More Evidence In Pala Disenrollments TRUMP Robert Smith's Phantom Evidence He Refuses To Show.

We have received two bits of information from the disenrollees of Pala. This seems to trump any evidence the Robert Smith says he has, but won't show. Mr. Smith, have you NO SHAME?   2. great letter, hope Mr. Smith realizes his decision could make Pala look good or look bad. The public is starting to look down on the gaming reservations because of the way they treat their people, they are getting sick of hearing about more and more disenrollments. The executive committees are their own demise, they are helping to destroy their tribes little by little. Be ware enrolled members, you could be getting way more per-capita if Robert got rid of some of your lawyers. Howard makes hundreds of millions off your tribe and Robert hands it to him. Look to see where your kids money is being held, make sure it is there. The disenrollees can't locate theirs for their children. You are being tricked and lied to, Robert thinks of you as fools, he knows you will believe him as long as you get your money.

    People of Pala, here is something I bet you didn't know. The tribal budget is placed in an account that draws interest while the money is waiting to be used. Did you ever get any of the interest in your per-capita? The tribal budget is larger than that of many cities of over 100,000 people. There are 1000 at most in Pala, but every year all the money gets used up. There is never any surplus to apply to the next year's budget. The funds for economic development also go into an account the pays interest. That interest never makes it into your hands either. The trust funds for the children don't get seen until the kids are 18. Plenty of oppotunity to play with the money, earn some interest, and divert to an offshore account.

    These things are happening. Robert Smith really is taking this interest money for himself. That is why he won't open up the books. Then you would see all the dirty deals in all their filthy glory.

    R-r 2:30 People of the tribe are scared to ask questions in regards to $$ or anything else fear of retribution from Robert smith and the EC. They do not realize they are probably owed more $ then they are getting. I hope they are starting to see all the decisions of their great leader in the past as this letter explains was not for their benefit but rather for smith and his EC to pocket more money for themselves and protect themselves not the tribe. Start asking questions pala members about the money you will soon see we know more than they think we do about what has been going on. The MB issue is only a small slice of this pie that your leaders have done wrong just wait you will see.

  6. Robert and his EC have been hiding lots and lots of money. They pocket interest from the funds sitting waiting for disbursements. They get all the interest from the minors money sitting there for years. Howard Dickstein was sued and settled out of court for $16,000,000 and it is rumored that Robert gave him the money. It was a year that there was suppose to be a raise in the per-capita and there was not one. Where's the $20,000,000 he was going to use to buy back Warner? How come he can afford 5 houses? Everything he does and everywhere he goes is paid for by the tribe. How many tribal members are allowed in his private box at the stadium with season passes? It is supposed to be tribe owned by the tribe? How many get to use one of the three jets the tribe owns. Just really start noticing the things he is getting away with and the money he is spending. Like covering for his niece who committed a hit-n-run and supposedly she was intoxicated. He really thinks he is above others.

    Why do you think Teresa Nieto gives the tribal members watered down financial reports, never provides hard evidence of casino profit/loss statements, she's controlling and manipulating all the records, thinking you are too dumb to catch on.

    It's time for tribal members to stop taking this and be responsible for the path of their tribe! It's not too late.

  8. Here we go getting off topic. The budget, the budget, the budget. Why the hell did you guys approve the budget without going through it? Why is it brought up at the May meeting when it should have been brought up in December? We can place the blame on the EC all we want but its time to start holding ourselves accountable. Some of you are so ill informed its not even funny.Back to the jet thing. Now its three jets. When that was brought up in a budget meeting a few years back everyone saw the jet use and not one person said a thing then. I know a lot of people are upset I sympathize with you. I am more and more on your side everyday but stick to what you are fighting for. When you go off topic people who are on the fence with this issue tend to go the other way. We can only get so much per capita. 60% of what we get from the casino. Much more I would like to say but its best not. But please stick to what you are fighting for. The approach that is being taken is the same approach you feel others are doing.

    There is no way to know how much money there is because the financial reports are vague. As far as per-capita goes you could argue that the tribal budget could be trimmed by $30mil, Howard Dickstein's fee could be trimmed by $20mil and the interest on economic development could be paid out in bonus. That is somewhere around $56mil that could be distributed.

