Descendants from Cupa:

Remarks by Robert Smith state that a group is starting a new tribe, this could not be further from the truth.  The truth is this group is trying to have the right of self-governance restored to the rightful people of the Pala Reservation and for the BIA to recognize the Cupa People.  There is also concern that the other people or villages that were removed from Warner’s Ranch also be recognized and their full rights restored as well.  No one should be left out that is truly a Warner Ranch Evictee.

If Robert is truly chairman of these people he would be doing what he could to preserve the rights of the Warner Ranch Evictees.  Yet he answers to the title of Chairman of the Pala Band of Luiseño Mission Indians which is Old Pala.

He no longer serves the descendants of Warner’s Ranch.  Instead he is dis-enrolling and disenfranchising them.  We need to find out what is wrong and why the BIA does not recognize the Pala Band of Mission Indians as a tribe.  The People, after being removed from Warner’s Ranch decided that they were to be the Pala Band of Mission Indians.  This did not include the Luiseño of Old Pala.

Robert has also said that anyone joining this new group cannot be members of Pala and belong to two reservations which he is right.  If this is true, how can the Pala Luiseño who are descendants of Old Pala be members of the Pala Band of Mission Indians (PBMI)?  This land was purchased for the Warner Ranch Evictees.

There is another group who are descendants of Morongo and Cahuilla attending our meetings and voting on important issues. These are the very same people who are voting to take away the legitimate rights of the members of the Pala Band of Mission Indians.

There are 12 people of the Pala Band of Mission Indians who cannot vote, cannot attend meetings and cannot run for tribal office because these same Morongo and Cahuilla are allowed to vote when they themselves have no rights here.

IT IS TIME TO TAKE BACK CONTROL OF THIS LAND. IT IS TIME FOR THE PALA BAND OF MISSION INDIANS TO TAKE BACK FROM ROBERT SMITH AND RESTORE TO THE GENERAL COUNCIL CONTROL OF THE BAND’S BUSINESS AND MORE.  IT SHOULD BE EASY SINCE ROBERT IS THE CHAIR OF THE LUISENO AND A MEMBER OF ANOTHER RESERVATION.

  1. So whats really going on in pala anyway? From what I read they have 3 E.C. (nonmembers?) with no ties to the people the pala Indian reservation was established for, sitting on a committee and determining blood degrees of tribal members that don't fall under their jurisdiction? There's a supreme court ruling that says only a tribe can determine its membership, (Santa Clara vs. Martinez) the 3 imposters on the E.C. CANNOT prove decendency from the tribe they have attacked therefore they CANNOT say weather the people they disenrolled belong or not, they are violating a Supreme Court Ruling. Maybe they should scamper on up to cahuilla and fuck with their own people, that is if cahuilla will have them.Then you have Robert Smith, all indications are the boy doesn't know up from down, right from wrong, black from WHITE, (pun intended, I read his family history) and to top it off he seems to have jumped the P.B.M.I. ship, claiming he's the chairman of a neighboring reservation/ tribe, Whats up with that? And the pala people go about their business like nothing is wrong? and to add insult to injury the B.I.A. is playing along with what basically amounts to fraud from 4 out of 6 of that reservation's E.C. nonmembers? Better start taking care of some business before you wish you had when you had a chance

  2. The EC members are descendants of Remijp Lugo who was a Cahuilla Indian from Banning. He was one of the teamsters that helped to evict the Cupenos from Warner's Springs. He found out that land was being allotted and managed to get some in spite of the fact he was neither homeless or landless. Just a little con game played on the BIA.

    Because he was allotted he became part of the Pala Band and the BIA transferred his Cahuilla blood degree to Pala Mission Indian blood degree. I don't think there was any fraud but it all happened a long time ago and we don't really know what arrangements were made.

    Robert Smith does not claim to be Chairman of the Pala Luisenos. The BIA conferred that title on him through a decision of nefarious intent. Now Smith has made no effort to correct the misidentification so he is complicit.

    Even if he tried to fix it the ramifications are multiple. The problem goes back over twenty years so suddenly trying to fix it now would not remove the past complicity.

