PALA Disenrollment Stories: Remijo Lugo and Alejandro Barker. Did the Corrupt Practices of the BIA Make them SIGNIFICANT?

The Family of Pala Disenrolled continues their quest to get the tribal ancestry questions out in front of the public.  Why?   Because if these issues aren't brought out, people will think that everything the tribe does is good and proper.   As a disenrolled Pechanga of Hunter ancestry, I know FIRST HAND that this is NOT true.  Yes, it may be dirty laundry, but it must be aired. And as we are finding out, the BIA is complicit in the destruction of so many Native lives, you'd think it was the 19th century and NOT the 21st.


Who was Remijio Lugo? The short answer is he was a Cahuilla Indian with no ties to Warner Springs or the Cupeño Indians. At the same time, it is not possible to discuss Remijio Lugo without first learning something, or maybe nothing, about Alejandro (Alexander) Barker.  Why are these two men important in Cupeño history? Not for the reason you might think. It is the progeny of these two men that cast the deciding votes in the decision to deprive the Brittens of their membership in the Association known as the Pala Band of Mission Indians.  PBMI is an Association whose membership that the descendants of Alejandro Barker and Remijio Lugo are not entitled to share. 

No one really knows who and where Alejandro Barker came from. He is reported to be one-half Indian. It is reported by Phil Brigandi that he was born around 1854 and that his father was a White man. A review of the 1860 United States Census reveals that there is no Alexander, Alejandro or Alex listed on the census of the Agua Caliente Village. Alejandro Barker would have been 6 years old at the time of the census.  In the 1886 census of Agua Caliente Village it does list Valeriana Barker as the mother of Angelita Barker, Ginoviva Barker and Samuel Barker.
 Valeriana is listed as a sister-in-law to a Mooat. It does not list Alejandro Barker as her husband or that she is even married or widowed. In the later census records they do appear as husband and wife.

The name Barker is the very first Anglo name to show up on the census records of the Agua Caliente Village. But where did Alejandro/Alexander Barker come from. We will probably never know. What we do know is that he was a Citizen Indian meaning that he gave up all of his rights as an Indian person. He was a registered voter. This is more proof that he was a Citizen Indian. He is on the voter rolls of San Diego County. Indians were not allowed to vote. Maybe this is proof that he was not Indian at all. It is possible that he may have been allotted in another state and became a Citizen Indian through his allotment. There are Barkers listed on the Cherokee Allotment Rolls. There are Barkers in Pit River territory and South Dakota. To get to this quickly, Alexander Barker married Valeriana Barker who had Angelita Barker who married Remijio Lugo.

Now who is Valeriana Barker. In her 1928 California Indian Judgment Roll Application No. 1108, she identifies her parents as Juan Chutnicut of San Ysidro and Antonia Arenas of Cahuilla.  SHE IS NOT AN AGUA CALIENTE CUPEÑO.
The Chutnicut identify themselves as San Luiseno. This only makes sense since Chutnicut is a Luiseno word meaning charcoal. So it should be obviously clear that neither Alexander Barker or Valeriana Barker were from Agua Caliente.

Now we are back to Remijio Lugo. Let’s start with his 1928 California Indian Judgment Roll Application No. 1211. And yes Remijio, where were you born?  “I was born at Sulphur Springs near Cahuilla.” His parents are listed as Patricio Lugo and Barbara Casero, both Cahuilla. Patricio is from Morongo/Malki and Barbara is from Cahuilla. Remijio is carried on the Morongo census records for several years before he moved to Pala from Morongo. He does not ever appear on the census records for the Agua Caliente Village at Warner Ranch. 

So let’s throw a little more insult on this injury to the People of the Cupeño nation. Remijio Lugo was apparently a Teamster (paid driver of a horse drawn wagon). Remijio Lugo, whose ancestors are disenrolling real Cupeño Indians, was hired and paid to remove the Cupeño from their home at Warner Springs. In a letter from the Special Disbursment Agent, L. Wright, Remijio (Ramigio) is requesting that his paycheck be sent to his home in Banning. The letter is dated October 29, 1903. The Teamsters had also just finished moving the People of San Felipe to Pala and Remijio was on his way home and did not want to wait for his check. So Remijio’s home was definitely not Pala in 1903.

