Did Pala Chairman Robert Smith Vandalize? Or is he just a JERK?

That video shows what a pathetic man Smith has become. Don't let anyone know the truth. He has to hide it at all costs. Its sad the 200 plus pages he sent tribal members that didn't mean squat was a bunch of bs wrapped in a pretty package. Smith all you do is use smoke and mirrors to sway people to think you actually have "evidence". If you have this so called "evidence" why are you so afraid to let the people of the tribe see it. Because we all know the truth and the truth is you are WRONG. Sovereign or not you are WRONG. The TRUTH is out there. People will see it and stand up to you. The time is coming.
This video revealed the true personality of Chairman Smith. He wants people to believe he's a just and moral leader, who is dedicated to the people, and is worthy of respect. It is all an act. He really wants to hurt people, to keep everyone under his thumb, to do as he pleases without any consequences, while he hides behind his position and sovereignty.
He behavior is irrational, childish, cruel, and vindictive. Exactly the opposite of what is required to be a good leader. No wonder he is such a failure as a leader and as a person.
Wow! This just shows how he doesn't want people to see the truth. He told the tribe they didn't file in a timely manner the BIA revealed in the letter he lied and he has the audacity to go to someone else's place of business and take down the letter that proves he lied. The tribe needs to realize what a piece of work their leader is and what a liar he is.

The video tells the truth, if you read the documents, go to the nctimes and look up the interview by Smith given to Ed Sifuentes, see and understand the chronology of the events, then it's pretty clear. If you need more evidence, than I can add more documentation to the video, such as the minutes of the meeting where Smith told the General Council that they did not file in time and how a motion was then made by members of the General Council to have Smith request the letter from the BIA acknowledging the appeal was timely filed (which he did and it proved he was lying), but I think that would be overkill. You just need to read the documents, pause the video and read them again to understand.
"How do we know the Pala disenrolled aren't lying?" 1. They have nothing to lose. 2. Video evidence speaks for itself. 3. BIA has supported them. 4. The 1989 Acting Assistant Secretary directive that MB was 4/4 supports them. 5. Original census reports support them. 6. They are willing to show the documents they have and do not hide behind soverignty.
Now which particular thing do you suspect them to be lying about?
smith, leroy, theresa, and dion must paint a pretty picture with the BIA and his other partners as they cooperate and provide documents and representation to support his scams and fabrications. I wonder if they (bia) know how he actually treats people who question him, and then dupe the others with threats and lies.
Eben is either a partner or was lied to at least twice by smith. One is with the 1928 probates in which Eben advises smith that those docs do not determine tribal membership. But smith used the 1928 class action lawsuit anyway as bedrock evidence to "factually" determine no father, so no enrollment. The other lie was the sand and gravel money. Somehow smith duped Eben into releasing those funds to smith to distribute which is a clear violation of procedure. So either smith lied to Eben or Eben has a partnership with him. So smith is either creating this peacful, trustworthy image with the bia that his tribe wholly supports his actions and he is just "making things right" or has a partnership, even though smith himself said the BIA "talks out of both sides of their mouth." Hopefully officials in the BIA and the Interior watch the video closely and see just a glimpse about how vindictive he really is. Ironic that the letter he rips in half is from the aunt (amy d) of the lawyer (sarah d)who helped him disenroll which the disenrollees helped finance! What a Jerk or better yet, what a Joke!

Are you implying this is a waiting game? What incentive does the BIA have to hold off on a "recommendation" for the Pala "disenrolled". They have already, repeatedly, stated that the "disenrolled" should be reinstated. It makes no sense that the BIA would sit on the newest batch of "disenrolled" for nearly 5 months unless they were biding their time to let everything "calm down." Or to run the "disenrolled" out of money and resources in hopes that they will give up.
The "disenrolled" aren't giving up. They know the truth, and they know they belong. No matter what they have lost as far as money, the truth is the truth.
The longer the BIA waits on it's "recommendation" the more suspicious it looks.
We need to pin the tail on the donkey. The BIA did not disenroll us. It was Robert Smith and the Executive Committee that did the dirty deed.
Did the BIA help them? Maybe, but it is very hard to prove.
Does the BIA have a duty to step in and act? That is part of the argument of our appeal, and we are waiting for their response.
Dennis Chappabitty told me that it is possible that the reason for the delay is that this matter has escalated to the top level of the BIA, meaning acting Assistant Secretary of the Interior Indian Affairs, Del Laverdue. Amy Dutschke did see the interview with KCBS and noted the diatribe from Chairman Smith that the BIA talks out of both sides of its mouth.
We can't trust the BIA to do the right thing though. It is time for Pala to go off so to speak, to ditch their failed leader, reinstate the disenrolled, and see what life is like without the fear, intimidation, greed, avarice, duplicity, and dishonesty embodied in Robert Smith.

To save tax dollars: The US government could pardon and release some felons who are incarcerated, regardless of the crime, and have an Indian tribe "adopt" them such as Pala, then tell the criminals do whatever they damn well please--lie, steal, manipulate, harm others for no reason, sell drugs, tell the government to kiss their ass, etc.. When questioned by authorities or the media, the felons can just reach into their wallet and pull out their tribal spokesman patented "I'm sovereign card" and no questions will be asked, no matter how serious the crime. The leaders of the tribes could actually train the felons how to use their "no hassle" reward card. If a person is one of the leaders of a tribe and has already committed a crime or discriminated against a group of people, the government will grant a "no hassle" sovereign immunity card to he/she and family rather than investigate and enforce laws and final decisions. Things wouldn't be much different than they are now as vindictive leaders and their families apparently are sovereign against all of the above, even much worse.
Do not get discouraged! There are many actions being taken by good people to help us in our fight for justice. When you see the minions of Robert Smith posting here, trying to say the disenrollees might be liars, you are really seeing the impact of the truth. They never offer any evidence, never tell the truth, but only try to pull the disenrollees down. They are trying to undermine our efforts, so be strong and cling to the truth. We can never be faulted for our honesty, and we have committed no crimes. RS and his cronies have come under fire and they are trying to do damage control. No amount of their lies can ever cover up the heinous nature of their actions.
But why hasn't the BIA helped the Pechanga dis-enrolled? They sit back and watch Macarro do the same thing and why isn't Jenny arrested yet?...if it was a non tribal person she would be in jail already....it's supposed to be all men are created equal in America....nowhere does it exclude Native Americans....why the special treatment....money?
The BIA should help the Pechanga disenrolled also. I think it's a matter of exposing the truth. Tribes adjusting to life with casinos and lawyers have found "loopholes" in the law. The BIA should have stepped up to protect the rights of any and all descendants but I don't think they knew how back then. And each reservation is it's own Nation, so there are sometimes slight differences in each situation.
And I think all men were created equal yes, but the founding fathers of the United States did not always see Native American's as their equal. There has been a lot of prejudice in the histories of the tribes through out the United States.
There are laws that do protect Native Americans, but more must be done considering what has happened. In the recent News segment featured on this blog, they say that Congress should help. If that's what it takes.
Fighting for the rights of everyone is important. Either you have your rights or you have lost them, but everyone should be on the same page as having those rights protected.
You never know if you will wake up one day and in your mailbox is a letter from your Tribal Government saying you don't belong anymore. You may think "Oh no, not me. I know my heritage." Guess what? So did the "disenrolled". Everyone has equal rights to be protected, and Congress (if no one else) should help.
Oh, and I'm not saying "No one else can help." The BIA, tribal general councils, and state courts all can help. Politicians can help. Casino customers can help by going to casinos that do not have citizenship disputes. And everyone can help by being honest about what is really going on.
It would also be helpful if "still in" members who are concerned, fearful, frustrated, or feeling oppressed who may have information that is helpful, discretely contact the lawyers representing the "disenrolled" with information about any crimes or suspicious activity.
Fearing "treason" or "banishment?" Guess what? You shouldn't have to be fearing those things. That's part of the problem. You have freedom and rights that should be being protected.
I don't mean to sound bad , but look at the Washington tribe (a Federal Judge told the tribe not to banish those 9 members ) they did and told the Judge to POUND SAND ?

