PALA Plans EVICTIONS for Speaking Out Against Their Injustice. Bet South Africa Did the Same

In a recent post we discussed how Pala Chairman Robert Smith is planning to evict some people, including Gina Howard, who is interviewed in the video below, discussing how their improper disenrollment, or stripping of citizenship has harmed her family. Please, Watch and Share. Re-POSTED to let our new readers have an idea how two local tribal casino tribes have affected their membership by revoking tribal citizeship: KCBS Channel 2 reporter CRISTY FAJARDO reports on disenrollment for greed and power tonight.

  2. I agree, our ancestors were pushed around and now select factions thinking it's ok to do it within is unbelievable. Our Ancestors settled with the unknown, and now the greedy factions think it's ok they went through it and now their descendants can, but the actions are generated within the band or bands. The crazy thing is these bands want to be protected from the outside, but their behavior is the same.

  3. Robert Smith thinks he can do whatever he wants under the veil of sovereignty, this is not what it was intended for. He treats his own people with such disdain and many of them live in fear of him and his followers. Don't do anything he does not like, don't talk to anyone that he does not want you to talk to, don't have someone over that he does not want you to have over, or he will try to evict you.

  4. The Altos were evicted from San Pasqual by Allen Lawson. The Altos went to Tribal court to seek remedy but were denied. They were forced out by Police, Security and Council. The Martinez family, specifically Hummay QuisQuis threatened the Altos if they did not leave that he would burn them out. Be careful, the law may not be on your side but its not worth your own life.

  5. The Martinez Descendants are confused. The post on the last blog says that they are against the removal of natives from a different geological region. (Pala). ("If they dont belong, they dont belong" Martinez Motto)But their own argument against Lawson is he doesn't belong but the Lawson family resided in the same geological region. Someone's got their head up there ass over there at the Martinez camp. Utterly confused.

If they decided to adopt the Alto's then who are these modernistas to disrespect the will of their ancestors/elders. In the late 1800's there were several different epidemics that left many children orphaned and homeless. You know what the old people did? They acted like Indians and took care of those young and raised them as their own because they were their own under Indian way. Now you want to disrespect that. I am glad that I am not you having to face the elders when I pass to the next world. They are watching. What are you going to do when they say you don't belong on the Indian side of heaven?   16. It's already been decided that if Smith goes ahead and try's to evict these 2 people, there will be 315 signatures promised. These signatures will be added to a complaint that will be sent to the FBI and the IRS, requesting an Audit (complete)of all of the Tribes Financial dealings. In fact we have already submitted to the FBI and the IRS a copy of the last 3 years of the financial statements that were handed out a few meetings ago.
    It's time for a change at Pala, and its time to fight fire with fire before someone gets real hurt or even dies at the Hands of RS and the EC.
    This is the right time to stand tall against the corrupt EC members and DEMAND and TAKE BACK OUR TRIBE, AND NOT TAKE NO FOR AN ANSWER.
    It's time for the Pala EC to pay for there Wrong doings that they have so imposed on the Tribe and its members. If they have nothing to hide, then they should welcome an Investigation to prove to the General Membership that they are honest and trust worthy, and if they are found untrustworthy then the General Membership needs to take action to get them imprisoned for all of there dealings.

  26. To pala rez and anyone else that supports the current EC, I am here posting because I can't see how anyone can be so dumb to stand up for the current EC. I'm and outside person looking in and all that I can see so far is that the Tribal members don't have much of a say concerning any thing that's important on the Reservation.
    This is very confusing to some of the outside people looking in because they thought that this sort of thing only happened in other country's.
    I do have a real question for Pala Rez or anyone else that cares to answer. WHAT ARE YOU GOING TO DO IF THE U.S. GOVERNMENT STEPS IN AND CLOSES YOUR CASINO, LIKE THEY DID UP NORTH ?
    Or don't you care that what your fought and died for will be null and void because of the way your Tribe is being run. It sound like a MOB story out of a mob move or something.
    I would be willing to bet that the chair person is involved in organized crime for sure. Is he? Are you? You can not claim Sovereignty under the RICO ACT. And all involved can be put in prison for many, many years. This is a very serious issue happening here in Pala and I know that most of the members have worked their entire lives to get this opportunity to relax and enjoy life in it's fullest comfort. And to throw all of this out the door would be a sin in it's self. Fix this before it gets fixed by the Government, or it will not be the same because if the U.S. Government gets involved the will for sure Take a bigger cut of the pie.

