Follow the Money UPDATE: Theft of Per Capita BY TRIBES Nearing Half Billion $ Mark

In January we posted a story about the theft of Per Capita/Benefits by gaming tribes.  Now, it's closer to HALF of a BILLION DOLLARS! And that's just for Pechanga, Redding and Picayune ALONE.

Eric Bolling of Fox Business Channel's Follow the Money ( Follow The Money" with Eric Bolling...taking you inside the world of corruption, abuse of power, and shocking betrayals of public trust. We follow the money wherever it goes.) asked me to send him links about the actions of tribes and their disenrollment practices after tribal gaming. I've sent him numerous links, but thought I'd make a post of it. I've asked friends from Redding Rancheria and Picayune Rancheria to let me know of their losses, and I invite citizens from other tribes to let us know what they've lost.

From the Pechanga Band of Luiseno Mission Indians in Temecula CA:

The Hunter Family has lost $1,295,000 per person, in per capita payments alone. We arrived at that figure by taking the last full year of per capita $268,000/12 months and multiplying that loss times 58 months of disenrollment. 95 adults at the time of disenrollment equals: $123,056,000

The Apis Family was disenrolled the year prior in 2005. The per capita was slightly less about $17,000 per month times 62 months of termination: $1,054,000 times 135 adults equals: $142,290,000

Moratorium people NEVER shared in what was rightfully theirs. The per capita went up to $360,000 per year for those remaining after elimination of tribal citizens.

From the Picayune Rancheria in Coarsegold, CA:
In the case of Chukchansi Gold, the casino has been averaging $4 million per month in payments to the Tribe over the past 18 months (as reported to me by a former Tribal Council member).
The tribe disenrolled 625 members who were making $3,200 per month. This equates to $96,000,000 stolen. The word from that reservation is that they wanted to further reduce their population.
Lets add what we have so far:

Pechanga: $318.3 MILION Includes additional $21 Million in Health Insurance. Corrected Insurance due to coverages, some double covered as family. Per capita losses are $200,000 PER DAY.  Does not include educational assistance and there are many college eligible students not receiving their scholarships.

Picayune: $ 97.0 MILLION Money is from share of dollars casino sends to tribe per person.  Read more on Picayune Rancheria HERE 

Redding: $ 33.3 MILLION Per capita only. Totals being tabulating but includes tribal JOBS lost.

Mooretown: $ 10.9 MILLION     Read more on Mooretown Rancheria HERE

Enterprise: $ 2.2 MILLION No Per Capita. Tribe gets revenue allocation. Losses include housing help.
I'll update per capita losses from other tribes as I get information. Also bear in mind, the tribe save on health care coverage for citizens and dependents they terminated. $12,000 per year for Pechanga times 600 people should be over $35 MILLION more. CORRECTION: Cost is per family, so number is reduced from $35 Million.

And the tribal coucils will say, it's NOT about the MONEY! But it IS because so many have lost homes, health insurance because their rightful per capita was taken away.  Add that to the loss of voting rights, right to attend meetings, elder assistance, and the fact that some tribes like Pechanga have tried to steal water rights and it's a problem don't you think?

WHEN IS THE PECHANGA MEMBERSHIP GOING TO FINALLY REALIZE THAT NO ONE IS SAFE FROM THOSE SOB'S AND THAT THIS COULD HAPPEN TO THEM IF MARK MACARRO AND HIS HENCHMEN DECIDE THEY NEED MORE MONEY, WHICH ONE OF YOU IS NEXT TO BE ILLEGALLY DISENROLLED? I WOULD THINK HARD ABOUT THIS "IT CAN, AND PROBABLY WILL HAPPEN TO YOU." IT'S TIME TO START TO HEAL PECHANGA, AND BRING BACK ALL THAT HAVE BEEN DISENROLLED FOR THE GOOD OF THE TRIBE, AND OUR "HERITAGE."

  5. We don't need to change the minds of the membership we just need to give a lot them some guts to stand up for what is right and insist that a duly passed tribal law be enforced.

    The membership voted in July 17, 2005 to outlaw disenrollment but we were disenolled on March 16, 2006 anyway.

    We found out just two days before we got our walking papers that we were not included in the new law, obviously timed so that we couldn't respond to the bogus ruling by the tribal council.

    The tribal council claimed in its March 14, 2006 letter to the membership informing them that we the Hunters were not included in the new law outlawing disenrollment the following:

    1. The membership couldn't overrule the enrollment committee regarding enrollment or disenrollment, that it violated tribal legal precedant.

    However the tribal membership, after the heirs of Rose Murphy were turned down for membership by the enrollment committee, voted in April 1986 to overrule the committee and to take them in, including current sitting tribal councilman Russell Butch Murphy, as tribal members.

    So it was the tribal council's ruling in March 2006 that actually violated tribal legal precendant and the people are in fact the final authority regarding enrollment and disenrollment.

    2. That the 2005 law outlawing disenrollment didn't change the tribal membership requirments.

    However, we maintain that we meet the requirments and that biased enrollment committee members with a clear conflict of interest who were close relatives of witnesses against our family who submitted hearsay against us with absolutely no facts to back up their contentions and that the slim majority on the committee ignored key documented evidence from both current tribal elders who directly contradicted what the elders who submitted statements against our family claimed as well as tribal elders from the historical period of when the reservation was created.

    By the way, the tribal council allowing biased people with an with a conflict of interest to rule on our disenrollment case violated the equal protection clause of the Pechanga Band's constitution and bylaws under Ariticle V which forbids malice or prejudice against tribal members.