Congress can waive a tribe's sovereign immunity to suit. Or congress can create an Act protecting the interests of the anyone "disenrolled" by a tribe by allowing for review of such cases. Or the general council of a tribe can waive the sovereign immunity of the executive committee.
Just because there is little that can be done doesn't mean that nothing can be done.
It would be nice if the general council would waive the immunity, and by doing so, remove people who make bad decisions with their money. This would protect the tribal body, it would be done legally, it would probably greatly benefit the tribe financially (even though no one wants to talk about money), it would protect the lineage of true descendents, it would protect the family relationships so that people don't have to "choose sides" and overall protect the integrity of the tribe and it's members.
Don't forget that the General Council can vote to impeach the Executive Committee, elect new officers, and obtain a temporary waiver of immunity so the sheriffs can remove the old officers. It's a bold move, but perfectly legal, and only requires that a majority of the General Council votes in favor of the action. Wouldn't that be a nice way to treat those that have ripped you off?
Yes. The executive committee members are simply elected officials. The general council still holds the greatest power. The BIA or other officals can assist a general council in removing (impeaching) current leaders and allow new representives to be elected.
The general council has the power to fully waive soverign immunity or they can do a limited waiver of soverign immunity...this limits it to the grounds specified such as only waiving it for the executive and/or enrollment committee in order to resolve an enrollment dispute. Or they can do a limited waiver of soverign immunity to have an audit of the tribal businesses, contracts and financial records.
Why is it that all your Chiefs look like crooks?...an outsider looking at Smith or Macarro would see it, but your tribes dont?...how do they gain so much trust to get put in that position?...and why do the majority of the tribe put up with their crap?...promises of more per cap?..tribes should want more members ...not less...there is strength in numbers...but the all might dollar gets in the way...got to buy another house or car or jet...everyone just sits by and collects the monthly check....which I am sure is actually getting smaller and smaller every year....with good reason...KARMA!

You are mistaking Chairman Smith for the Tribe again.
I said the TRIBE can waive the rights. The adult voting members. Chairman Smith is not the TRIBE.
And I said they can LIMIT the terms of the waiver. They can limit it to only have the enrollment or executive committee as individuals, and the rest of the tribe remain protected.
They can request a TRO ((Temporary Restraining Order) for Chairman Smith and any other member of the executive council so that the voice of the actual Governing Body (GENERAL COUNCIL) can be heard without interference.
Of course the Chairman wouldn't permit himself from being removed.

And we do have impeachable offenses on record. For instance the constitutional violations that were committed in disenrolling members. The Savings Clause of the Tribal Constitution was violated, as well as the Enrollment Ordinance. So anytime the General Council wants to hold impeachment hearings, they have the grounds in place.
Is the General Council ready to see whatlife is like without Robert Smith? After seeing his performance in this video, hearing of his many self-serving and illegal activites, and measuring the accomplishments of his leadership, I think there is no doubt that the tribe will be better off without him. This video is just a scratch on the surface of the many wrongs Robert Smith has committed against the people, be it moral or financial. He continues to dupe the General Council, lining up his cronies to promote his agenda, rewarding his cronies with benefits. Have you ever wondered how much goes on behind the scenes with these people? How much tribal monies are spent on giving these cronies more than generous allowances, paying excellent wages to sub par workers? We all know it's wrong! Robert Smith is like the Emperor with no clothes, we all see that he has no clothes, but none of us has the guts to stand up to him and tell him to put some clothes on! Well, when those who choose to stand up to him do, you see how it goes, he punishes you. In some cases, he will take your per cap away for a year (like he did with those two young men, educated men). Or how he did to King's kids and nieces and nephews ("I'm going after King and his kids" and "Your kids are OFF THE ROLLS" - quotes from Robert Smith prior to disenrollments commenced.) I can tell you this, at least this man is consistent in that he is a horrible, sneaky, unjust, conniving, leader.
I guess there must be some balance, so if the Trujillos aped it up, then they should be called on it and learn to behave. Does that warrant disenrollment? They weren't accused of bad behavior, and there is plenty of that in every family. Look at Robert Smith's kids. But RS can use tribal money to buy Bonnie Dumanis, the San Diego DA that RS has in his pocket, so the bad stuff just goes away for a price.
As long as we're talking about Smith's wrongdoings and duplicity, here is a case in point. Why is the Chairman campaigning for a candidate for mayor of San Diego? Pala is a sovereign nation. There is no need to use tribal money to help elect politicians outside the rez. Doesn't anyone else see the stupidity in contributing to outside governments? That money should be going to invest in the future of the Tribe, not to prop up some crooked politician.
This is how much RS believes in sovereignty. He only believes when it is convenient or when it can be used to prevent outside forces from closing in on him. Once again he is caught talking out of both sides of his mouth.
It's not much different than San Manuels ex leader trying to get into city government to swing things towards San Manuel....why doesn't he stay in his tribes business?...either way it's probably to benefit the tribe from the outside.
What I don't understand is why a Tribe(sovereign nation) needs to contribute, and if Tribal money is being "donated" to a outside sovereign politics....is there a vote with the General Council on which candidate they are supporting?
There is a difference between a Chairperson donating personal funds and a Tribal Chairperson donating Tribal funds.
All this money belongs to the tribe, it's basically coming out of their per-capita. Do they get a say on where it is being spent? And do they realize how much exactly is being spent on these political contributions?
Take that phone conversation that happened on January 19, 2012 with Santa Ana City Council member Michelle Martinez where she said that Pala was going to come in big with some IE's (independent expenditure)...but then later Pala (Elmets) denied Pala intended to support her, but turns out that Pala had contributed $1000 in November 2011 to her.
That whole situation seemed a bit odd.
So, does the General Council know which candidates their money is going to, and are they in fact in support of these candidates?

I think the point you are making is that there is favoritism at the tribe. (???)
The issues at hand seem to be: 1.Does this favoritism have anything to do with the disenrollment of the 160 descendents of Margarita Brittain? 2. Is the "missing" or "withheld" money belonging to the 'disenrolled' being used in political contributions to sweep the 'disenrollments' under the rug? 3. Does the rest of the Tribe know this is what is really going on with the budget, spending, contributions, businesses, etc? 4. Does the 'disenrollment' action have to do with the desire to silence certain descendents questioning the finances of the Tribe and the actions of the Executive Committee?
I may have missed the point, but this is what I am getting reading these comments.
Campaign contributions do not come from per-capita. They come from the economic development funds. They are not about sweeping the disenrollments under the rug, but are all about buying influence in the outside sovereignty. The tribe knows diddly squat because they are either closing their eyes, have been intimidated, or believe that RS is doing the right thing.
Here is what the disenrollments are about:
1) Hate. RS hates the MB descendents. He doesn't even know most of them. When I tried to meet him, he sent Leroy Miranda to intercept, and ignored me. I guess I'm not good enough for him.
2)It is about silencing opposition. Some of us tried to speak up and question his actions. We can't have that now, can we?
3)It is about getting rid of a powerful voting block. Some of us didn't vote his way. As if he actually does what people vote for, but he is all about appearances.
4) Lastly it is about showing the other tribal members what will happen if they oppose him. Now he can keep everyone in line because they know he isn't afraid to abuse his power.
Maybe I am too honest, but at least I can say what needs to be said.

Yes, that is the reason for the hate. It is Hatfield/McCoy shit. It goes all the way back to 1903 when Kupa people were forced to move to Pala because the California Supreme Court decided that some rich guy was more entitled to their land than they were. The Pala Allotments were supposed to split up the land and make everyone happy, but some people got better land than others, and so enmity was the result. Really though, the Kupa people did not get the better land. It's just that the Pala people didn't like sharing.
I don't blame them. This was not their choicem and not ours either. We tried to make the best of it, but the resentment has lasted over a century, and no one blames the BIA anymore. Instead they say we don't belong because of some chicken scratching on the 1913 census rolls, and because Mel Lovato says his granny told him we didn't belong.
My God! Look at all the crap that RS has done, and yet the descendents of MB are the bad guys. How blind can you get?