  3. Does anyone really know what is happening in Pala? Seems the BIA can't even make up their mind about which Pala they are working with. Does it even matter when one person is allowed to rig elections and create an EC without any real ties to Pala. The real Kupa should have never allowed themselves to be duped by the BIA. The BIA forced the Kupa to accept the Lugo families and to allow the San Felipe to be part of the tribe. It is all wrong. What is really stupid about the whole thins is that the BIA says pala is luiseno yet the majority of the people are either cupeno or Diegueno with a new majority of Cahuilla. Where are the luiseno???? Oh yeah, the BIA let the Rincon run aways settle on old pala and take control there. the BIA also let the lugos claim ancestry to old pala lugos so the BIA could give that land away too. there is no connection between the old pala luiseno and the Cahuilla lugos but the Cahuilla lugos get to take control of that land too. Liars. I guess the BIA only chooses to work with liars. How is this for a lie. The BIA is the best governmental entity ever created by the United States. Sure.

  4. R and R what do you mean RS doesn't make any claim to pala luiseno. Every single document of importance is signed by him as the chair of the pala luiseno. there is no fixing it. the BIA has messed this one up so bad it can't be fixed anymore. the articles of association are wrong. the pala constitution cant ever be amended because the amendment language in the constitution creates a vote requirement that can't be achieved. it is a total disaster at pala and the BIA is 100% responsible. The BIA thinks that as long as they let RS have his way the problem will just go away. good luck on that one.

  5. Yes RS does sign these documents. That is why I say he is complicit. Does he claim to be Chairman of the Luisenos? If signing off is the same as a claim then yes. Try to get a court ruling on that. We have seen how the BIA and the courts jump through hoops to protect RS.

  6. This is not the BIA'S fault. It is the fault of the GC for allowing RS to take control away from them, and it's the fault of the people who keep voting him in, it's what the tribe wants, until the people want change it will stay the way it is.

  8. What's the real story about the claims that he and his brother killed someone and a mag light? And if he and his brother are the drug dealers, has anyone contacted DEA?...the Local sheriffs aren't going to do anything....they are too busy protecting RS.

  9. All authorities have been alerted over and over again, RS just donates money the second he thinks he is almost in trouble. He contributed over $50,000 to Bonnie Dumanis, DA of San Diego when she was running. He tells the Sheriff's department that the disenrollees are violent and he is always in danger from them. Hopefully the case is just building up until they have enough evidence to make an official arrest. The State of California is making so much money from the Evil Leaders that they don't believe the Individual Indians who complain about their leader's actions. The FBI has to have a stack of federal crimes before they move forward with arrests, they probably hope that the existing members make a formal complaint about their EC because they cannot use sovereignty against enrolled members. Not sure how the lawyers work in a situation like that, because they are supposed to be tribal, (for the whole tribe). In fact when you think about it every disenrolled Indian paid their lawyers to disenroll them. These lawyers are just as bad as the leaders who disenroll and they too will have to pay for the horrendous destruction they have put true members through.

There was a post earlier with the phone number of the FBI in Carlsbad Ca. that is handling the Pala Cases so you can add anything to the complaints that have been filled. hear it is again (760)729-0811 ask for the Agent that is handling the cases for Pala. Please give only real info, as any BS info only prolongs the cases. Thank for Caring.
    ps. these cases are nothing to do with disenrollments the courts will decide those issues. these are crimes committed by RS and his brother Andrew. Including Drugs, Fraud, Elder Abuse, Murder, Terrorist Threats .Also any crimes committed by Theresa Nieto such as Fraud, investments that have gone bad without a good reason, money laundering.Remember," only facts and no made up bullshit".

  14. Pala doesn't disenroll any longer. They just made you disappear and bury your remains where no one can find them. The Pala EC is the JUDGE THE,THE JURY< AND THE EXCUTIONOR. Along with the Bands backhoe.

  15. All of you that know this to be true are just as GUILTY as they are for not coming forward and tell the truth. That's right it is considered a Felony to help to cover up any major crime like murder.
    Oh well there is plenty of room in the prison system these days.