    It's not the per-capita that is the biggest problem. The biggest problem is that the per-capita is 60%, but there is 40% left over that never makes it into the tribes hands. This money is supposed to be used for economic development, but it may as well be Robert Smith's private bank account. If the money was invested wisely, the earnings could be distributed. So just a quick calculation: Say the casino pulls in $800mil a year. Net is $400mil, subtract Dickstein's 5%, leaves $380mil. Subtract Tribal Operations, leaves $280mil. Subtract 60% per capita leaves $115mil.

    This is actually pretty close, because the per-capita comes out to $165mil, and spread over 1000 members you get $165k each. If there's 900 members, thats $183k each. But that $115mil could be working for the tribe. And that should have been multiplying through the years as more gets invested. Who got extra money from the Casino expansion?

    This is all guesswork though. It doesn't get us reinstated, but it does reveal the magnitude of theft and waste going on with the current administration.

    The truth is being hidden or kept from tribal members.

    The truth about Margarita Brittain's blood degree, as well as possibly financial reports.

    I think the point trying to be made is that people are being mislead by their government officials. And it can be about someone's blood degree, or about money, or about business ventures, etc.

    I think what they want is a government that is honest and forthcoming. How can being honest about blood degree (true lineage) be harmful? How can honesty about business ventures and profits be harmful to the tribe?

    From all the evidence I've seen (and that's a lot...including Chairman Robert Smith's "book" of "evidence" sent out) I can see that the majority of evidence shows Margarita Brittain as full blooded.

    And I'm not a Brittain descendant.

    You are right about accountability though...that when it comes time to look over the budget the tribal members should really take the time to look it over.

    Yes, there are 3 jets and fuel expenses. (Jet information is public since you have to file a flight plan etc. So go look it up.) Those belong to the tribe. The tribe should have fair use of them, and if not should vote to sell them as part of fiscal responsibility.

    This is all part of the point. The tribe's members should be accountable for their decisions. But they should have good strong honest leaders with their best interests as a whole tribe in mind when making decisions.

    The Margarita Brittain issue has been settled by The Department of Interior and has been made final. The Brittain descendants have a ton of evidence supporting their blood degree. So far the Chairman has produced no real evidence and when asked to on TV he says "We're sovereign we don't have to show anything."

    That is not proof. That is a claim. And it is a false claim.

    The BIA can not help us. The courts cannot help us. Maybe it's time for Indian Law cases to be revisited all the way up to the supreme court..and things changed.

    IF every tribal member in the US was under a magic microscope, 1/4 of them probably would not meet blood requirement set up by the tribes. OF course some tribes don't care what "degree" you are, as long as you are a lineal descendant is all that matters.

    Once someone IS a Tribal Member there should be no "going back" later to "dis-enroll" someone...but it is like what happened with Hitler...everyone is afraid, and if they make waves, they may be targeted next.

    The US Supreme did make a ruling, and Tribes can determine their own membership. Key word there: Tribes.

    The Executive Committee is not the Tribe. They don't even represent the Tribe. Leroy Miranda has no right to be on the EC. We signed a petition to have him removed. Robert Smith lied and said some people took off their signatures. Robert Smith fixed elections. He couldn't win reelection without dismantling the people.

    The Enrollment Ordinance of the Pala Constitution states:

    BE IT FURTHER RESOLVED, the Executive Committee of the Pala Band, by adoption of this ordinance, does not intend to alter or change the membership status of individuals who have already been approved and who are currently listed on the membership roll of the Pala Band of Mission Indians, nor does it intend to change the membership status of those persons whose membership applications have previously been disapproved.

    There is a Savings Clause in the Pala Constitution:

    All enactments of the Tribe adopted before the effective date of this constitution shall continue to be in effect to the extent that they are consistent with this constitution.

    So the General Council vote to change Margarita Brittain's blood degree to full blood in 1984, a prior enactment of the Tribe is still in effect.

    Robert Smith violated the Constitution. It is a matter of fact.

    The Brittain descendants meet eligibility in accordance with the Tribal constitution. The BIA, who approved the constitution, has several stated this several times.

    The EC did violate their own constitution by not adhering to their savings clause on the MB issue which was decided and finalized in 1989 before the constitution was "approved" they have violated the disenrolled civil rights and with no due process. The BIA has a fiduciary duty to step in on this matter and require the EC to reinstate their membership.