  31. It still is strange that the Lugo's, Dion and Theresa chose to look at the descendants if a full blood Kupa Indian and hurt her descendants by dis enrolling her great great grandchildren. Why did they only choose to look at her and not their own families questionable ties to Pala. Why didn't they Theresa and Dion look at the document where Remijo Lugo requested his paycheck for herding the Kuoa people to Oala be sent to his home in Morongo. Morongo was where he was enrolled. Maybe they didn't want to look at their own enrollment and the enrollment if their first cousins because they wanted to continue to enjoy the benefits of the casino. Even though it was cheating rightful members still enrolled and unjustly disenrolled.

  32. People don't know the history. Mel Lovato and Leroy Miranda said their grandma told them Margarita Britten was half blood. Juliana Calac asked the BIA about it too back in 1962. Patricia Nelson filed an appeal in 1989 to overturn the BIA decision. There is a faction at Pala that has always been opposed to the 1/16th blood degree Britten descendants being enrolled. This fight has been going on for over a century now. Some people just can't handle the truth.

  35. @ PalaRez@3:12PMWell if you are so tired of hearing, why don't you try READING THE FACTS ON THIS BLOG and except the TRUTH as it is written and well documented ,not only locally but also in Washington DC. If this was your Family would you be doing the same thing as we are? Everyone is seeing truth come to light here with all the supporting evidence from the United States Government,and the Affidavit sworn by E. Lucero, who was the BIA Specialist on the enrollment issues. If you can't read it, let me know and I will be happy to have it put on a CD for you so that you can understand that no matter what anyone says, THE BRITTENS DO BELONG,LIKE IT OR NOT. And that fact that the EC is putting this in the hands of the 9th Circuit Court of Appeals is going to hurt the Tribe more, when the issue of Sovereignty is at stake for the Tribe, because it doesn't apply to the 9th circuit board case. And neither does the Martinez issue. The EC does not realize that they are putting this entire Tribe at risk as far as the Sovereignty issue goes. It will open a new can of worms, so to speak, and the EC can only blame themselves for this. When Rs and the EC decided to over turn the Governments 89 decision they in fact broke a FEDERAL LAW by doing so. And the 9 Judge Panel will see these when the view the Evidence on file, remember this is a Federal Case and Federal case Law will be in effect. Can't hardly wait to have OUR day in COURT.

This has escalated to matters of tribal leaders exceeding their authority, attempts to evict non-members from the reservation without just cause, denial of due process and other civil rights violations. Then there is the internal corruption, the theft, malfeasance, and misappropriation of funds. We can move on to extortion, and compromising tribal members to participate in criminal activity. How about bribery of federal employees? We all know that Amy Dutschke, Robert Eben, and Frances Muncy have abused their positions and shown favoritism to Robert Smith and they didn't do that for nothing.

    The list of offenses keeps growing larger and longer. Go ahead and support the Pala EC if you want. It is a losing proposition. Those guys keep breaking the law and it will catch up with them. If you are part of the conspiracy you can expect some consequences. These allegations are not going away.

  46. PalaRez, in the 9th circuit appeals court on this Pala Case the issue of Sovereignty does not apply and neither does the santa clara issue.
    This case is about the BIA not doing there job. So no one will be able to claim sovereignty on this issue. It has nothing to with the Tribe .

  48. I see the Santa Clara vs Martinez Supreme Court Ruling coming into play somewhere soon. The Santa Clara vs Martinez case has been the unofficial anthem of the B.I.A. in the Pala ordeal but there it can actually work for the pala people. The ruling states "only a tribe can determine its membership". Pala is not a tribe but a association of groups, the people disenrolled are all from the Agua Caliente Tribe from Warners Hot Springs. The two people who motioned and voted to disenroll have subsequently been found to have NO TIES to the Agua Caliente Tribe, therefore they CANNOT determine anything when it comes to the 162 people they disenrolled. Maybe it time to approach the B.I.A. with all the documention proving Theresa Nieto and Dion Perez have no lineal connection to the Cupeno Nation and see if they still want to stand behing a P.B.M.I. E.C. that has violated a Supreme Court ruling, if so then they would also be guilty by doing nothing and continuing to carrying a government to government relationship with a rogue illegal leadership there in Pala.

