After months of tribal dispute surrounding Rolling Hills Casino that prompted a lawsuit from the State of California, a federal judge Wednesday evening issued a temporary restraining order against the Paskenta Band of Nomlaki Indians.
The order remains in effect in advance of a hearing set for June 30th. It says that tribal members are barred from attempting to disrupt casino operations, from having armed guards within 100 yards of the property and from having any firearms on tribal properties.
In the lawsuit filed Tuesday, the State of California claimed the presence of armed guards and so-called tribal police at the casino during a recent standoff posed an "imminent threat to health and public safety." It said that threat was a violation of a gaming compact between the state and the tribe that was approved in 1999.
Tehama County Sheriff's deputies were brought in to keep the peace, racking up tens-of-thousands of dollars in overtime and pulling deputies off other critical assignments.
In her ruling Wednesday evening, federal judge Kimberly Mueller said the taxing of Sheriff's office resources "poses a threat to the public health, safety and welfare."
The ruling also says the state "made a strong showing" that it is likely to prevail on its argument that the tribe violated its gaming compact with the state due to the threat posed by the ongoing standoff.
However, the judge made no final ruling on that matter, instead allowing time for both sides to prepare a case for a hearing on June 30th.
If the judge were to rule that the tribe violated its compact with the state, the compact could be nullified, effectively shutting the casino down.

I asked the person that i was meeting with, does this apply in Indian Country. And his answer was "YES" it does apply, the FBI is Federal, and the Indian Reservations are Federal and we have jurisdiction on all Federal lands, including all Arm Forces Bases,and Indian Reservations.
When the Spokesman allows Civil Rights to be violated and then broadcasts lies to try and keep the violations under cover, the band is now open to outside enforcement. The truth is the truth, and the liars feel or felt that Sovereignty would protect them from being questioned for civil right violations. ICRA is for "ALL" so is sharing rights even if we disagree. The bands determine everything not the Bad Actors club. The story was written a lifetime before the current Bad Actors tried to change the story and take away others rights. Truth is crystal clear.
ReplyDeleteHow was the Pechanga reservation created, and why would it be ok to violate Civil Rights of State, Federal, and other bands recognized people? Bring back "ALL" or face the agency who can help do it. Replace council with more Bad Actors or make them stop the civil rights violations and tell the truth. "ALL MEANS ALL"!

ReplyDeleteThe tribe's constitution in 1978 said that members must prove "descent from original Pechanga Temecula people." In 1996 the tribal council tightened the rules, declaring for the first time that "members had to have an ancestor from the subset of Temecula who relocated to the Pechanga valley" where the reservation was established. In cases of disenrollment of large families in 2004 and 2006, Pechanga officials have said they were enforcing rules of membership that required historical residence as well as descent from known Temecula.
According to recorded Ancestral depositions, some where disenrolled without cause. Either the Bad Actors don't believe other Elders, or they just don't care what our Elders say. Either one the civil rights have been violated.
Change is good, but acts being allowed inside that our ancestors went through from outsiders is not our way I believe (apartheid, dis enrollment, lies, greed ect.). Criminal acts (unwanted sexual acts, drug use, stealing ect.) on others is different. Disagreements & unsettled questions is a different thing and should be handled together inside. Misusing customs and traditions to hold power, telling lies to outsiders to justify your actions is not our way either. These acts are running through because $$ is blinding, and people are forgetting these acts could be used against them. They would feel uncomfortable too, feeling their children watch the bad mistakes. No one is going anywhere.