Let’s add it all up. Alexander Barker. Not a Cupeño Indian.  His Indian heritage is unknown or he is simply not an Indian by virtue of his status as a Citizen Indian. Alexander Barker marries Valeriana Barker who acknowledges in her 1928 California Indian Judgment Roll Application that she is a Cahuilla and San Luiseno Indian. She was born at San Ysidro and not Agua Caliente. Alexander Barker and Valeriana (Chutnicut) Barker are the parents of Angelita Barker. There is still no Cupeño blood here. Simple math, two Cahuilla does not equal one Cupeño.  OP:  BOOM!
Angelita Barker marries Remijio Lugo and according to his 1928 California Indian Judgment Roll Application he was born at Cahuilla. So, 1 Cahuilla + (Cahuilla + Cahuilla) still does not add up to 1 Cupeño.    OP:  BOOM!

So there is still one more possibility that these Cahuilla Indians could belong at Pala. There is a special clause in the law authorizing the purchase of lands for the Warner Ranch Evictees. This clause allowed for the BIA to locate Homeless Indians, with no entitlement to other lands, on the lands purchased for the Warner Ranch Evictees. So maybe, just maybe the Lugo/Barker group can be salvaged under this clause. Maybe they do have rights at Pala. Nah! They still don’t qualify. They have/had rights at Cahuilla and Morongo so therefore they were not entitled to any lands at Pala.    OP:  BOOM!

Here we go again. Why does everything end up back with the corrupt practices of the BIA? Even when the allotments were being made at Pala many of the people objected to Remijio receiving an allotment. It didn’t matter. Remijio was a good Indian and always did what the BIA wanted. He even helped remove those nasty Cupeño from Warner Springs.

So why don’t we go back and do this right. If Robert Smith has authorized the use of the 1928 California Indian Judgment Roll then let’s do it. Let’s really do it and ask those Lugo/Barker Cahuillas to leave Pala, They really do not belong there. Even a BIA agent once referred to them as Charlatans.
Oh my gosh, there is one more chance that the Lugo/Barker Cahuillas belong at Pala. What about Valeriana Barker and her offspring? Nah again! She is also considered a Citizen Indian due to her marriage to Alexander Barker and her children are also Citizen Indians and not entitled to Indian Allotment.

Yet through the power vested in Amy Dutschke and the BIA the Lugos have almost completed their takeover of Pala. A place they do not belong; a place where they are not entitled to hold office within PBMI; and a place where they do not have any authority to disenroll anyone.
Everyone is waiting to see who really will be the victims of disenrollment next. People are wondering if it will be the Lugos disenrolling the Smiths or the  Smiths disenrolling the Lugos. It is what they do when they don’t get their way. It is what they do when they are close to getting caught involved in stealing, or murder or rape or any of the other awful things they have a reputation of doing.

It is amazing what you can find once the door has been opened. Robert Smith chose to open the door to the 1928 California Indian Judgment Roll as determining who is and who is not an associate member of PBMI. (One more little secret, there never was and there is not a tribal roll for Pala)

So really, if we are going to use the 1928 California Indian Judgment Roll then the Lugos next official act as EC members of PBMI is to disenroll themselves and let the rest of us get on with what is ours. Truly ours!!!!

You are so white blind that you can't even see that most of the Brittens are more Indian than you even without any Margarita Britten blood. Take away all of Margaritas blood, we would still be more Indian than you. And why do you keep saying the tribe. There is no more tribe. you took all the power and you make all the decisions so don't blame the tribe for what is going on. Tell the people the truth, even the BIA disagreed with you and recommended the Brittens be restored. Why don't you tell the people that.   11. Margarita Britten couldn't put down who her father was on the 1928 CIJR application. That's because she was dead. That application was completed by John Ortega who was intent on enrolling all the Pala Indians into the judgment roll so they could participate in the settlement money. Do you have other evidence that her father was unknown, because that 1928 application is not first hand evidence.

    Just so that everyone knows, there were two Rolls completed for the 1933 California Court of Claims. One of all the living Indians, and one for all the Indians who were alive in 1854. That is why an application was completed for Margarita Britten even though she had passed away.

    Now this vendetta you have for King Freeman is really starting to sound deeply personal. So you have an axe to grind with him. Why does that mean you have to hurt his children? What kind of pissant attitude is that? How would you feel if someone took out their anger toward you on your kids? Just more of the same cowardly B.S. we always hear from you.

