The Fresno Bee's Marc Benjamin has the details on a plea deal that would keep felon Tex McDonald from becoming a 3rd strike felon. Lucky Tex.
Tex McDonald, the former chairman of Picayune Rancheria of Chukchansi Indians, is expected to take a plea deal Friday in Madera County Superior Court that allows him to avoid a possible third strike for his involvement in the Chukchansi Gold Resort & Casino office raid in October.
McDonald’s lawyer, Antonio Alvarez, said his client intends to plead to a “non-strike felony” that will let him out of jail within a few months. “I think we are going to resolve,” said Alvarez. “We have a framework in place, we just have to iron out the details.”
Other participants in the raid that led to the casino and hotel closure may have their cases resolved Friday, too, lawyers in the case said.
But some of the men who served as “tribal police” in the raid said they will not take a plea bargain offered by Madera County District Attorney David Linn, because it will affect their abilities to get jobs in the future.
Linn said that he is offering to whittle down the more than a dozen charges against most of the 15 men to one count of false imprisonment and possibly a lesser charge. The officers and three employees of the McDonald faction’s tribal police said they will consider the offer. Tribal council member Vernon King also is considering his options, a tribal official said. King and McDonald are the only two of the 15 defendants who remain in jail since their arrests six months ago.
If they reject the plea deals, the remaining defendants will have a preliminary hearing, the stage that determines whether the case goes to trial, said lawyer Mark Coleman, who represents eight of the 10 officers and one tribal employee.
At least he'll be out. Vernon will be out too. The two people that tried to do what's right will be vindicated for trying to ensure Reggie and his thieves were removed. Wonder how much Reggie stole after they went to jail? He probably cleaned out the entire cage while his people live like shit. He's greedy. Time for Reggie and his crew to go to jail now. What now to the posters wishing they stayed in jail. They're free and Reggie's fat ass will still be stealing from the natives! lol @ all Reggie and his people that thought they'd never be free.

ReplyDeleteReggie and his people screwed everybody. Where did he get money to pay people $1000 to vote yes? If this doesn't show you dumb Indians that he's stealing money from you then nothing will. He straight up fucked over your revenues by not filing an audit. The audit is what screwed the casino and native out of money. He didn't file those audits because he was stealing. It wasn't until after Tex and Vernon took the paperwork that he decided to file an audit. Now why is that? He knew he was screwed if the truth came out. Put the real criminals (Reggie, Nancy and the rest of their thieves) in jail.

ReplyDeleteStc security did have guns.and put them in the patrol car trunk every time they entered the casino. Yeah I seen it with my own eyes every day working there. How about the people they had at gunpoint getting off the elevator the day of the raid.the sheriff made a police report.

I seen it as well for a week after the Reggie takeover STC with guns while inside the casino whats the difference with them and Tex they did the same thing.
Yup you hit the nail on the head again Cathy! I hear your little buddy Dora Jones is back at it again living large. For example, taking all of the luxury box seat tickets for her own family at Chukchansi park and I hear she enjoyed herself yesterday by watching the NFL draft with a former Raider without a care in the world about her people. Shameful how she can go about like nothing is wrong. Cars are being reposed, electricity is being turned off, and her own people in Coarsegold don't have any water. Must be nice to not have a soul or care about the people she is supposed to care about. Those people will never learn. But, I guess that's who the US Governement and tribal members of Picayune want since they approved the 2010 appointment.

So, according to this article the elected tribal leaders also called McDonald faction lost control of the casino six weeks earlier when members of the Reggie Lewis-Nancy Ayala faction broke into the casino and took control of gaming and hotel operations. Lewis-Ayala are also responsible for the loss or missing 49.6 million dollars from the casino, according to the federal audit. Why no charges against the individuals responsible for this mess Lewis-Ayala? The problem with any plea bargain is that it can be coerced, the government has all the power and money. 97 percent of federal and 94 percent of state cases are plea bargained. What a shocker that the feds "BIA" also just happen to select a group of former tribal leadership from 2010 made up of former law enforcement and government types, didn't matter that the appointment of the 2010 group violates federal law or earlier US Supreme Court rulings on such matters! This is not the America we grew up in, one step closer to a police state with no freedom or legal rights for the everyday individual citizen that doesn't have a fat wallet or government connections!
The BIA insists on the 2010 council. They refuse to understand that in 2011 there was a concerted effort to get Reggie out of there. The BIA chose to let Reggie stay in then (against tribal wishes) and they want him there now. The tribe has had no say in any of this. Reggie's paid votes don't count. Elections that are not open to all, don't count either.

ReplyDeleteIt is a cluster f..k, it is only obvious to everyone except the BIA and the unification supporters that the unification council members are criminals. The directors of the BIA must be getting handouts to look the other way. Follow the money, it tells always tells the true story since these people do not. Find out where the BIA people live and how much money they spend, if it seems like more than a normal employee should have then you know they are being bribed. The thing is that since they are government employees they sit pretty through their retirement, unless they are proven to have committed fraud during their employment, then it is taken away from them. They are trying to make sure their corruption is hidden well before they retire.