    We sent at least six letters to the tribal council and the enrollment committee requesting that those enrollment committee members in question be made to step aside from ruling on our case and we would have been cleared from disenrollment if the council had not violated its own equal protection clause.

    I will again briefly compare evidence that was for us and evidence that was against our family in another post.

WITH THIS IN MIND, THE "MACARRO CARTEL" WAS THE SOLE INSTIGATOR IN THIS BLATENT DISENROLLMENT PROCEEDING OVERLOOKING ALL THE RELIVENT DOCUMENTATION THAT WAS PRESENTED AT THE TIME THE VOTE WAS TAKEN BY THE ENROLLMENT COMMITEE. TRIBAL LAW WAS IGNORED, AND "MARK MACARRO" WAS DIRECTLY RESPONSIBLE FOR THIS ACTION. TO BE RECOGNIZED AS ALLOTEES' ON RESERVATION PROPERTY SHOWING LINEAGE TO THE TRIBE, AND THEN BEING DISENROLLED FOR NOT BEING TRUE PECHANGA. YOU CAN'T HAVE IT BOTH WAYS. THE VOTE TO STOP DISENROLLMENT WAS IN 2005, AND WE WERE DISENROLLED IN 2006, A YEAR HAD PASSED WITH THIS LAW IN EFFECT AND THE VOTE TO DISENROLL US CAME ABOUT. "ONE YEAR." WHAT WAS THE GENERAL MEMBERSHIP THINKING WHEN THEY LET MARK MACARRO PULL OFF THIS ILLEGAL ENDEVER. IT GOES AGAINST THE CONSTITUTION AND BY LAWS THAT ARE SUPPOSED TO STOP ANYTHING LIKE THIS FROM EVER HAPPENING. ISN'T THERE A TRIBAL COURT THAT CAN ADDRESS ISSUES THAT CAN SORT OUT WHAT IS RIGHT OR WRONG ON WHAT IS ILLEGALLY TRANSPIRING AT PECHANGA? WHY THE TRIBAL COUNCIL WON'T FOLLOW THERE OWN LAWS AS IT IS WRITTEN? THEY SURE REVERSED THEMSELVES WHEN THEY ILLEGALLY BROUGHT IN BUTCH MURPHY, NOT PECHANGA, AND VOTED THE HUNTERS' OUT, WHO ARE PROVEN PECHANGA. CAN SOMEONE TELL ME HOW THE HELL THIS CAN HAPPEN WITH WRITTEN LAW AGAINST THIS FROM EVER HAPPENING.

I do believe that the constitution mentions that the general membership is the final authority and that it would only take a simple majority to overturn an action that the enrollment or council makes even if it is on behalf of the people. People are now more white than Indian for they have adopted the white man’s way of individualize and immediate self gratification, whereas the people used to be a communal society where families were used to living in a generational family unit with aunts, uncles, and grandparents and the needs of the many were considered first. I do not believe there are enough elders to straighten out the young for the young have grown teeth like rats and they bite their parents. Who will guide them and teach them the important things of life.

During the debate of the measure the Pechanga legal department declared that it was within the tribe’s authority to pass this petition as written into law per the Temecula Band of Luiseno Mission Indians Constitution and Bylaws, sometimes referred to as the Pechanga Band of Mission Indians (title of the tribe is from the preamble of the Band’s Constitution and Bylaws). So the all the provisions of this law are legal and binding.

    Also during the debate of the measure Chairman Mark Macarro said, when asked if the Hunters were covered by the new law if it was passed, “all means all” So it was very clear that the people were voting to end all disenrollments including the pending Hunter case. In addition, elder Norman Pico commented that disenrollment was not even mentioned in the Constitution and Bylaws so it was not stipulated that the enrollment committee had the final authority in such matters so the people were the final authority to stop the Hunters disenrollment which they did when they approved the law outlawing disenrollment. Smokey, even though Butch Murphy's family were turned down by the enrollment committee for membership the people overruled the committee and accepted them in 1986 so we may be stuck with them but if the people could vote to take them in, then they could and did vote in 2005 to stop our, the Hunters, disenrollment.

    I am typing this directly from the tribe's constitution and bylaws:

    Article VIII regarding membership meetings states, "THE SIMPLE MAJORITY OF MEMBERS PRESENT SHALL RULE AND DECIDE IN ALL MATTERS OF GOVERNMENT AND BUSINESS OF THE BAND, UNLESS STIPULATED IN THESE BYLAWS."

    Nowhere in the constitution and bylaws does it say the enrollment committee is the final authority on who gets enrolled or disenrolled (even if the disenrollment law was still in effect, which it wasn't)

    There is one exception regarding enrollment though because the Band's constitution and bylaws states in Article II regarding membership the following:

    "THE MEMBERSHIP ENROLLMENT WILL BE OPENED THE FIRST MONTH OF EACH YEAR BY THE BAND'S ENROLLMENT COMMITTEE."

    So the moratorium, which originally was only supposed to be for one year so the committee could catch up on all the applications that were coming in, shoud have been thrown out as unconstitutional a long time ago.

    Maybe our benefactor who said that he or she could get us enrolled actually might have the guts to insist that the duly passed law outlawing disenrollment be followed?

    It would be nice if that is the case, but I think it more likely he or she is just trying to string us along.

  21. Smokey, I did talk to someone recently who has an idea on how to get some publicity with the press and has a press contact that might pan out, that is if his contact is interested in doing the story, but I don't know if this is the same person posting here.

    We do get people here who are not being helpful so I guess we will see.

    The person I talked to said that the press contact did express some interest so it might be something that would be good for all of us, not just our family.