Can anyone confirm this? I am deeply concerned for all the disenrolled still living on the rez if this is the case. First they get your name and picture posted. Then they start restricting your access to roads, the Tribal Hall, the Casino Resort, the Cemetery, and who knows what else. Get ready for segregation just like at Pechanga.
I sure hope there is still some heart in the Tribe and that they don't let this happen. The disenrollees are not the bad guys. They don't need to have wanted posters put up or to be marked as undesirable. We did not do anything wrong, and we still have our rights to be treated equally. Sovereignty can't take that away.

There is 190 descendants with the same blood degree, why aren't the other 28 disenrolled? Why were they saved? If you are going to claim the blood quantum reason then do it for all the people who are the same blood degree, not just the ones you choose to do. There are other families whose blood should be in question are they next? It would eliminate another 400 members, some of them are talking behind the EC's back, it is time to be honest about the whole thing and stop destroying the tribe and the morale on the reservation. It's not right to say a bunch of people don't meet blood quantum and kick them out after the U.S. Government has stated they DO meet blood quantum.
It's even more unfair if there are other people who are still enrolled don't meet blood quantum and are supporting the disenrollment of others but not being honest with themselves.
If there is evidence that one group is disenrolled for not meeting quantum but another group is still enrolled but doesn't meet blood quantum I think that someone should get those documents and show them to prove that this may be more about who is friends with who than actually about protecting the lineage and blood degrees of the tribe.

On the 1928 Applications she is called "Margarita Saubel" by her children, and they name her mother as Miguella Owlinguish.
My understanding is that Saubel took the name Ortega and they can be the same family name. I am unsure as to why there was a change.
Have you ever looked over the family trees in William Duncan Strong's book? I believe he explains Ortega/Saubel.
I have never seen her headstone so I can't tell you why a name was used or not used.

And to be clear: Usually a girl is born and is given her father's last name at birth. When she gets married she takes her husband's last name.

How much was the BIA paid? How much did RS give Robert Eben to release the Vulcan money, or to help him find his phony evidence that he used to justify disenrollment? The people were confused long before 1988, and that hasn't changed to this day. RS has been lying to the people all along, and like an eagle soaring above he has laid his droppings on his own people.
We have proof on our side. Proof is evidence that supports your statements. You have what? Show us what you got if you can overturn the evidence. Even RS can't reach into the National Archives and change the BIA Census records. No one on our side had to pay the BIA because the truth was there to be found.
Now about the so called slander. It's only slander if you can't back it up with evidence. I am looking at the record of Roscinda Nolasquez right now. Mel Lovato is part Yaqui. Sylvario Nolasquez was a Mexican Indian, and according to the 1928 California Indian Roll blood quantum derived from a tribe not native to the US can't be included in the total blood degree.
This 1928 California Indian Roll is the same one that lists Margarita Brittain's father as unknown. So why is it correct for MB and incorrect for Mel Lovato? Easy answer. Mel Lovato has for long been telling people MB was 1/2blood, and RS wanted his support, and to get back at the Trujillos. So there, only truth no lies or slander.
Is RS is a thief? Ask him what he did with the $10mil the tribe invested in San Pablo Lytton Casino. That casino didn't go bankrupt or out of business, and yet RS reported the investment lost. Funny how that seems to happen with all the tribe's investments.

The answers were given in 1928 when California was a US State and Mexico was Mexico.
On documents for people born at Kupa or "Agua Caliente" they identify on the 1928's as such. They do not say "Born in Mexico, but now that's California, and it was really at ____."
If they were born at one of the CA Indian villages they state which village.
Out of the 200 or so 1928's I've seen in my life, I can assure you that if it says "Mexico" they do not mean "California."
You have to look at when the document was filled out, not when the person was born.

First, everyone has a mother and a father. Secondly, even if both parents were listed, if a known parent was of any other lineage (white/black) it was noted and the children were usually marked as 1/2. If the children had any Indian blood it was marked as Indian.
Sylvario Nolasquez was born in Mexico and his children say he is Mexican Indian. They say their mother Merced Saubel is born at Agua Caliente.
There is a distinction made between the two points of origin after the border between CA and Mexico had be established.
Sylvario Nolasquez was not indigenous to California. Therefore his blood can not be counted according to the BIA.
If a parent was "unknown" it did not mean they did not exists.
If Margarita Brittain's children called her by her maiden name Saubel, and Saubel is a well known Native name from the histories written about Southern California tribes, one has to acknowledge that her parentage wasn't "unknown" but that her father was a Saubel. They list Miguella Owlinguish as Margarita's mother, but they do not use this as Margarita's birth name.
Merced Saubel is also called Saubel on her children's 1928 applications and they don't even list Merced's parents names as grandparents at all.
If Merced Nolasquez parents are not listed on the 1928s, do we assume they are "unknown?"
Sorry if you don't like what the 1928 California Indian Roll says, but that was an exact quote copied directly from the application of Roscinda Nolasquez. The 1928 Roll was to sign up California Indians for a lawsuit against the US for misappropriation of land; it was correct to disallow Mexican Indians.

It is my understanding that Mel Lavato was scared his house was going to be burnt down by Smith and his friends years ago, and that a Lavato witnessed the murder of a young man in the Campgrounds, it goes to figure that it must have been Mel that witnessed this murder and that might be why Robert keeps him on the enrollment, because he does not want Mel to tell the truth about his brother Andrew. Restitution-reinstatement hit it right on. Pala uses the 1913 allotment roll to determine membership. The 1913 roll lists MB as 4/4 Indian( the original copy in DC). RS and the EC should be using that as basis for enrollment. Plain and simple. If they are using anything other than that which violates the civil rights of the disenrolled then they should not be. There is a possiblity it was Jose Ortega who was filling out apps for lots of the tribal members at Pala. MB was dead at the time and I haven't heard anyone say the reason an app was filled out for a dead person.
The family history card for Merced Nolasquez says her parents were Pelegrino Ortega and Miguel Ortega and lists Margarita Britten as her half-sister. Since we know that Miguela Owlinguish was her mother from other census records we can document her parentage. In direct testimony during the probate hearing for Merced Nolasquez, Carolina Nolasquez stated:
Q: Did Merced Nolasquez have any brothers or sisters? A: She had three half-brothers, Ambrosio Ortega, Jesus Ortega, and Juan Ortega. They are all living. They had the same father but different mothers. She had five half-sisters, Margarita Britten, Rafaela Owlinguish, Melvina Sibimooat, Ysadora Michao, and Marcella Sibimooat. They had the same father, but different mothers.
There you have it. Documented evidence from the family history card, and personal testimony from Carolina Nolasquez. This testimony was coroborated by each of her siblings present at the probate hearing.
This is no secret. The BIA presented this evidence to RS back in 1989 when the Asbra/Mills decision was explained to the Pala Executive Committee. No one paid for or solicited this evidence. It was compiled by the BIA document specialist in order to make a judgement on an appeal to correct MB's blood degree.
Now if you are going to question the identity of MB's father, it takes a certain stubborn stupidity at this point. To cling to a judgment made by the EC of Pala, who are not professional document examiners like Elsie Lucero, didn't review the BIA Census records from 1923, 1924, and 1925, and have intentionally omitted the Merced Nolasquez probate records in order to deceive the Tribe, is a spiteful and vindictive choice. It harms a lot of people, it is dividing the Tribe, and it is going to make it difficult to heal the wounds afterwards.