    You say my aunt and cousin walk around with attitude but does anyone walk around with more arrogance than Robert Smith? Talking trash about my aunt and cousin is really pathetic. My aunt served the tribe for many years on the executive committee, and my cousin is a sweet woman who is raising her children as best she can after having her life torn apart by the disenrollment.

    Now its been over twenty five years of Robert Smith's leadership, or rather lack of leadership. How does his performance rank with King Freeman's? Be honest. There is so much theft, corruption, and crime in his adminstration that he looks at everything as an opportunity to steal and lie. That black Amex card has a ton of personal expenses on it, and I bet the Chairman never pays for anything out of his own pocket. You are right about not cutting corners though, and of course the food budget is a prime example.

    Now this part about the 1/16th blood degree is such a damaging remark. You act as though all the disenrollees are 1/16th blood degree. My grandfather was an enrolled Pechanga Indian and was 3/4 blood. My grandmother was 11/16ths combined Luiseno and Cupeno, so I have plenty of Indian blood degree. You are a racist S.O.B., and you don't get to say who is Indian and who is not.

    I thank O.P. for his help in getting the truth out, and if you don't like the truth then put your head back up you a**. One thing for sure. You seem incapable of talking about the subject and keep bringing up all kinds of stuff that has nothing to do with anything at all.   12. ??Now if there is in fact hard proof that Robert Smith does not have the required blood degree to be enrolled, and be the Chairman of the Pala Band, What are we supposed to do about it???

    Do we ture a blind eye to the facts of the BIA and all the evidence that is proof that he does not qualify, or do we take action and have him removed as the Chairman and disenroll him and his family, and charge him with fraud and send him to the federal prison for a new live behind bars. What about Theresa Nieto, what should we do to her for her involvement defrauding the People of due process and motioning to disenroll members that she new was wrong, but she decided to turn a blind eye to the evidence in black and white, including the sworn testimony of true Cupa elders, calling them liars and turning a blind eye to them and disenrolled them.
    And what about Dion Perez, who started the ball rolling by making the motion to disenroll the first round of members, what should be done to him for ignoring the black and white facts and the SOWRN TESTIMONY of true CUPA ELDERS, calling the, LIARS and turning a blind eye to their sowrn Testimonies. Now what do we do about this mess, and how do we restore the lost faith in the Reservation that once was the best Reservation in the State to live and raise a family?   16. One of the things that comes out is that Pelegrino Ortega Saubel was having children all over the place. He had children at Los Coyotes, Mesa Grande, Rincon and La Jolla. I doubt if anyone has ever really determined how many children he really had. So obviously he was a bit amorous and very prolific. Miguella Owlingwuish was only 12 years old when she became impregnated by Pelegrino Saubel. She gave birth to Margarita (Britten) Saubel when she was 13. Now the truly odd thing in all of this and the real elephant in the room is that nowhere in any document, official or unofficial does it state who the mother of Merced Saubel is. Even her own relatives state that she and Margarita Britten had the same father but different mothers. There is absolutely no record of who Merced Saubel's mother is. Not even a guess. So where does that leave Robert Smith with the family of Merced. Oh my gosh. Her mother is unknown. Her mother has to be white. Maybe her mother was the wife of John Warner and maybe just maybe she had an affair with Pelegrino Saubel. Where does it stop people. Better yet, why did you ever let it begin?

    Teresa Nieto and Dion Perez actually agreed to meet with about 10 people after the first 8 were ousted, Document after Document were put in their faces showing them their mistake and they acted as though they just didnt get what they were looking at, it was sad to see that people "Elected"?? to be tribal leaders could not or simply would not comprehend what they were "attempting to read"?? . Finally little dupe de doo Dion Perez made this statment that rings so true to the above posted letter. QUOTE FROM DION PEREZ, "Its difficult to find information from this time period at Warners, I can't find ANY records of MY family at warners"!!! Read the above history of your ancestors again Dion Perez and you will understand why.

    In reply to the comment above regarding the lineage of the Chutnicut family, I just reviewed Application 1107 and can verify that the family of Valeriana Barker, as reported by her child, Sam Barker, was residing in San Ysidro in the year of 1852. His application states that his Grandfather, Juan Chutnicut, belonged to the San Ysidro and that his Grandmother, Antonio Arenas, belonged to the Cahuilla.

