This letter newsletter will be about history of the Pala Reservation. Hope the young people become more interested in how Pala became the new home of their grandparents, great-grandparents, and great-great-grandparents.
On April 12, 1895 the Secretary of the Interior approved an allotment roll for the Luiseño Band for a small reservation on the south side of the San Luis Rey River which was about 350 acres. One allottee was Maria Sal, she had four children: Ramona Scott, Adelina Giddens, Albert Golsh and Sebastian Salazar. All their descendants would be members of this reservation. None of these descendants would be from Warner’s Ranch area. How and when did they become enrolled in PBMI?
When the people moved to Pala from the Warner Ranch Area (Kupa, San Felipe and Puerta La Cruz), the Pala Reservation was established for them and covered about 1,100 acres.
These two Bands were separate Bands. The Luiseño band never voted at the Cupa meetings or even attended those meetings. This band was never part of the Kupa, San Felipe, and Puerta La Cruz. Now Robert claims you can’t belong to two reservation/tribes. It seems, in light of Robert’s claims that the Luiseño Band attending and voting at our meetings belong to two different reservations/tribes.
According to our Articles of Association you must be a descendant of those moved from Warner’s to be a member and vote! How many attending our meetings and voting can show that they are a descendant from Warner’s?
Is Robert slowly disenrolling descendants? Slowly kicking them off of the rolls for what reason?
In 1955, in testimony before the California Senate Interim Committee on California Indian Affairs, Robert Ardillo gave the following testimony on behalf of Old Pala:

They are essentially cutting their own per cap down. Grow some balls and ask for an audit. That's why he got rid of the term limit. He knows he can hide the thievery if he and his cronies are in office. The tribes are always blaming the white man for everything, yet they let Robert rob them blind according to many. He and his friends are growing rich over your lack of caring and your trust in him. You deserve to lose everything like you will if it keeps up.

You think giving your opinion and spreading the truth about Robert Smith and Theresa Nieto stealing Pala's money and abusing its members civil rights to stay in power is gonna make a difference?? Well I don't. The truth is not enough. If you feel that strongly about something then do something about it. That's what it took at Chukchansi to get federal attention and have the casino shut down. Rick has provided us with lots of information that he receives from other people. Everyone knows a blog is also opinion, so yes he has his right to post his opinion. Anyone that goes on a blog, will know that it is his opinion, but when you look at all the evidence he has been supplied with then his opinion means something. You are just upset that the truth is coming out. He also lets people know when it is something he has read or heard and not his own opinion. Why do you allow Luiseno to be nominated and serve in a Government meant for the Cupeno?
We the people of "The Band" eagerly await your reply.
If Robert re-enrolled you guys (cousins) now, then let's start off fresh. If he doesn't and waits for the courts to uphold the ASIA "final" decision on Margarita Brittens to be "FULLBLOOD" and Robert has to re-enroll then go for back-pay. It's your money just as much as any member and you should have been getting it all along. The EC has the money it won't hurt us (the tribe). If he admits there was a mistake made and re-enrolls on his own and start from that point forward don't fight for back-pay and continue this any longer. It needs to end. If Ronert doesn't have the decency to end this on his own and reinstate and is forced to then go for everything that's rightfully yours. Robert has the power to end this situation and allow Pala to move on.
ReplyDeleteThank you 4:33, we the disenrolled are willing to talk and settle our issues in a peaceful manner. We have been denied over and over again first by the Pala EC , then by the Pala tribal members followed by the BIA and government officials that have been paid off. I truly would not like to go to court, but it would be interesting to see how far Rob went to keep us out. He is not alone, he is blindly served by the EC via stolen money from the tribe, government officials like Deutchke and Ebens at the BIA with manipulation of paperwork and several other county and city officials who turned a blind eye to his unlawful actions. Maybe this is the vehicle that must be taken in order to bring justice to light? The Brittan family is committed and United and we are not going away! Robert chose the wrong family to disenroll, we are warriors of justice and truth and will stop at nothing.