There is every reason to believe that the BIA will decide in our favor. That doesn't mean they will compel the tribe to reinstate us. We will have a way to go to court, but first we must exhaust our administrative remedies. It won't be over. Maybe RS won't be chairman forever. The People of Pala could vote someone else in. Wow, all the elders who knew MB signed the petition in the 1980's. Which petition was that? You mean the one that was overturned by a General Council meeting in 1984? MB did marry a white man, but he was not the father of all her children. From what I tell from the Census records, her first five children had a father named Jose Santos. He died sometime in the late 1880's or early 1890's, and was probably not Indian. That is why MB's children are considered half-blood. No secrets here. No hiding Yacqui blood, or implying illegitimate children, or that someone was whoring. Just the honest truth. Can you do the same?

The vice chairman of the Pala Band of Mission Indians, which owns a large casino and resort in North County, is due in court next week for an alleged probation violation stemming from a lewd conduct conviction in Riverside County last year.
Pala Vice Chairman Leroy Miranda, 44, was cited on Nov. 6, 2009, by Moreno Valley police for allegedly soliciting a prostitute at the Happy Time Adult Book Store in Moreno Valley, according to court records. He pleaded guilty to a misdemeanor charge of lewd conduct in February 2010.
Under terms of the plea, Miranda agreed to pay a fine of $570, enroll in an AIDS education program, stay away from the Happy Time Adult Book Store and wear an electronic monitoring device, also known as an ankle bracelet.
Christopher Coburn, Miranda's attorney, declined to comment.
According to court records, Miranda violated one of the terms of his probation by failing to complete the electronic monitoring program. A court hearing is scheduled for Friday to address that violation.
Miranda was elected vice chairman of the 1,100-member tribe in 2001. He has been a leading voice for the tribe against the proposed Gregory Canyon landfill, a project to turn 1,770 acres of land adjoining the Pala Indian Reservation into a dump.
Miranda is also the director of the Cupa Cultural Center on the Pala Indian Reservation, which is about 15 miles north of Escondido and east of Interstate 15. The center is the cultural hub of the Pala reservation and houses a small collection of Indian artifacts, tools, vessels and old photographs.
On the tribe's website, Miranda is described as a graduate of Sherman Indian High School in Riverside. He lives on the reservation with his wife and family, according to the website.

Sept 23, 2012. The vice chairman of the Pala Band of Mission Indians was arrested on suspicion of being drunk in public at the tribe's casino early Saturday morning, according to the Sheriff's Department.
Deputies were called to the casino at 1:47 a.m., according to a Sheriff's Department report. Pala Vice Chairman Leroy Miranda, 46, was arrested shortly after deputies arrived at 2:56 a.m. Miranda was booked into the Vista jail at 4:13 a.m. and later released, according to the Sheriff's Department.
Officials at the Valley Center sheriff's station declined Tuesday to comment on the details of the incident.
Miranda was elected vice chairman of the tribe in 2001, one of six members of the tribe's governing council. He is the director of the Cupa Cultural Center, a museum on the reservation, according to the tribe's website.
Doug Elmets, a spokesman for Pala, said the tribe is reviewing the incident and declined further comment.
"The allegations are currently under investigation and the executive committee of the tribe will review the circumstances of the incident," Elmets said in a written statement.

The feud goes back years, but critics say the removal of the tribal members was spurred by a failed effort to recall Miranda last year. Former Pala Chairman King Freeman, whose family members were expelled from the tribe, told the North County Times last year that the recall effort began after he learned about Miranda's 2009 arrest in Moreno Valley.
Miranda could not be reached for comment by phone Tuesday afternoon at the Cupa Cultural Center.

Sadly, we've found out that one of the original eight he had terminated, died from consequences of alcohol abuse, exascerbated by the despair brought on by the termination of her family. Smith has ignored the Bureau of Indian Affairs admonition that the Marguerite Brittain family should remain in the tribe based on their family proving they belong. Smith is on record as saying he won't show the "evidence" he has because "we are a sovereign nation and we don't have to" during an interview by Cristy Fajardo of KCBS TV. He is serving his eighth consecutive two-year term on the council and is in his 14th year as Tribal Chairman. Macarro's vision for the Pechanga people is to see the band strengthen its political self-determination and economic self-sufficiency by developing a diversified economy for the Pechanga Band while maintaining its distinct and unique cultural identity.
A national leader, Macarro represents Pechanga in the National Congress of American Indians (NCAI) as an alternate area Vice-President of the Pacific Region 2007-2009 and represents the Pacific Region on the board of directors for the National Indian Gaming Association (NIGA). He is a member of the Electoral College 2008 US Presidential Election, 2008 Platform Committee Member of the Democratic Party and a member of the Board of Governors, Harvard Honoring Nations. In 2008 he was presented as a Pathbreaker Award Honoree at the 20th Annual IGRA Symposium.
He also served as a Riverside County Board of Supervisors appointee to the County Historical Commission and served on the board of directors of Borrego Springs Bank, NA. In the 1990s as a charter board member, Chairman Macarro helped found the Advocates for Indigenous California Language Survival (AICLS), a non-profit organization with the mission of funding tribal language speakers in the state.
Macarro served as program manager for the library and museum of the Rincon Reservation from 1992 through 1995, as the director of youth education at Soboba Reservation's Noli School from 1990 through 1992, and began his career in Indian country as a grants/contracts administrator for the Pechanga Reservation in 1988. Macarro also served as a credentialed substitute teacher for grades 7-12 in the Riverside County Schools system, the San Jacinto Unified School District, the Colton Joint Unified School District, and Riverside City School District.
Macarro has a Bachelor of Arts degree in political science from the University of California, Santa Barbara.
Chairman Macarro's father, the late Leslie Macarro, was a Pechanga tribal member and a correctional peace officer killed in the line of duty in May of 1988 while working for the California Youth Authority. Mark's great-grandfather, Juan Macarro (1851-1920) served as Captain for the Pechanga Band during the first decade of the 1900's and was also a Nukwáánish singer. Among southern California tribes, the office of chairman was formerly called "captain."

The Pechanga Tribal Council consists of six members and one chairperson. General elections are held every two years. If a vacancy occurs, a special election is held to fill the vacant council position. The tribal council meets at least on a monthly basis, and reports to the General Membership (which meets at least once a month). The tribal council sets policies, administers government programs and executes the will of the General Membership. The General Membership, by law, must vote on all Pechanga Reservation land-use decisions.
The tribal chairperson and members of the council are charged to uphold and enforce the Pechanga Band's Constitution, bylaws and tribal ordinances. They are also responsible for upholding the rights of each tribal member, without malice or prejudice. The tribal council members are obligated to act always in the best interest of the Pechanga Band.

The history of Pechanga begins with our ancestral home village of Temeeku. Now under Redhawk, where Margarita road cuts south through a bluff, the Temeeku Village was home to the Temeekuyam and a center for all Luiseño Tribal peoples.
Post-Contact
Gregoria Pajovish at Pechanga after the eviction The payomkowishum, or Luiseño People were nearly destroyed by events and actions from first contact with Spanish Missionaries. Turbulent times continued with the eviction of our tribe from traditional lands in the 1870s. The Pechanga reservation was established by Executive Order of the President of the United States on June 27, 1882, affirming Pechanga Tribal sovereignty and our land-base.
The Missionaries In 1798, Spanish Missionaries founded the Mission of San Luis Rey de Francia, forever altering Luiseño tribal life and pressing the Luiseño people into servitude, slavery or imprisonment. The Roman Catholic Church established ranchos that encompassed the native villages. The newcomer Spanish identified the tribes living in the territory claimed for Mission San Luis Rey as Sanluiseños, or simply, Luiseños.
Eviction After the establishment of the state of California in 1850, a group of Temecula Valley Ranchers petitioned the District Court in San Francisco for a Decree of Ejection of Indians living on the land in Temecula Valley, to which the Temeekuyam could show no clear written title on April 15, 1869. The court later granted the decree in 1873. Several attempts by the Temeekuyam captains to stay the decree were unsuccessful, and our fate was sealed.
In 1875 a posse led by the sheriff of San Diego County, Mr. Hunsaker, began three days worth of evictions. The video tells the truth, if you read the documents, go to the nctimes and look up the interview by Smith given to Ed Sifuentes, see and understand the chronology of the events, then it's pretty clear. If you need more evidence, than I can add more documentation to the video, such as the minutes of the meeting where Smith told the General Council that they did not file in time and how a motion was then made by members of the General Council to have Smith request the letter from the BIA acknowledging the appeal was timely filed (which he did and it proved he was lying), but I think that would be overkill. You just need to read the documents, pause the video and read them again to understand.