    It appears that, although there were Chutnicuts who claim lineage to the Cupeno, this particular Chutnicut seems not to be of this group.

  21. There were plenty of blood degree errors, discrepancies in tribal affilitation, and missing information on family trees that makes researching bloodlines difficult. The real truth is that the Band established by law the 1895 and 1913 Pala Allotment Rolls as the baseline for blood degree and lineal descent, and to use 1/16th blood of the band as the minimum eligibility requirement. There is no other evidence required. The idiotic claim by the EC that the disenrollees omitted the 1928 CIJR applications so they violated Section 6 of the phony EC Enrollment Ordinance is not even worthy of bathroom reading.

    Everyone knows that the disenrollees were enrolled based on the 1989 Final Decision, and that the BIA provided the evidence to enroll the Britten descendants. The Pala EC is using sovereignty, and the deference offered to tribal leaders to avoid scrutiny of the deceptive and illegal disenrollments.

    Now I have heard Pala members express their disappointment about the usurpation of political power by the Pala EC, and say that the disenrollees should have been more involved and then they could have stopped this. The BIA order to enroll the Britten descendants came in 1989. The actual enrollments didn't happen until 1994. By then the Pala EC had already put the Constitution to vote and they used that vote to adopt the Constitution in 1997.

    It just doesn't hold water to blame the disenrollees for the troubles in the tribe. Then after we were enrolled, General Council meetings became forums for tribal members to tell the Britten descendents they didn't belong. We have taken these insults, and tried to work around the people who are opposed to us. You can't please all the people all the time.

    We keep telling the truth, and the Pala EC keeps lying. Not much has changed.

  22. How can anyone blame the disenrolled for the problems, and you say that if they were more involved, that they could have stopped this whole mess. How do you figure this, the EC never put anything up for a vote, including but not limited to the so called constitution that was done. I'll bet that there are no members that can recall an ELECTION were they voted to adopt a constitution for the Tribe. I also believe the Britten descents should be put back on the ROLLS like it or not, the do BELONG.

  25. There was an election in 1994 to change the Articles of Association to a Constitution. I remember because I voted against it. Robert lied to the people and told them that we needed to become an IRA tribe and give up our non-IRA status before anyone would do business with us for gaming. It was a lie. There was only one IRA vote and that was in 1934. That was the only time for an IRA vote. Robert used his lies to begin his ascent to complete power and dictatorship. Not enough people voted in 1994 to pass the Constitution but Robert sent it to the BIA as adopted by the tribe knowing that it was a lie. Or should I say he got his lacky Nikki to do that.

The legacy of resistance against the Indian Reorganization Act in California, particularly Southern California, is widely known and is seen as part of the larger struggles that Indigenous people from Southern California endured in order to preserve a way of life for there children and grandchildren. Tribes in California were the poorest and suffered the most in terms of land loss and poverty. That they refused to assimilate to a US indpired, written, xerox copy of a Constitution shows the resolve and determination of preservation that tribal communities committed to for their future generations. What speaks even louder is how easily those future generations succumbed to lies and gave in to acceptance of an IRA indpired governing document that their ancestors would never agree to adopt, they would rather starve snd suffer for their future generations than conform to forced government regulation. What a slap in the face, now they are going to have to live with the consequences. People really need to know what they are voting for and stop thinking about themselves and their future, and think about the next generations and creating their futures.

  27. Yes, and if you look at the NIGC agreement with PBMI you can see that the Band says it is governed by the Articles of Association. That means that the Constitution was not necessary to gain approval for tribal gaming. Just another one of Robert Smith's many lies.

    Certain websites can be blocked from people who use Palanet. Cellphone providers can't be blocked, nor can other internet providers not controlled by Pala. Also E-mail can be read, or blocked, so be forewarned.

    Now this silly idea that no one has the right to bad mouth the Chairman needs to be addressed. The Chairman is a public figure and therefore not protected by law from public comments, dissent, or publicity. Anyone can speak freely as long as they avoid obscenity or outright defamation. Some of the comments may stray from propriety, but most are legitimate and not libellous.

    The good thing is that there is proof of the wrongdoing of the Chairman, and allegations of wrongdoing that have not been proved would need to be disproved in order to substantiate libel charges. That mean the Chairman would have to provide evidence that he has not done the things he is being accused of, and that would mean going to court and waiving sovereignty. Think that is going to happen?