@4:33 I agree 100%....@6:44 it will be interesting to see how far Robert is willing to play this out before he does the right thing and follows the Sec of Interiors final decision that M Britten was FULLBLOOD and any court will uphold a federal order that the tribe followed for 22 yrs then just decided to go against it. Is he really that hateful that he will allow Pala to be damaged by a court order just to hurt King and Willy and other members that go against his dictatorship? Time will tell and that's all it takes is time. Even Robert knows he couldn't pull off the disenrollment forever. COME ON ROB FIX THINGS. WE WANT PRE-DISENROLLMENT PALA BACK!!!!

ReplyDeleteI know what documents that have been submitted for review in the 9th Circuit Court of Appeals and there is no way that any appeals Court
with an honest panel will vote ant other way except to vote in favor of the Plaintiffs in this case. The evidence is overwhelming as to why the disenrollment should have never happened in the first place.
And I have to agree with the above post as to the Pala EC should re-enroll before the 9th Circuit makes its ruling.
#-1, if the Circuit sides with the Plaintiffs, it will look better to that the Tribe has made an effort to end this case on it's own accord.
If there is nothing to back up the Pala EC's action , then their could be some real heavy sanctions imposed on the entire Band.
You must remember that this is a Federal Court and what they decide will become law as far as the Band and the BIA is concerned.
However in all the evidence that has been presented for review, their is nothing that supports the Pala Band as far as their actions on this issue. It is all based on theory on their part. But the Evidence is overwhelming as to the blood degree of said MB. And it is all documented as far as the U.S. Government is concerned.
I guess it is very important to keep records as the ones posted her and the ones that are presented as evidence for the 9th Circuit Court of Appeals Panel. Good Job to who ever saved or obtained the information.
It has been years of research, mostly done by one or two people that have gone over all the archives they could and by asking for information that is available by the information act. It is amazing the thousands of records this person has gone through, but it is all because we have been wronged. In doing this research it has been found how much info that certain BIA officials and tribal leaders have tried to hide or have eliminated. Very sad the amount of power they have to hurt people.

ReplyDeleteYou are thinking that because of the appeal on Cosentino that the federal government has the authority and right to intervene in tribal governmental business. The arguments within the opinion of the appeal to Cosentino rely on a logic that limits tribal sovereignty and decides how and why a tribe can govern themselves. I don't see the 9th Circuit siding with the Plantiffs, because the Cosentino appeal case goes against a long standing federal law scrutiny that reviews how "official capacity of tribal government officials" is understood in comparison to how tribal immunity is understood. The appeal to Cosentino is just a California State appeals case, the 9th Circuit is a federal case that supercedes State authority. Although the merits of how Cosentino and it's appeal are relevsnt, they will be scrutinized under federal interpretations and can be overturned. I believe that tribes have the right to decide how they want to govern themselves, be it negative or posituve, and the interpretation of what is deemed negative and positive should not be interpreted by people who are not part of the community, and especially in a court that has no jurisdictional authority to decide the future if how tribes can govern themselves. Tribal immunity is important becsusese it allows tribes to remain independent, free from outside interpretation of tribal governance. Tribal immunity is important because it coincides with the right to remain sovereign, interpreting what is the right or wrong official capacity of a tribal official is invading a tribes right to govern themselves, and greatly undermines the underlining ideology of how tribal sovereignty is understood and maintained not only under federal law, but within tribal communities where it is active and alive.
The 9th circuit only needs to rule to uphold the ASIA final decision on M Britten FULLBLOOD status not the tribes right to determine membership or sovereignty. They just have to back their governments ruling over a tribe that already decided and has followed it until the leader got upset with certain people and wanted them out of the tribe. This has nothing to do with a tribe determining membership or sovereignty it is one man pushing all this over personal reasons not blood degree,membership requirements or a tribes rights. Robert Smitb is not the tribe he cannot do what he wants and get away with it because the tribal members are afraid to speak up against him and lose their percap. That is why nobody will sign their name to anything to be sent out asking for help to other agency's.

