee served our family member with disenrollment papers even before any evidence had even been presented that would have merited even opening up a disenrollment investigation and that when their initial challenge was disallowed they got their family members and friends to submit statements against us instead.

    Article V of the Temecula Band's constitution and bylaws, sometimes referred to as the Pechanga Band of Mission Indians says:

    "IT SHALL BE THE DUTY OF ALL ELECTED OFFICIALS OF THE BAND TO UPHOLD AND ENFORCE THE CONSTITUTION, BYLAWS, AND ORDINANCES OF THE TEMECULA BAND OF LUISENO MISSION INDIANS; AND ALSO, TO UPHOLD THE INDIVIDUAL RIGHTS OF EACH MEMBER WITHOUT MALICE OR PREJUDICE."

    So how was allowing biased people with a clear conflict of interest to rule on and be the deciding votes against us not a violation of this equal protection clause?

    And this isn't the only violation of our constitution and bylaws that occured when we the Hunters were disenrolled.

    Old Pechanga, don't you have any interest in seeing that the true rule of law prevail?

    Or do you just care about keeping your larger share of the profits that you get and even if you had nothing to do with our disenrollment, which I think may be the case, you going along with it is in effect silent approval of injustice.

  86. Gentle readers, do you think any of our critics will ever explain how the Band's constitution and bylaws wasn't violated?

    All they have, and it really is a huge, huge roadblock, is sovereighty but deep down, if they really know the truth, they know it was wrong what they did to us but they think we can't do anything about it.

    So if you are right, old Pechanga, the tribal hack, or Mr. Potato Head, or whoever, answer how our conatitution and bylaws was not violated but use fact this time and not just general statements.

    Mind you the issue about recusal of officials dealing with our case wasn't the only violation either.

It surprises me that you would say that last paragraph...so if Macarro voted you back in you would vote with him?...its hard to believe that you would after all the heartache he has caused you..of course I am not a tribal member , but read this site often because I used to gamble at Pechanga...if he is a snake now(according to this site)..why support him if he puts you back in?..because of money??..I have more respect for your plights than this flip-flop of support for him.

  88. That last paragraph is a direct reflection on what is said in many houses, or under many oak trees in the political sense of Pechanga. These same favors is what made Pechanga what it is today. Do me a favor and I'll vote the way you want me to. It has been a pure democracy for 10,000 yrs. Kicking people out because they do not vote the way you think has tainted the democracy and will be hard to repair.

The credibility and greed component is back on the disenrollees back if they are willing to comprimise their principles and support a person whom they labelled as a tyrant,to gain entrance to the palace. This attitude moves you closer to your greedy captors and makes you just another wannabee with the money people, and you have no human rights issue, only greed. You weaken your plight when you sell your souls to the devil.

    It's greed to lose your heritage because your family members wanted to do what's right and get a family not related to us enrolled?

    Macarro had many of our votes. He's doing what the CPP wants so he can stay in "power".

    Money and all that comes with it is a right that belongs to ALL Pechanga, whether that money is $30,000 a month, or $3,000.

    There has been no selling of souls to the devil. The devils are in the CPP.

  93. There is no recall attempt. It is a rouse with smoke and mirrors, by the CPP to see who is not following there little game. Jennie stands up and shouts out at tribal meetings that it is not hard to determine votes by clans. Mark says people sit with their own clans and it is easy to see who supports who. Don’t forget, these people have been strategizing the take over of Pechanga for over 30 yrs. Every thing that comes out of these people mouth is a lie. They will look you in the eye, and stab you it the back. It looks like a recall effort, but they are trying to see the cracks in their plans. Never, ever trust them. The writing is on the wall.

    Any time they feel threatened they come up with some little political move. It gets people talking, and they can feel people out to see where they stand. Either your with them or against them. The CPP is a political nightmare.

  94. There are cameras, and microphones everywhere. Mark uses these devices along with his other CPP friends to play the political puppet games. He uses Jennie, Raymond, Ed, Gloria et al. to make it look like they don’t like each other. He then uses the electronic devices to monitor others views as to what just happened. People believe that Mark keeps the game clean. Wrong, they are all in it together. Wake up people. The leadership is rotten to the core.

    They say that other families are working the political games, but who plays these roles out? its clearly the CPP.

That sounds just like something Marcy and the bald woman would do, for we know that the rest are like sheep except for the potato he's a perv looking for little kids. I know that this is just me spewing meanness and it does not contribute to our efforts, but I can't get close enough to say anything to their face so why not just piss them off every once in a while, What are they going to do to me sue me? Let them I don't have anything that is worth taking