Eben is either a partner or was lied to at least twice by smith. One is with the 1928 probates in which Eben advises smith that those docs do not determine tribal membership. But smith used the 1928 class action lawsuit anyway as bedrock evidence to "factually" determine no father, so no enrollment. The other lie was the sand and gravel money. Somehow smith duped Eben into releasing those funds to smith to distribute which is a clear violation of procedure. So either smith lied to Eben or Eben has a partnership with him. So smith is either creating this peacful, trustworthy image with the bia that his tribe wholly supports his actions and he is just "making things right" or has a partnership, even though smith himself said the BIA "talks out of both sides of their mouth." Hopefully officials in the BIA and the Interior watch the video closely and see just a glimpse about how vindictive he really is. Are you implying this is a waiting game? What incentive does the BIA have to hold off on a "recommendation" for the Pala "disenrolled". They have already, repeatedly, stated that the "disenrolled" should be reinstated. It makes no sense that the BIA would sit on the newest batch of "disenrolled" for nearly 5 months unless they were biding their time to let everything "calm down." Or to run the "disenrolled" out of money and resources in hopes that they will give up.
The "disenrolled" aren't giving up. They know the truth, and they know they belong. No matter what they have lost as far as money, the truth is the truth.
The longer the BIA waits on it's "recommendation" the more suspicious it looks.
We need to pin the tail on the donkey. The BIA did not disenroll us. It was Robert Smith and the Executive Committee that did the dirty deed.
Did the BIA help them?

That is part of the argument of our appeal, and we are waiting for their response.
Dennis Chappabitty told me that it is possible that the reason for the delay is that this matter has escalated to the top level of the BIA, meaning acting Assistant Secretary of the Interior Indian Affairs, Del Laverdue. Amy Dutschke did see the interview with KCBS and noted the diatribe from Chairman Smith that the BIA talks out of both sides of its mouth.
We can't trust the BIA to do the right thing though. It is time for Pala to go off so to speak, to ditch their failed leader, reinstate the disenrolled, and see what life is like without the fear, intimidation, greed, avarice, duplicity, and dishonesty embodied in Robert Smith.

To save tax dollars: The US government could pardon and release some felons who are incarcerated, regardless of the crime, and have an Indian tribe "adopt" them such as Pala, then tell the criminals do whatever they damn well please--lie, steal, manipulate, harm others for no reason, sell drugs, tell the government to kiss their ass, etc.. When questioned by authorities or the media, the felons can just reach into their wallet and pull out their tribal spokesman patented "I'm sovereign card" and no questions will be asked, no matter how serious the crime. The leaders of the tribes could actually train the felons how to use their "no hassle" reward card. If a person is one of the leaders of a tribe and has already committed a crime or discriminated against a group of people, the government will grant a "no hassle" sovereign immunity card to he/she and family rather than investigate and enforce laws and final decisions. Things wouldn't be much different than they are now as vindictive leaders and their families apparently are sovereign against all of the above, even much worse.

Do not get discouraged! There are many actions being taken by good people to help us in our fight for justice. When you see the minions of Robert Smith posting here, trying to say the disenrollees might be liars, you are really seeing the impact of the truth. They never offer any evidence, never tell the truth, but only try to pull the disenrollees down. They are trying to undermine our efforts, so be strong and cling to the truth. We can never be faulted for our honesty, and we have committed no crimes. RS and his cronies have come under fire and they are trying to do damage control. No amount of their lies can ever cover up the heinous nature of their actions.
But why hasn't the BIA helped the Pechanga dis-enrolled?

The BIA should help the Pechanga disenrolled also. I think it's a matter of exposing the truth. Tribes adjusting to life with casinos and lawyers have found "loopholes" in the law. The BIA should have stepped up to protect the rights of any and all descendants but I don't think they knew how back then. And each reservation is it's own Nation, so there are sometimes slight differences in each situation.
And I think all men were created equal yes, but the founding fathers of the United States did not always see Native American's as their equal. There has been a lot of prejudice in the histories of the tribes through out the United States.
There are laws that do protect Native Americans, but more must be done considering what has happened. In the recent News segment featured on this blog, they say that Congress should help. If that's what it takes.
Fighting for the rights of everyone is important. Either you have your rights or you have lost them, but everyone should be on the same page as having those rights protected.
You never know if you will wake up one day and in your mailbox is a letter from your Tribal Government saying you don't belong anymore. You may think "Oh no, not me. I know my heritage." Guess what? So did the "disenrolled". Everyone has equal rights to be protected, and Congress (if no one else) should help.
Oh, and I'm not saying "No one else can help." The BIA, tribal general councils, and state courts all can help. Politicians can help. Casino customers can help by going to casinos that do not have citizenship disputes. And everyone can help by being honest about what is really going on.
It would also be helpful if "still in" members who are concerned, fearful, frustrated, or feeling oppressed who may have information that is helpful, discretely contact the lawyers representing the "disenrolled" with information about any crimes or suspicious activity.
Fearing "treason" or "banishment?" Guess what? You shouldn't have to be fearing those things. That's part of the problem. You have freedom and rights that should be being protected.

The only thing your lawyer can do is sue the BIA and question their administravtive procedures (and thats what I would do).

Congress can waive a tribe's sovereign immunity to suit. Or congress can create an Act protecting the interests of the anyone "disenrolled" by a tribe by allowing for review of such cases. Or the general council of a tribe can waive the sovereign immunity of the executive committee.
Just because there is little that can be done doesn't mean that nothing can be done.
It would be nice if the general council would waive the immunity, and by doing so, remove people who make bad decisions with their money. This would protect the tribal body, it would be done legally, it would probably greatly benefit the tribe financially (even though no one wants to talk about money), it would protect the lineage of true descendents, it would protect the family relationships so that people don't have to "choose sides" and overall protect the integrity of the tribe and it's members.
Don't forget that the General Council can vote to impeach the Executive Committee, elect new officers, and obtain a temporary waiver of immunity so the sheriffs can remove the old officers. It's a bold move, but perfectly legal, and only requires that a majority of the General Council votes in favor of the action. Wouldn't that be a nice way to treat those that have ripped you off?
Yes. The executive committee members are simply elected officials. The general council still holds the greatest power. The BIA or other officals can assist a general council in removing (impeaching) current leaders and allow new representives to be elected.
The general council has the power to fully waive soverign immunity or they can do a limited waiver of soverign immunity...this limits it to the grounds specified such as only waiving it for the executive and/or enrollment committee in order to resolve an enrollment dispute. Or they can do a limited waiver of soverign immunity to have an audit of the tribal businesses, contracts and financial records.

I said the TRIBE can waive the rights. The adult voting members. Chairman Smith is not the TRIBE.
And I said they can LIMIT the terms of the waiver. They can limit it to only have the enrollment or executive committee as individuals, and the rest of the tribe remain protected.
They can request a TRO ((Temporary Restraining Order) for Chairman Smith and any other member of the executive council so that the voice of the actual Governing Body (GENERAL COUNCIL) can be heard without interference.
Of course the Chairman wouldn't permit himself from being removed.