    Ah, so it's my fault that Fearless Leader has disenrolled myself and 161 other family members, cut us off from our heritage, and our rightful share of benefits. It is my fault that he used our money to hire the lawyers that helped him do it. It's my fault that I didn't save my money just like Robert Smith does, siphoned off cash, and hid it away in offshore accounts.

    I am going back to work; I have to. However, I never earned as much working as I got from per-capita, and that bought me a house that I can't afford now. So even with a job I will lose my home. It is sad, because I did nothing wrong to deserve this. I only ran afoul of Robert Smith's desire to disenroll people.

    Dennis Turner and Robert Smith also assumed ownership of the Pala Mototcycle Raceway. The one that was built without General Council approval using Tribal funds. They split the profits, give the Tribe the paltry land use fees and act like it is a good thing for the Tribe.

    Dennis Turner is Robert's buddy, and Dennis Jr. operates the Raceway and gets a cut too. But the people of Pala don't deserve to share, and MB descendents had to be disenrolled because it's the right thing to do.

    If he did these things outside the reservation it would be easy to prosecute him. But sovereignty makes him bold, and the people with the power, the Tribe, give their power up to him. That is how it works with power: Use it or lose it.

    Now we discover that the Pala Raceway is owned by Chuck Perrault. Pala still sends employees Frank Spurgeon and Shasta Gaughen over to check decibel levels and install noise level metering. The Pala tribe paid to build the Raceway. Robert Smith gave the go ahead even though the General Council never approved it. Now somebody named Chuck Perrault owns it. How much did he pay Pala for it? I bet Robert Smith got all the money, and the tribe is still on the hook to send employees over there to fix things for Perrault. Just another of the wonderful deals swung by Chairman Smith. The crap never stops. He hates his people, he steals their money, he sells their property and keeps it all so secret. What a scumbag.

  52. I have heard that there has been a request submitted to the pala EC to have the blood degree rocinda nolasquez looked into. That explains the sudden influx of alot of these disrespectful, misinformed, facts backwards, comments. It seems rocinda's decendents have gotten wind of this request and are lashing out . This blog was being used by educated, respectful bloggers who seem to be well versed in factual historical documents, now we must all put up with / or ignore all this disrespect, and misinformed comments of these poor people who have been raised on lies and misinformation.     I heard that something like that is in the works. Here are the facts as I see them. On Roscinda Nolasquez' 1928 California Indian Roll application she lists herself as full-blood Agua Caliente. Her father, Salvador Nolasquez, is listed as Mexican Indian. Since the puporse of the application is to join a class action lawsuit against the US for misappropriation of California Indian lands, only California Indian were allowed to participate. Therefore an amendment was made to her blood degree changing it from full-blood to half-blood on the application.

    If the Pala EC follows its own constitution, and the precedent established by disenrolling MB's descendents, then all the descendents of Roscinda Nolasquez should be disenrolled also, including Mel Lovato, since they misrepresented or omitted evidence that would make them ineligible for membership in the tribe. Their blood degree is also affected since Roscinda Nolasquez' blood degree was amended and many may not have sufficient blood quantum.

    This is the problem with using the 1928 California Indian Roll to establish blood degree. The 1913 Pala Allotment Roll should supercede the 1928 roll. For me it would be even worse to have more disenrollments. We do not want disenrollments. We want to be a people that respects their laws, lives together with civility, and provides for the common welfare.

    The Pala Executive Committee was the first to tip the scales and it seems they have misused documentation. It seems only fair to open up questions into the other lineage.

Any second grader will tell you when daddy hits them, he can be brought to justice, and he cannot hide behind his claim he was just trying to be a good daddy. Any third grader will tell you that the RS and the EC can be sued in court and forced to defend by arguing their disenrollment actions where all within federal and tribal law before the judge will let them get their "get out of jail free" tribal sovereign immunity pass. Tribal officials in New Mexico were sued not long ago in their official and individual capacities in federal court recently all over a casino gambling contract dispute where the plaintiffs are arguing tribal defendants' actions that damaged them were done all outside federal and tribal law. Let's see RS tear the federal civil summons and complaint off Kings door now. Any idiot who thinks RS and the EC were acting within their lawful authority to get rid of the 162 needs to check themselves in to rehab. RS can't be so smug to think all remedies to solve this American Tragedy won't be pursued including a big fat suit against him and the other guilty parties. Back in June '11 the ship left the dock and RS could have wisely called it back in. He can only blame himself for looking like our own American version of a middle eastern despot who jets around with family in tow putting on a smiling face to continue his charade that all is well in never never land. Does he have cowards for lawyers? Step up lawyers for RC and face everyone cause you are also responsible for our American Lynching (professional malpractice?). How much is Elmets paid to try to put a spin on lies to make them look like truths? RS and his lackeys are not good enough to turn their own smelly farts into nice perfume. Only thing they do well is to hand out $$ to and ask "do my farts smell good?" Before the $$ are given to those with out stretched hands, they must say "yes, your hindness." That is the moral filth and garbage that RS has dumped in public by his evil actions!