It is obvious you have the power. Rob has known this all along even if his ignorant followers don't. Only the people can end the wrong doings that have occurred and are occurring. The Lugos had a chance to help themselves out even if Rob was holding their illegal membership in our tribe over them but they didn't so that is the karma they have bestowed upon themselves. Kick them off this reservation along with Rob and his family of supporters. They were gonna do the same to those brave souls who tried to stand up to Rob and his nefarious ways last year.   55. The truth is simple. The court dismissed our case due to sovereign immunity. That has nothing to do with the validity of our allegations. This statement that the Pala EC won the case is a lie. So get it straight PalaRez. The facts didn't go away. The court wouldn't look at the evidence because they said the EC can't be sued when acting in their official capacity.

    Now what would happen if the court actually looked at the evidence and the plaintiffs had an opportunity to discovery, meaning they could subpoena evidence from the defendants? It would be an open and shut case. The Pala EC handed out the same financial report two years in a row. They are hiding the theft of large sums of money. All you have to do is find out where the money for Pala Interactive came from. That money was not accounted for in the financial reports, and the EC lied about it to the General Council for two years.

    There is a cell in federal prison with Robert Smith's name on it. I hope he likes pork and beans because he is going to be eating a lot of it.

    They also will not approve a SDG&E pass so the said Church can get electrical service, and they have refused the same Church to hook to the Water system. Thats why the Church has to haul water in so the bathrooms can be used during service, and have had to buy large Generators for their lights to be used also during service.

That was the same exact spot where Theresa Nieto screwed up a couple of months ago when she was attempting to recite the LORDS PRAYER. The people at the Meeting had to finish the prayer so the meeting could start. And Nieto is Supposed to be an Angel at the old mission at Pala. (Angel with horns).

    This is a case against the BIA and the BIA Employees that are refusing to do their job like Amy douschbag, And the ASIA, it does not involve any one from the EC or any Tribal Members per say.

The EC even refuses to give SDG&E the approval to hook up electric for the church where Pastor Johnson was the assistant Pastor where he is not allowed to go to Church any longer, By order of the EC. They,the (EC)won't even give to said Church permission to be hook up to the Tribal Water supply or the Tribal sewer system. And the Pastor of the Church is even a Tribal Member, but they still refuse to comply. They, the said Church had to buy a generator so that they could have lights for their services and use a water tank mounted a trailer to haul their water in so the Restrooms could be used during service.

  65. I am guessing here. But the Pastor of this Church must be a Descendant of Mrs. Britten. Is this the reasoning behind the denied request for electrical, water and sewer service.
    That's is so childish on behalf of an Executive Committee that should be helping this Pastor to make the Reservation a better place to live.
    And is this the same Church that the Pala EC has banded an assistant Pastor to attend services for standing up for his rights.
    Be careful Pala EC, you are way overstepping your authority on this one. A right to freedom and a right to practice ones Religion are is
    a Constitutional right, and not the right of the Pala EC to determine.
    This Assistant Pastor and the Church should fight this issue to the fullest extent and do not give up until you win.

  66. Well now this is really fucked up that they won't allow this Church to have water and electrical service. How did so many people get electrical service and water at DoDo's trailer park. Did the Tribe approve the electrical service there along with the Tribal water and sewer system hook ups. That is really messed up. It seems that the EC is really overstepping their authority by refusing these services to this Church. And how did Donna get her Church water, sewer hookup and approval for SDG&E service. Or is she illegally hooked up to the services?
    I guess that the EC is really out to get all of the Descendants of
    Mrs. Britten. We are truly beginning to see this now, and as Tribal Members, we thought that the statements against the EC were being made because of the disenrollments. But know this issue have shown a new light on the EC and should be dealt with now and not latter, because this is really wrong and it is no way to treat Members or other people that have done nothing to deserve this kind of treatment from the EC or anyone else. And to band a Pastor from attending church services because the EC says so is a violation of the U.S. Constitution.

  67. The Pala EC needs to approve this SDG&E hook up ASAP, Because if they don't then at the next meeting when they want to vote for service on a new home, TURN IT DOWN and vote NO.
    And keep voting NO until this Church receives the services that they should have had a long time ago. This is just down right hateful as far as the Pala EC is concerned.