And we do have impeachable offenses on record. For instance the constitutional violations that were committed in disenrolling members. The Savings Clause of the Tribal Constitution was violated, as well as the Enrollment Ordinance. So anytime the General Council wants to hold impeachment hearings, they have the grounds in place.
Is the General Council ready to see whatlife is like without Robert Smith? This video is just a scratch on the surface of the many wrongs Robert Smith has committed against the people, be it moral or financial. He continues to dupe the General Council, lining up his cronies to promote his agenda, rewarding his cronies with benefits. Have you ever wondered how much goes on behind the scenes with these people? How much tribal monies are spent on giving these cronies more than generous allowances, paying excellent wages to sub par workers? We all know it's wrong! What I don't understand is why a Tribe(sovereign nation) needs to contribute, and if Tribal money is being "donated" to a outside sovereign politics....is there a vote with the General Council on which candidate they are supporting?
There is a difference between a Chairperson donating personal funds and a Tribal Chairperson donating Tribal funds.
All this money belongs to the tribe, it's basically coming out of their per-capita. Do they get a say on where it is being spent? And do they realize how much exactly is being spent on these political contributions?
Take that phone conversation that happened on January 19, 2012 with Santa Ana City Council member Michelle Martinez where she said that Pala was going to come in big with some IE's (independent expenditure)...but then later Pala (Elmets) denied Pala intended to support her, but turns out that Pala had contributed $1000 in November 2011 to her.
That whole situation seemed a bit odd.
So, does the General Council know which candidates their money is going to, and are they in fact in support of these candidates?

The issues at hand seem to be:
1.Does this favoritism have anything to do with the disenrollment of the 160 descendents of Margarita Brittain?
2. Is the "missing" or "withheld" money belonging to the 'disenrolled' being used in political contributions to sweep the 'disenrollments' under the rug?
3. Does the rest of the Tribe know this is what is really going on with the budget, spending, contributions, businesses, etc?
4. Does the 'disenrollment' action have to do with the desire to silence certain descendents questioning the finances of the Tribe and the actions of the Executive Committee?

Campaign contributions do not come from per-capita. They come from the economic development funds. They are not about sweeping the disenrollments under the rug, but are all about buying influence in the outside sovereignty. The tribe knows diddly squat because they are either closing their eyes, have been intimidated, or believe that RS is doing the right thing.
Here is what the disenrollments are about:
1) Hate. RS hates the MB descendents. He doesn't even know most of them. When I tried to meet him, he sent Leroy Miranda to intercept, and ignored me. I guess I'm not good enough for him.
2)It is about silencing opposition. Some of us tried to speak up and question his actions. We can't have that now, can we?
3)It is about getting rid of a powerful voting block. Some of us didn't vote his way. As if he actually does what people vote for, but he is all about appearances.

Yes, that is the reason for the hate. It is Hatfield/McCoy shit. It goes all the way back to 1903 when Kupa people were forced to move to Pala because the California Supreme Court decided that some rich guy was more entitled to their land than they were. The Pala Allotments were supposed to split up the land and make everyone happy, but some people got better land than others, and so enmity was the result. Really though, the Kupa people did not get the better land. It's just that the Pala people didn't like sharing.
I don't blame them. This was not their choicem and not ours either. We tried to make the best of it, but the resentment has lasted over a century, and no one blames the BIA anymore. Instead they say we don't belong because of some chicken scratching on the 1913 census rolls, and because Mel Lovato says his granny told him we didn't belong.

Can anyone confirm this? I am deeply concerned for all the disenrolled still living on the rez if this is the case. First they get your name and picture posted. Then they start restricting your access to roads, the Tribal Hall, the Casino Resort, the Cemetery, and who knows what else. Get ready for segregation just like at Pechanga.
I sure hope there is still some heart in the Tribe and that they don't let this happen. The disenrollees are not the bad guys. They don't need to have wanted posters put up or to be marked as undesirable. We did not do anything wrong, and we still have our rights to be treated equally. Sovereignty can't take that away.

If you are going to claim the blood quantum reason then do it for all the people who are the same blood degree, not just the ones you choose to do. It's even more unfair if there are other people who are still enrolled don't meet blood quantum and are supporting the disenrollment of others but not being honest with themselves.
If there is evidence that one group is disenrolled for not meeting quantum but another group is still enrolled but doesn't meet blood quantum I think that someone should get those documents and show them to prove that this may be more about who is friends with who than actually about protecting the lineage and blood degrees of the tribe.
If this is about blood, then it's about blood. We should know if it's about blood quantum or if it's about money and politics.

It's obvious this issue will not see an end anytime soon. The issue should have been settled when the U.S. government looked into it between 1984 and 1989 (?) but for some strange reason keeps being brought up.

On the 1928 Applications she is called "Margarita Saubel" by her children, and they name her mother as Miguella Owlinguish.
My understanding is that Saubel took the name Ortega and they can be the same family name. I am unsure as to why there was a change.
Have you ever looked over the family trees in William Duncan Strong's book? I believe he explains Ortega/Saubel.
I have never seen her headstone so I can't tell you why a name was used or not used.
If her children called her "Margarita Saubel" on their 1928 Applications, and not by her married name "Brittain" nor by her mother's name "Owlinguish" do you believe they were calling her by her birth name? That is how it appears to me.
And to be clear: Usually a girl is born and is given her father's last name at birth. When she gets married she takes her husband's last name.

How much was the BIA paid? How much did RS give Robert Eben to release the Vulcan money, or to help him find his phony evidence that he used to justify disenrollment? The people were confused long before 1988, and that hasn't changed to this day. RS has been lying to the people all along, and like an eagle soaring above he has laid his droppings on his own people.
We have proof on our side. Proof is evidence that supports your statements. You have what? Show us what you got if you can overturn the evidence. Even RS can't reach into the National Archives and change the BIA Census records. No one on our side had to pay the BIA because the truth was there to be found.
Now about the so called slander. It's only slander if you can't back it up with evidence. I am looking at the record of Roscinda Nolasquez right now. Mel Lovato is part Yaqui. Sylvario Nolasquez was a Mexican Indian, and according to the 1928 California Indian Roll blood quantum derived from a tribe not native to the US can't be included in the total blood degree.
This 1928 California Indian Roll is the same one that lists Margarita Brittain's father as unknown. So why is it correct for MB and incorrect for Mel Lovato? Easy answer. Mel Lovato has for long been telling people MB was 1/2blood, and RS wanted his support, and to get back at the Trujillos.

The answers were given in 1928 when California was a US State and Mexico was Mexico.
On documents for people born at Kupa or "Agua Caliente" they identify on the 1928's as such. They do not say "Born in Mexico, but now that's California, and it was really at ____."
If they were born at one of the CA Indian villages they state which village.
Out of the 200 or so 1928's I've seen in my life, I can assure you that if it says "Mexico" they do not mean "California."
You have to look at when the document was filled out, not when the person was born.

First, everyone has a mother and a father. Secondly, even if both parents were listed, if a known parent was of any other lineage (white/black) it was noted and the children were usually marked as 1/2. If the children had any Indian blood it was marked as Indian.
Sylvario Nolasquez was born in Mexico and his children say he is Mexican Indian. They say their mother Merced Saubel is born at Agua Caliente.
There is a distinction made between the two points of origin after the border between CA and Mexico had be established.
Sylvario Nolasquez was not indigenous to California. Therefore his blood can not be counted according to the BIA.
If a parent was "unknown" it did not mean they did not exists.
If Margarita Brittain's children called her by her maiden name Saubel, and Saubel is a well known Native name from the histories written about Southern California tribes, one has to acknowledge that her parentage wasn't "unknown" but that her father was a Saubel. They list Miguella Owlinguish as Margarita's mother, but they do not use this as Margarita's birth name.
Merced Saubel is also called Saubel on her children's 1928 applications and they don't even list Merced's parents names as grandparents at all.
If Merced Nolasquez parents are not listed on the 1928s, do we assume they are "unknown?"
Sorry if you don't like what the 1928 California Indian Roll says, but that was an exact quote copied directly from the application of Roscinda Nolasquez. The 1928 Roll was to sign up California Indians for a lawsuit against the US for misappropriation of land; it was correct to disallow Mexican Indians.
That is why we use the 1913 Pala Allotment Roll to determine eligibility for enrollment in the Tribe, and not the 1928 California Indian Roll. That is unless you are Robert Smith and talk out of both sides of your mouth. If you are him then you can say 1928 for these guys, 1913 for these guys, but only if I like you.
Margarita was a widow in 1903, and that is why her husband is not listed. All of MB's children are listed as 1/2 blood. It only doesn't make sense if you try to force the facts into a lie.
While we are talking about these matters, let me lake it clear that we only want equal protection under the law. The truth is that the 1913 Pala Allotment Roll marks the beginning of Pala as a federally recognized tribe. No other document can supercede it.