    So say what you want. He won't do anything about it. He's a liar and a thief and uses sovereignty as a shield to protect himself from prosecution.

They, the EC want to built a Golf Course on the property and vow that they will get the land one way or another. Stop the EC now before they have a chance to do anything concerning this land grab.

  38. The Pala disenrollees are still fighting hard. I don't know why anyone would they aren't unless they haven't been paying attention. There is an appeal before the Ninth Circuit Court. There are all the recent posts here on the blog. There is the Agua Caliente Tribe. Lots of fighting going on.

    I am proud of the Brittens and their persistence and determination.

Well let me say this PalaRez, we are so mind set on proving that the Chairman and the EC were totally wrong to disenroll legit members, and we are so mind set on exposing the corruption that has spread like a cancer through the Pala Reservation. And we are mind set on having the Chairman and the EC members responsible for corruption and the hurt to members of the Tribe be held accountable for their actions. And furthermore the The EC has done many things outside their scope of authority that they can be held accountable for such actions. So we will see what the 9th circuit panel of Judges have to say. And we are so mind set on the EC and the Chairman that we are ready to all the way to the U.S. Supreme Court. Remember Palarez instead of being part of the problem, why don't you help and be part of the solution, it's the right thing to do for all Native Americans.

  43. Is Gina Howard trying to gain federal recognition for the descendants of the original evicted at Warner's? The reservation called Pala was established by the federal government in 1903 for the Evicted families at Warner's. The clause " and other homeless landless Indians in the area" such as the adjoining valleys and areas that included Luiseno and Kumeyaay people was part of the original purchase plan, they were eventually adopted by the tribe later on, but I don't think they were ever included culturally, religiously, and or traditionally at Pala unless the had kinship ties to clans and families, but at best they were considered foreigners. Why do I say this, because today most of those adopted families get to claim their total blood for enrollment purposes, but it is the Cupeno bloodline that is left to be scrutinized. The fact is that more no - Cupeno members exist than Cupeno memebers, and the disenrollment issue has illuminated that fact, which was used as an argument against adopting the other people at Pala along time ago, which has come to fruition. If she does gain I ng federal recognition, the reservation would be converted back to the original evicted families, and the EC or GC can invalidate the adoptions. What would the tribe be called the Pala Band of Aqua Caliente Cupeno Indians? All of this is trying to be stopped of course, because if you relinquish your rights in Pala, you lose everything and federal recognition takes decades is is never guaranteed, plus you only have one shot at federal recognition. Choose your battles wisely. I do not know what the future holds, but I think this conflict should be quelled internally, by the family members of the disenrolled.

    All we are doing is posting the truth for the public to see and to show the wrong doings that the US Government has imposed on legit Native Americans. Even more so, we back up our post by showing black and white documents that can be verified all the way to Washington D.C. None of it is "Hear Say", it's all facts, and if makes the chairman or the ec look bad don't blame us. Also is not doing the Tribe any justice by bad mouthing Mr. Freeman and the Pala Store. The store has always been our information spot. That's mostly the reason people go there. If it was the Pala Mission that was posting info for the public and Tribal Members to view, would you feel the same way?
    Please, for the sake of the Tribe and the Members so some respect for others. I'm sure that the EC can defend themselves if they so desire to do so.

  53. I'm not on the Ec but as far as I know, NO there are not any disenrollments scheduled. They are not facts because all of the Ec has ties to warmers. The rolls were fixed after the 162 people were given 30 days to prove their lineage, which they could not. If there were any more planned it would of been done then.

    The Pala Band of Missions is a Federally reconized Indian Tribe, and is organized under its ARTICALS OF ASSOCIATION that was adopted on 8-15-1959 and approved by Asst. Sect. on 11-06-1960, as amended on 7-03-1961, 11-27-1973,3-11-1974. and 10-2-1980.Seems like there is no mention of a Constitution anywhere, and are still under the Articals of Assoc. as this is dated 3-3-2014.

  89. Found I. It is in the letter from Amy Dunce to RS, chairman of the Luiseno tribe. Dated 3-3-2014. On page 18 paragraph 2. There is no mention of the constitution anywhere in the document. based on this letter it does mean that RS and Amy crapola transferred those lands to Old Pala. The letter is posted on Pala Watch. Check it out. Page 18.