ReplyDeleteAlso, the sovereignty issue does not apply to the BIA the same way as it does the Tribe. This case doesn't even involve the Tribe directly.
It's the BIA that is refusing to make the Tribe abide by the 1989 FINAL decision by the ASIA. The BIA has no balls to stand by their own decisions and that is wrong.
The problem with the sovereignty issue is that the Tribes are using it to justify these dis-enrollments of true Native American Indians.

ReplyDeleteThe ASIA is a position that is determined by the Executive branch of government, the BIA is an executive administrative drpartment. The rules and regulations that are introduced by the ASIA and the BIA are federal memorandums, not case or legislative law. Remember, the Legislative Branch of government has the power to veto Executive decisions and to create new federal laws, the Judicial branch decides whether or not the Executive orders and/or Legislative laws are Constitutionally sound. The catch is that the SC only hears a limited amount t if cases per year, and they pick and choose what is important dependent on their political persuasion. Currently, Indian Law cases are not priority nor are they being favored towards upholding tribal sovereignty. The thing about this mess is thst the ideal of tribal sovereignty ty is being shoved into a position where outsiders can determine, shape, and limit just how that inherent right will be executed in the future. Internsl tribal matters need to be fixed internally, or through Congress. The courts are limiting sovereignty, which affects the whole nation and each tribal community within the nation. The ASIA decision from 1989, although in favor of enrollment, is not the final say of how a tribe recognizes and determines itself. The problem is within, not without.

After a little research was done he would get any where from 250 to 325 clear votes.

You all complain about the EC and when someone decides to risk it all run for a seat on the EC that is from an original cupeno descendant you put your support on a person with questionable ties to the Cupeno People. And a person that has been accused of crimes against a minor child.
Everyone knows how close Eric and Robert are, and you all know that if Robert ask Eric to do something, he will do it without question.
This fact has been done over and over again.
I don't think that even showing you his birth certificate will change anything. So if that's how you feel then you go ahead and vote the way that you feel, but don't cry later when it comes to past that he is from the Garica side. You all have a chance to bring change to Pala but are you really wanting a change or are you just talk.

They know that Pete would never vote to dis-enroll anyone, not even the Lugo Family and that's why they don't want Pete to run even as a write in. Because if Pete where to win, that could spoil Smiths agenda. Think about it people.
Also someone posted earlier that may be someone should go and talk with Pete about his running for Vice, so I am going over to talk with him on Sunday afternoon, and if anyone is interested and with his approval I will let you all know what he has to say. So let me know what you want.
The 9th Circuit Court is conducting a hearing on an appeal. Only the matters of the appeal will be decided. Neither party us challenging the sovereign immunity of PBMI, so that will not be under consideration.

I also actually did an accounting of the votes that he could possibly get and I was very surprised at the numbers that would favor him if he in fact does decide to run as a write in, they are very good indeed.
Has anyone talked to Mr. Trujillo sr. about this yet. And is their enough backing to get him involved in this election as a write ?
I know that there is a lot of rumors going around that he would win.

I am sure that everyone knows who I am, and who my parents are.
I do have some education under my belt as far as business goes. I worked for Ford Motor Co for over 9 years. I started as a lot attendant in the mid 70's and worked my way up to General Manager at the Vista Branch of Heller Ford. I also ran my own towing service for many years here in Pala, with contracts with the CHP, County Sheriffs
The Border Patrol, The San Diego County Corners office.
I live here in Pala with my wife of 34 years and our family of 4 kids and Great Grandkids.
I would be very proud to serve the Members of Our Reservation as their Vice Chairman, in fact it would be an Honor.
My father, Peter P Trujillo was involved a little, here and their with the Tribe ,but was mainly involved with the housing dept.
My Mother Betty Trujillo was the cook at the Pala Mission School for
many years . I really do ,with a sincere Heart care about our Reservation and all Tribal Members.
If I an elected I can without any doubt be fair with all members and listen to what you have to say with an open mind and an open Heart.

Hey has anyone heard about the EC re-enrolling the disenrollee's?? That they are sending out letters. I guess they looked over Margarita's history again and count her as fullblood. If it's true I give praise to the EC for doing the right thing and moving in the right direction.