  60. rocinda was a young girl so she had nothing to do with mb there were many others like i said before m.b. died at what age 60some years old in what year 1925 so she was way older than rocinda but you wanna blame her if you were so right king why didnt you enroll your kids at birth come on people 1980s when there were no more elders rocinda wasnt the one at the meeting saying they dont got the blood. so all those people back than knew so stop blaming one person when there is over 100 plus signatures stating to not honor the enrollment and the some of those people are dead so quit blaming when there was far more vocal people than rocinda not one of you shared or cared about our kupa language.quit blaming like i said who would say at the meeting to you king you dont got the blood and it wasnt rocinda.

It is Margarita's descendants finally listening to their elders and taking up the fight for their rightful heritage.

    No one says Rocinda had anything to do with MB or her blood degree. What we are saying is that her father, Salvador Nolasquez was listed on the 1928 California Indian Rolls as a Mexican Indian. Because he was Mexican he wasn't entitled to California Land and couldn't participate in the lawsuit for restitution for the US taking land that belonged to Indians.

    Someone named Barbara Warwish checked off on an amendment to Roscinda Nolasquez's blood degree, changing it from Full-blood to half-blood. So read carefully now. The 1928 California Indian Roll shows Roscinda Nolasquez as 1/2 blood. The 1928 California Indian Roll says Margarita Brittain's father is unknown.

    We know who MB's father is though. He father is Pelegrino Saubel/Ortega. I don't why you guys can't get it through your thick skulls, but my guess is that it is hereditary. You are the descendents of the same people that falsified MB's records, and have consistently lied about her blood. It is a long standing hatred that serves no purpose. And it really makes you appear to be ridiculous and unreasonable.

    Well we don't return the hatred. We want justice. We want to be treated fairly using the same laws as you. If we don't get due process and equal protection, then we will continue to stir the pot and show how the EC is denying our civil rights, and discriminating against us. That means we have to dig through the records of all the members of Pala and show how they stand based on the 1928 California Indian Roll just as it has been used against us. This will make our case much stronger as we proceed.

    There is still time for the EC to revert to the truth of the 1913 Pala Allotment Roll. If I were a member of Pala I would insist on it. There are hundreds of people who will come under scrutiny as we push forward.

  63. I dont understand how some people just cant get it through their hate filled heads what happened in the 1980's. Its so sad that you can explain it over and over and they still kling to and ask the same old stupid and already answered questions. Simply put...a process was started in 1983 by 3 female elders, all decendents of MB who discovered that some spineless weasel took a pen and crossed out MB 4/4 blood degree and wrote 1/2 on the 1913 P.A.R kept by the tribe or the B.I.A. in riverside...(whoever this was could not afford a trip back to washington to do the same to the original 1913 roll kept by the dept. of interior)...so there were many decendents of MB who at birth could not be enrolled until the bia corrected the change made, it was finalized in 1989 after a full investigation by the B.I.A. that took almost 5 years. Of course we cant expect you to understand the process that took place back then because you refuse to , its more selfserving for you to ask the same stupid questions because sadly, its all you have, or your just to dumb to understand what gets explained here by people who have spent countless hours researching offical historical documents to say what they say on this blog

    It is because of hate and stupidity. That is how this EC will be remembered when they pass. They have consistently lied, stolen, threatened, manipulated, cheated, and blamed others for their sins. They are incompetent and useless at anything but crime.

    Robert Smith will go down as Pala's evil tyrant, the less than a man that thought he was sovereign. He will be known as the racist despot that hated his tribe, and as the theif that shamelessly stole the future of the people.

    I am sure of this, because I will write that history myself. We must be sure to learn about history lest we repeat these errors and ever again allow one mean-spirited jerk make a shambles of our people.