RS and the EC should be using that as basis for enrollment. Plain and simple. If they are using anything other than that which violates the civil rights of the disenrolled then they should not be. You need to reed the affidavit of Elsie Lucero page 13, it says right there that Carolina claims Merced had five half sisters, same father different mothers. Unless you were alive then and know differently than her own daughter, this is written verified historical information.
There is a possiblity it was Jose Ortega who was filling out apps for lots of the tribal members at Pala. MB was dead at the time and I haven't heard anyone say the reason an app was filled out for a dead person.
The family history card for Merced Nolasquez says her parents were Pelegrino Ortega and Miguel Ortega and lists Margarita Britten as her half-sister. Since we know that Miguela Owlinguish was her mother from other census records we can document her parentage. In direct testimony during the probate hearing for Merced Nolasquez, Carolina Nolasquez stated:
Q: Did Merced Nolasquez have any brothers or sisters?
A: She had three half-brothers, Ambrosio Ortega, Jesus Ortega, and Juan Ortega. They are all living. They had the same father but different mothers. She had five half-sisters, Margarita Britten, Rafaela Owlinguish, Melvina Sibimooat, Ysadora Michao, and Marcella Sibimooat. They had the same father, but different mothers.
There you have it. Documented evidence from the family history card, and personal testimony from Carolina Nolasquez. This testimony was coroborated by each of her siblings present at the probate hearing.
This is no secret. The BIA presented this evidence to RS back in 1989 when the Asbra/Mills decision was explained to the Pala Executive Committee. No one paid for or solicited this evidence. It was compiled by the BIA document specialist in order to make a judgement on an appeal to correct MB's blood degree.
Now if you are going to question the identity of MB's father, it takes a certain stubborn stupidity at this point. To cling to a judgment made by the EC of Pala, who are not professional document examiners like Elsie Lucero, didn't review the BIA Census records from 1923, 1924, and 1925, and have intentionally omitted the Merced Nolasquez probate records in order to deceive the Tribe, is a spiteful and vindictive choice. It harms a lot of people, it is dividing the Tribe, and it is going to make it difficult to heal the wounds afterwards.

There is every reason to believe that the BIA will decide in our favor. That doesn't mean they will compel the tribe to reinstate us. We will have a way to go to court, but first we must exhaust our administrative remedies. It won't be over. Maybe RS won't be chairman forever. The People of Pala could vote someone else in. We'll keep after it. There are still actions we can persue.
Well like I said before, the BIA can't force the tribe to do anything...
So I hope your tribe votes out smith because your change has to come from within.

Talk about messes. The mess that Robert Smith has made will put anything that went on in the past to shame. You still can't prove that King Freeman is responsible for the disenrollments. MB did marry a white man, but he was not the father of all her children. From what I tell from the Census records, her first five children had a father named Jose Santos. He died sometime in the late 1880's or early 1890's, and was probably not Indian. That is why MB's children are considered half-blood. No secrets here. No hiding Yacqui blood, or implying illegitimate children, or that someone was whoring. Just the honest truth. Can you do the same?

BOSTON (CBS) – Football fans may not have to worry about the replacement referee drama for much longer.
CBSSports.com’s Mike Freeman has confirmed a report that an agreement between the NFL and NFLRA to get the regular referees back is on the horizon.
But until the ink is dry, nothing is set in stone.
Sports Illustrated’s Peter King tweeted a short time after that NFLRA negotiator Scott Green has told the officials that a deal is not imminent.
ESPN’s Chris Mortensen first reported the two sides agreed to a deal in principle, and the real officials could be back on the field this weekend for Week 4.
Mortenson writes: The NFL and the NFL Referees Association made enough progress in negotiations Tuesday night that the possibility of the locked-out officials returning in time to work this week’s games has been discussed, according to sources on both sides. An agreement in principle is at hand, according to one source familiar to talks, although NFL owners have postured with a “no more compromise” stance.

Article I, Section 8 of the Constitution states that “Congress shall have the power to regulate Commerce with foreign nations and among the several states, and with the Indian tribes”,[3] determining that Indian tribes were separate from the federal government, the states, and foreign nations;[4] and

These basic provisions have been changed and/or clarified by various federal laws over the history of the United States. Regulate, historically means facilitate. Therefore, the Congress of these United States was to be the facilitator of commerce between the states and the tribes.[6]

Robert H. Smith serves as Chairman of the Pala Band of Mission Indians, a position he has held since 1987. Chairman Smith successfully negotiated the first Tribal-State compact in California with Governor Pete Wilson in 1996, and subsequently supervised the opening of Pala Casino, creating thousands of jobs for tribal members and area residents. Chairman Smith’s work for the Pala Tribe includes providing health, vision and dental insurance for all members, creating a $1.5 million home loan program, launching a $300,000 scholarship fund for higher education, purchasing additional land for the Tribal cemetery and securing 24-hour on-site ambulance, firefighter and paramedic service for the Pala Reservation. Chairman Smith is also responsible for the opening of the Pala Library and Pala Child Care Center.
Chairman Smith is a member of the California Tribal Business Alliance, San Luis Rey Indian Water Authority, Southern California Tribal Chairman Association, San Diego Association of Governments, Indian Health Council for North San Diego County, Pala Housing Authority, Pala Fire Department, National Fire Protection Agency, California State Fireman Association, Vivian Banks Charter School Parent Advisory Board and the Cupa Cultural Center. The vice chairman of the Pala Band of Mission Indians, which owns a large casino and resort in North County, is due in court next week for an alleged probation violation stemming from a lewd conduct conviction in Riverside County last year.
Pala Vice Chairman Leroy Miranda, 44, was cited on Nov. 6, 2009, by Moreno Valley police for allegedly soliciting a prostitute at the Happy Time Adult Book Store in Moreno Valley, according to court records. He pleaded guilty to a misdemeanor charge of lewd conduct in February 2010.
Under terms of the plea, Miranda agreed to pay a fine of $570, enroll in an AIDS education program, stay away from the Happy Time Adult Book Store and wear an electronic monitoring device, also known as an ankle bracelet.
Christopher Coburn, Miranda's attorney, declined to comment.
According to court records, Miranda violated one of the terms of his probation by failing to complete the electronic monitoring program. A court hearing is scheduled for Friday to address that violation.
Miranda was elected vice chairman of the 1,100-member tribe in 2001. He has been a leading voice for the tribe against the proposed Gregory Canyon landfill, a project to turn 1,770 acres of land adjoining the Pala Indian Reservation into a dump.
Miranda is also the director of the Cupa Cultural Center on the Pala Indian Reservation, which is about 15 miles north of Escondido and east of Interstate 15. The center is the cultural hub of the Pala reservation and houses a small collection of Indian artifacts, tools, vessels and old photographs.
On the tribe's website, Miranda is described as a graduate of Sherman Indian High School in Riverside. He lives on the reservation with his wife and family, according to the website.

