Indianz.com has a scathing story on the despicable Pala Band of Mission Indianz and its porcine chairman Robert Smith.
Two children who were disenrolled by the Pala Band of Mission Indians which, disenrolled 162 members cannot be protected by the Indian Child Welfare Act, a California appeal court ruled on Tuesday.
The tribe formally objected in July 2009 when K.P. and Kristopher were put up for adoption. Their mother, Michelle T., is enrolled.
But sometime during the proceedings, the tribe disenrolled the children. As a result, they are no longer considered "Indian," the court determined.
"Under federal and state law, the Indian tribe's membership determination is conclusive," Judge Cynthia Aaron wrote in the unpublished opinion. "The record shows that enrollment is a prerequisite for Pala Band membership, and that the Pala Band determined that K.P. and Kristopher are not members of its tribe."
SO, are tribe's doing the government's "dirty work" in getting rid of Indians? Now, disenrollment means one is NOT Indian..while at the same time, there is NO requirement that you have to be INDIAN to be a tribal member?
Michelle tried to argue that the tribe's enrollment decision's are subject to review by the Bureau of Indian Affairs. A federal judge has rejected that view but the case is currently pending before the 9th Circuit Court of Appeals.
Separately, the 9th Circuit has rejected a different disenrollment lawsuit filed by former members who tried to sue individual tribal leaders rather than the tribe itself.
Assistant Secretary Kevin Washburn, the head of the BIA, has been a strong advocate for ICWA. Just last month, he told the National Congress of American Indians annual convention in San Diego, California, that the law remains under attack by non-Indian interests.
And, apparently, INDIAN INTERESTS
Washburn's position on disenrollment, though, inadvertently contributed to the negative decision this week. The court cited his 2013 letter in which he said the BIA lacked the authority to review the Pala Band's membership matters.
More directly, the court relied on the ICWA guidelines that Washburn issued in February. In that document -- which does not carry the force of law -- the BIA urged state courts and state agencies to defer to tribes in determining who is and who isn't an "Indian."
Inadvertent means he had no idea. Who would believe that? He knew what would happen, he just didn't care. The JERK WASHBURN WROTE THIS:
The ICWA guidelines define an "Indian child" as follows:
Indian child means any unmarried person who is under age eighteen and is either: (1) a member of an Indian tribe; or (2) eligible for membership in an Indian tribe and the biological child of a member of an Indian tribe.
In a section titled, "Who makes the determination as to whether a child is a member of a tribe?" the document reads:
The State court may not substitute its own determination regarding a child’s membership or eligibility for membership in a tribe or tribes.

I know this has been said before, but I am saying it again. the practices these tribes engage in is not the way of an honorable people or nation of people. Even though our ancestors were treated so poorly by being killed, placed on plots of land and then having their kids taken away to be mistreated and abused is not a good enough reason for these decedents to do the same type of things with disenrollment and exclusion of longtime members who can trace their heritage to those of the past. ReplyDeleteThis is so disturbing and actually brings tears to my eyes. Two children who have obviously lived a life of heartbreak will continue to be lost in the system. This is not only the fault of the Pala Council, but the members who allow him to continue on this path of genocide. My heart goes out to the children and the members who have been wrongfully disenrolled.

And it is all because the Tribe refuses to recognize all the Federal Documents that have been given to them which proves the blood degree of our late great, great Grandmother Margarita Britten.

I don't understand how the Tribe and the U.S. Government could decide this issues because the case that involves the 2 children is in the 9th Circuit Court of appeals. And the fact that ASIA Washburn knows what the decision was made by his department in 1989, and was final for purposes from the BIA,or the so called Department of the Interior.
There are so many Documents that prove that Margarita Britten was and is a full blood Cupeno Indian.
And now we, The relatives of these babies sit here in total shock and wonder why our own people will not step up and help in correcting the issues of our dis-enrolled family members.

If Kevin Washburn would just do his job he could eliminate most of the problems that Pala is facing, of course getting rid of the current EC would be the best way to overcome these heinous crimes they are committing. Just think they would not need the lawyers that they aren't supposed to use in the first place for personal reasons, the government could save so much money for their lawyers too, they have so many cases involving disenrollment and their lack of duty, Just do everyone a favor and make all tribes re-enroll their legitimate members or no federal recognition for the tribe, then the government is not determining the membership, they are correcting it and giving the disenrolled a chance to prove their right to belong.