ReplyDeleteI don't want to break your bubble but I doubt that this is true. I think it's just another way of making fun of the disenrolled. I really wish that that was true but highly doubt it. Remember we still have the same EC as we did when the dis-enrollments took place, and for them to do whats right is not to likely to happen.
Very happy to see that Mr. Trujillo sr. is serious about running for Vice Chairman. Mow all of those that wanted him to run need to support him and help to make this possible. And I mean all, so don't start to relax and do nothing. Help by spreading to word and make his signs, and call you friends and family members that don't live her and tell them to vote for Pete sr.

So please call all the people that you know that will be voting by mail and tell them who to vote for. This needs to be done because he will not have access to the outside voters. So he is counting on everyone to contact these members and let them know who to vote for.

Although soverignty immunity is not the sole purpose, the logic and discourse embedded within the merits of the arguments that decided the ruiling are, which is like a deconstruction of all legal reasoning and discourse so far. Affirming or reversing is based on the interpretation of how the law was applied, and ultimately is based on the ways in which federal law dictates it's legal discourse concerning Federal Indian law.
Not really an argument. The appeal disputes the reasoning of the court in its decision to deny the motion for summary judgment and to grant the cross motion.
DeleteThe immunity of the Band is not being challenged. If that was a claim it would be necessary to join PBMI as a party. It is the decision of the AS-IA that is at dispute.
Though the agency administrates federal Indian law, the jurisdiction is the standard of the APA which governs federal agencies not Indians.
Fine points to be sure but necessary to understand. Remand of the AS-IA decision is the desired remedy. Will that infringe on tribal sovereignty? The defendants argue that they are unable to craft a remedy that does not infringe on sovereignty.
Does the court have to take that into consideration? Only if the court decides to reverse the decision. It is not grounds for affirmation, but must be considered if there is a reversal and a remand ordered with instructions.
9:29 is not a brittian. We just want to be re enrolled. 9:29 is someone trying to make the disenrollees look greedy.
ReplyDelete@ Peter, You can probably find out who the tribe goes through for background checks and get your own done, and then keep a copy for yourself and have three sent to them: certified, regular mail, and emailed, that way they cannot claim that they did not receive it. ReplyDeleteI am not being gullible I am being hopeful. Yes the EC was wrong to dis enroll, but that does not mean they still can't do the right thing. If they are willing to re enroll instead of go through court then I am NOT going to argue. However it would take a lot for Robert to re enroll, so I will not hold my breath.

ReplyDeleteI am not to concerned about the back ground check because I went through a complete back ground check when I was fighting to get custody of my Grandkids. They did a complete check of every thing and more, including finger prints, and I past it with flying colors.

ReplyDeleteWhy would you ask Pete not to run in fear of splitting the votes. He is stepping up to bat for all the Tribal Members who asked him to do this, and you are asking him not to do this.
How about you put on your thinking hat and try again.
If Eric runs and wins, there will for sure be more Families dis-enrolled. Eric is not a Man of his word. He has proven to be a yes man for Robert Smith and you know it.
Eric will be used to dis-enroll the Lugo Family for sure. And all Smith has to do is ask Eric to do this and he will obey.
On the other hand you have Peter Trujillo who has gone through this dis-enrollment already with some of his Children and Smith knows that Pete would never make a motion to dis-enroll anyone, including the Lugo Family.
He has made a statement about how he believes in the Customs and Traditions of the Band that was instilled in him by his Father and said that he would not be swayed to go against these Customs and Traditions because he knows what they mean to the Tribe.
So why are you willing to risk this by asking Pete not to run as a write in Knowing the history of Eric's ties with Smith. Is it that you want another yes man as you vice chairman, instead of a man like mr. Trujillo who will stand up for what is right and be firm about it.
It's a no brainer to vote for Mr. Trujillo.
I truly hope that all the members of Pala will read this and see what the truth is and cast their vote for a true Cupa Man that Mr. Trujillo

Besides there are over 80 comments here under the cupa news letter post and I count less about pete's running for the VC spot than any other post,there is also more about Eric's blood degree than there are about Pete running for VC.

This is according to Local Crime news and recent arrest in Pala.