The vice chairman of the Pala Band of Mission Indians was arrested on suspicion of being drunk in public at the tribe's casino early Saturday morning, according to the Sheriff's Department.
Deputies were called to the casino at 1:47 a.m., according to a Sheriff's Department report. Pala Vice Chairman Leroy Miranda, 46, was arrested shortly after deputies arrived at 2:56 a.m. Miranda was booked into the Vista jail at 4:13 a.m. and later released, according to the Sheriff's Department.
Officials at the Valley Center sheriff's station declined Tuesday to comment on the details of the incident.
Miranda was elected vice chairman of the tribe in 2001, one of six members of the tribe's governing council. He is the director of the Cupa Cultural Center, a museum on the reservation, according to the tribe's website.
Doug Elmets, a spokesman for Pala, said the tribe is reviewing the incident and declined further comment.
"The allegations are currently under investigation and the executive committee of the tribe will review the circumstances of the incident," Elmets said in a written statement.
Miranda was previously cited for allegedly soliciting a prostitute at the Happy Time Adult Book Store Nov. 6, 2009, in Moreno Valley, according to court records. He pleaded guilty to a misdemeanor charge of lewd conduct in February 2010.

The Pala tribe owns one of the largest casinos in the county, the Pala Resort & Casino, east of Fallbrook on Highway 76.
In recent years, the tribe has been embroiled in a bitter internal dispute over its membership. Tribal leaders have expelled 154 people who they say do not meet the requirements to belong to the 900-member tribe.
The feud goes back years, but critics say the removal of the tribal members was spurred by a failed effort to recall Miranda last year. Former Pala Chairman King Freeman, whose family members were expelled from the tribe, told the North County Times last year that the recall effort began after he learned about Miranda's 2009 arrest in Moreno Valley.
Miranda could not be reached for comment by phone Tuesday afternoon at the Cupa Cultural Center.

Today, we have the displeasure of adding a new member: Pala Chairman ROBERT SMITH: The portly chairman of the Pala Band has overseen the stripping of tribal citizenship from 154 people. Sadly, we've found out that one of the original eight he had terminated, died from consequences of alcohol abuse, exascerbated by the despair brought on by the termination of her family. Smith has ignored the Bureau of Indian Affairs admonition that the Marguerite Brittain family should remain in the tribe based on their family proving they belong. Smith is on record as saying he won't show the "evidence" he has because "we are a sovereign nation and we don't have to" during an interview by Cristy Fajardo of KCBS TV. Mr. Smith, HAVE YOU NO SHAME?

Mark Macarro, 45, tribal chairman of the Pechanga Band of Luiseño Indians, was first elected as a Councilman in 1992. He is serving his eighth consecutive two-year term on the council and is in his 14th year as Tribal Chairman. Macarro's vision for the Pechanga people is to see the band strengthen its political self-determination and economic self-sufficiency by developing a diversified economy for the Pechanga Band while maintaining its distinct and unique cultural identity.
A national leader, Macarro represents Pechanga in the National Congress of American Indians (NCAI) as an alternate area Vice-President of the Pacific Region 2007-2009 and represents the Pacific Region on the board of directors for the National Indian Gaming Association (NIGA). He is a member of the Electoral College 2008 US Presidential Election, 2008 Platform Committee Member of the Democratic Party and a member of the Board of Governors, Harvard Honoring Nations. In 2008 he was presented as a Pathbreaker Award Honoree at the 20th Annual IGRA Symposium.
He also served as a Riverside County Board of Supervisors appointee to the County Historical Commission and served on the board of directors of Borrego Springs Bank, NA. In the 1990s as a charter board member, Chairman Macarro helped found the Advocates for Indigenous California Language Survival (AICLS), a non-profit organization with the mission of funding tribal language speakers in the state.
Chairman Macarro believes it is critical to maintain and cultivate the Pechanga tribal culture, language, and traditional life ways so that the Pechanga people can preserve their unique tribal identity. Macarro is a traditional Luiseño singer, singing ceremonial Nukwáánish funeral songs at tribal wakes throughout area Indian reservations, and is a practitioner of Cham'tééla, the Luiseño's native language. He has also been an apprentice bird singer to Robert Levi, an elder of the Torres-Martinez Reservation; having learned hundreds of Levi's birdsongs.
Macarro served as program manager for the library and museum of the Rincon Reservation from 1992 through 1995, as the director of youth education at Soboba Reservation's Noli School from 1990 through 1992, and began his career in Indian country as a grants/contracts administrator for the Pechanga Reservation in 1988. Macarro also served as a credentialed substitute teacher for grades 7-12 in the Riverside County Schools system, the San Jacinto Unified School District, the Colton Joint Unified School District, and Riverside City School District.
Macarro has a Bachelor of Arts degree in political science from the University of California, Santa Barbara.
Chairman Macarro's father, the late Leslie Macarro, was a Pechanga tribal member and a correctional peace officer killed in the line of duty in May of 1988 while working for the California Youth Authority. Mark's great-grandfather, Juan Macarro (1851-1920) served as Captain for the Pechanga Band during the first decade of the 1900's and was also a Nukwáánish singer. Among southern California tribes, the office of chairman was formerly called "captain."

Theressa Villa was elected Tribal Secretary in 2011. She previously served as Tribal Treasurer from 1991-1993 and has served on numberous tribal committees and board. She is a graduate of Fallbrook Union High School and American Business College San Marcos. Villa has lived on the Pala Reservation for 45 years and has six children and nine grandchildren.

Summer Barber is alive because of the heroic actions of a military hero. Mayor Tim Alford presents him with the Distinguished Citizen award. Last month, he was driving by when he saw a woman engulfed in flames outside a Shell Field Road home. The lawn mower Summer was riding caught on fire and spread to her nylon jacket. The Second Lt. was in route to Fort Rucker when he came across the horrible site. Summer Barber says Kilma Lattin arrest arrested the flames and saved her life. At first, doctors feared that Summer's severely burned arms might have to be amputated. She is now regaining circulation and strength in them. The Pechanga Tribal Council consists of six members and one chairperson. General elections are held every two years. If a vacancy occurs, a special election is held to fill the vacant council position. The tribal council meets at least on a monthly basis, and reports to the General Membership (which meets at least once a month). The tribal council sets policies, administers government programs and executes the will of the General Membership. The General Membership, by law, must vote on all Pechanga Reservation land-use decisions.
The tribal chairperson and members of the council are charged
to uphold and enforce the Pechanga Band's Constitution, bylaws
and tribal ordinances. They are also responsible for upholding
the rights of each tribal member, without malice or prejudice.
The tribal council members are obligated to act always in the
best interest of the Pechanga Band.

Since time immemorial, through periods of plenty, scarcity and adversity, the Pechanga people have governed ourselves and cared for our lands. We have grown and adapted to meet changing times and conditions. This land is witness to our story.
The history of Pechanga begins with our ancestral home village of Temeeku. Now under Redhawk, where Margarita road cuts south through a bluff, the Temeeku Village was home to the Temeekuyam and a center for all Luiseño Tribal peoples.

The payomkowishum, or Luiseño People were nearly destroyed by events and actions from first contact with Spanish Missionaries. Turbulent times continued with the eviction of our tribe from traditional lands in the 1870s. The Pechanga reservation was established by Executive Order of the President of the United States on June 27, 1882, affirming Pechanga Tribal sovereignty and our land-base.
The Missionaries
In 1798, Spanish Missionaries founded the Mission of San Luis Rey de Francia, forever altering Luiseño tribal life and pressing the Luiseño people into servitude, slavery or imprisonment. The Roman Catholic Church established ranchos that encompassed the native villages. The newcomer Spanish identified the tribes living in the territory claimed for Mission San Luis Rey as Sanluiseños, or simply, Luiseños.
Eviction
After the establishment of the state of California in 1850, a group of Temecula Valley Ranchers petitioned the District Court in San Francisco for a Decree of Ejection of Indians living on the land in Temecula Valley, to which the Temeekuyam could show no clear written title on April 15, 1869. The court later granted the decree in 1873. Several attempts by the Temeekuyam captains to stay the decree were unsuccessful, and our fate was sealed.
In 1875 a posse led by the sheriff of San Diego County, Mr. Hunsaker, began three days worth of evictions. Among those in the posse were Jose Gonzalez, Juan Murrieta, Francisco Sanjurjo, Pujol, and Louis Wolf. Murrieta and Sanjurjo were two of the ranchers— sheep farmers— who successfully petitioned for the decree.
