Pechanga Chairman Macarro's DC Trip Yields Questions On Tribes Dealings or Lack Thereof With Reservation Allottees From Who the water Rights Flow.



At the recent Indian Affairs Committee meeting. Chairwoman Senator Maria Cantwell asked  Pechanga Band of Luiseno Indians Chairman Mark Macarro and BIA Secretary Kevin Washburn how Pechanga allottees get just and equable allocations in S1219 The Pechanga Water Rights Bill. While the Pechanga Band may have an interest in the water rights issue, that interest flows mainly from claims that it solely represents the Temecula Indians and Temecula Indian allottees in this issue.  This is not true.

Mr. Washburn stated it is a remaining issue and concerns individual allottees. Furthermore he stated these things need to be resolved in order to be supportive.

There has been NO communication  from the BIA to disenrolled Pechanga tribal members nor Temecula Indian Reservation allottees from the Tosobol Family in three years.  That’s when they talked about talking to us.
His mention of smaller allottees fails to account for the nearly 100 acres of reservation land and vineyards owned by Paulina Hunter descendents





Chairman Macarro tried to answer   by saying the settlement shouldn’t affect our rights at all.
The truth is it does affect our rights the bill states you need to be a federal recognized allottee member of Pechanga to be recognized for this bill.
The tribe is inserting language into the new bill that changes the definition of allottees to a tribal member, excluding those of us who actually HAVE an allotment  on the reservation.


Mark furthered stated that the status of former allottees that were that were members is complicated.

What is  complicated is that  if we didn’t meet the criteria for membership set by Pechanga’s constitution and bylaws,  it should be laid out before the Indian Affair Committee and the B.I.A. to show that our allottee status is flawed and we have no right to Pechanga has an allottee.

Chair woman Senator Maria Cantwelt asked has the Dept of interior not funded a water settlement. Mr. Kevin Washburn stated no. Chairwoman Cantwell then asks how was the settlement handled in the past. Mr. Kevin Washburn answered how other tribes had their settlement and the process. But when it came to the concerns of allottees that is part of Pechanga’s water bill he stated the tribe has claims and the allottees has claims they need it all settled at one fell swoop

The B.I.A. recognizes the Hunter family as as allottees via a letter from Regional Supervisor Amy Deutschke. With passage of this bill we will lose our recognition as allottees because of the changes to the definition of allottees.  And the millions of dollars that Pechanga is going to get for selling the water rights will not benefit  allottees that are not members.

  3. His Indian name should be "Walking Eagle" because he is so full of shit that he can't get off the ground. It is only obvious that he has no intention of helping the disenrolled allotte's what he his attempting to do is circumvent through the water bill a statute that if you are not recognized as a Pechanga tribal member then your allotment is null and void. It is called adding a rider to a piece of legislation. It happens all the time. Some people notice but that is how compromise works on the hill. It would be helpful to write, fax, and email the committee about such concerns, and how there is no fair unbiased representation coming from the Pechanga tribe, given that it is they who are in-conflict of interest given that it was they who sought and got members disenfranchised.

  4. Chairman Macarro conveniently leaves out what he and Masiels have done to our families, Tosobols, Apis and Hunters.

    WE have rights to water on OUR reservation. It's NOT a Pechanga water right, but a Temecula Indian right.

  5. I am a Legal Rep, For one of the Hunters.

    (1). I argue that if the hunters are entitled to water rights that,

    a. They are entitled to use the park which has "Grass" grown by water owned by the Hunters .

    B. They also are entitled to drink any water from the reservation "From any location".

    c. The Hunters may move freely on the Reservation as " The water does", like a (running spring).

  6. Honarable Mark Maccarro! LMFAO what a joke to put that word with his name. He's a holly come lately native! He so white washed trying to play big chief bringing white ideals to the Rez. Natives dont turn their back on each other for personal gain that's an outsiders way of thinking. Since he grew up outside that's how he thinks. I guess the natives that tried to teach him our culture when he was an adult and discovered his heritage didn't make it stick.

The constitution does not allow adoptions, those that believe that they have been adopted must know that they are mite-like squatters, who have just had the luck to have taken over illegally...for now.   24. Pechanga Water Committee, (including convicted felon Raymond Basquez Jr.) are raising the water bill of "Former Member Allottees" as soon as this Water Bill is passed through congress. Macarro has secretly put the payment increase on hold till it's a done deal. All Former Member Allottees will than have their water turned off or pay a heffty fine to continue to have water. There is Evil in the works behind the scenes of Mark Macarros desk. Just like when he went against the Tribes Vote to stop disenrollment!

  25. I have read many comments on this blog. There is a lot of name calling and finger pointing. What is the truth? I also belong to a tribe where there is a lot of things going on but we can never prove what we know is true. To me it seems when people who have never had power let it go to their heads when they get in elected office. There are so many professional tribal in my tribe (those who are well educated and hold very good jobs) but we always end up with a tribal council that couldn't hold any type of real job. Some have IQ's lower than ticks! Tribes will always have problems because they vote $$$$ instead of what is best to the whole tribe. This is not the Indian Way Of the Ancestors. No good will come of anything when it is put together wrong.

  26. I KNOW FOR A FACT A CHILD THAT WAS ENROLLED ALMOST 4 YEARS AGO AND AN OLDER GIRL WHO WAS ENROLLED EARLIER THIS YEAR. IF THERE IS A MORATORIUM IT DOES 'T APPLY TO EVERYONE.

    it is true what you say. We Apis have attempted to have our grievances heard that include the illegal actions and broken tribal conational by-laws during our disenrollment process heard in court, yet the tribe fought use and was successful in keeping us out of court. We went all the way to the Supreme Court just to be denied a hearing. The ting about tribal councils that have as much brains as a bag of rocks is that they have street smarts and know that a lawyer(s) who have no ethical standards will do the bidding of the corrupt for a nominal fee. It is also unfortunate that the remaining tribal members do not speak up for several reasons. I think you know those reasons as well as anyone.

    I believe what you say is true, for I heard the rumors and it appears that the enrollment number has gone up over the last couple of years. Until there is an independent body that monitors the constitutional practices of the tribe they will get away with the things they do. A tribal court would be one such method as long as it was not appointed by the tribes and was independent of the tribes. It is sad that this type of tribe will not be considered and even fought ageist by tribes like Pechanga. Many tribal communities back east who are not corrupt and put their people first have such courts and are productive where all of the members have an opportunity to work and go to school and do not fear disenrollment if they speak out in disagreement with their tribal council.

    Burn sage with your prayers and work for unity among the disenrolled for our fight is the same and our heritage is at risk of being lost the short sighted greedy and power hungry casino Indians.

    This last statement only applies to those tribes who have willfully hurt their people and their culture in the pursuit of wealth and power. Again there are tribes who do the right thing with the earnings from their casinos and economic enterprises.

  32. It's pretty hard to prove that a tribal council is doing dirty ! My leader has planned and schemed for many years to get to the point of complete control. General council is controlled by the leader and puppets are on tribal council. Vote them out,Ha ! Our Leader has complete control of every aspect of our tribe. Like I say ,this was a plan that was put in motion many years ago. Fellow Native brothers and sisters, our only hope is that those who wrong us will be brought to justice one way or another. They will slip up sooner or later and the noose will tighten !!! Right is right and wrong is WRONG.