K.P. and Kristopher were previously enrolled as members of the Pala Band. The Pala Band disenrolled the children in February 2012. The children's father was not, and never had been, an enrolled member of the Pala Band. The children's mother remained an enrolled member of the tribe.
Robert H. Smith, Pala Band Chairman, sent letters to the juvenile court, dated July 9, 2014 and December 17, 2014, stating that the children are not enrolled members, and are not considered eligible for enrollment or reenrollment, with the Pala Band of Mission Indians.
That tells me that Robert acted solely and purposely to make sure that these two children were removed from the protection of ICWA.
When is the world going to see the monster that Robert Smith is? When is the world going to stop pandering to this ass, who apparently relishes not only disenrolling people who are rightful members, but then shoving it down their throats, again and again. How many acts of unbridled hatefulness do we have to take before the Kevin Washburn's, the Ebens, the Dutchske's, the Muncy's of the world are held accountable for not only allowing this behavior, but even assisting this behavior? The Snyder Act of 1921 does not define Indians in terms of membership in a federally recognized tribe.

Secretary of the Interior, shall direct, supervise, and expend such moneys as Congress may from time to time appropriate, for the benefit, care, and assistance of the Indians throughout the United States..."
The BIA is compelled by law to provide services to Indians throughout the United States, and it is only an internal policy to deny benefits to disenrollees. In the matter of the descendants of Margarita Britten the BIA has already issued a decision that they are indeed Indians. The 1989 Asbra and Mills Final Decisions establish Margarita Britten's full blood and the right of her descendants who are at least 1/16th Pala Band blood degree to be enrolled in the Band.
The lawyers defending the rights of these children to be covered under the protections of the ICWA should insist that the the BIA once and for issue a decision on their position on whether or not the 1/16th blood degree descendants of Margarita Britten are Indians.
The Bureau has been playing this game to avoid issuing a decision on the matter. They have been deferring to the Pala EC's decision and saying that the Band has the power to decide who is Indian or not by right of inclusion in the Band. Since the disenrollments are still under appeal there is doubt about the finality of the decision. In the matter of the welfare of children every effort must be made to protect them from harm for that is the intent of the ICWA.
The BIA has stated four times that they uphold the 1989 Final Decisions. They cannot overturn their own decisions and there has been no appeal filed. Somehow, someway, the courts must be led to the correct argument that will enable them to rule on the law. The Court cannot rule based on tribal law. Lack of subject matter jurisdiction is the argument that has been used numerous times to dismiss litigation. Why is any court citing a decision made by the Pala EC in order to deny the right of Indian children to participate in the benefits of the ICWA?
Robert does not care about any kids, according to him "they can have welfare". He does not even care about his own kids, look how well he has raised them. He has to get their names erased from arrest records, wow, such a great thing to have to do for your daughter, lol, what a joke. How sad for those girls. Look how he treats his own wife, according to other members he goes off with other women all of the time, even Theresa Nieto, come on, yuck. He pays for it. Maybe his wife stopped giving it to him long time ago. He leaves a trail of abuse behind him.

The minors all had trust accounts that they would receive when they became adults, but all that money has mysteriously disappeared. Theresa Nieto is the one in charge of those accounts. That money is for those kids and by you stealing it Theresa, for you and Robert, that is abuse and failure to provide! All your luxuries are possible because we helped to start it. You are all part of this, you people have destroyed the disenrolled physically,mentally, and emotionally. You are responsible for each and every person affected by your actions. You are despicable! You can change and make things better though, it is still not too late to repent. You know the truth, all of you do, is not one one of you even the tiniest bit sorry, and feeling guilty. This Judge also made some false statements in her ruling. She stated that the Pala Band Said that these two children were not being reenrolled or even being considered for re-enrollment.

The Band has never got to voice their say in this matter or any other matter concerning the Dis-enrollment of these people, the Decision was made by the EC which does not have that Authority unless it is brought before the General Council for a vote. So the Pala Band did not make that statement, it was Robert Smith that did this and he will blame the entire Band for his actions.
Is this just another reason that the EC wanted you to pass the Amendments change at the last meeting on Nov. 11.

As Pete has said, words are words. I have heard all kinds of talk from Pala people saying they have their family's back, and how important Pala is to them. Actions speak louder than words. I guess most Pala members want someone else to do the heavy lifting. Either that or the check is more important to them than family or the horrible conditions at Pala.
ReplyDeleteWhen the Casino opened it was operated under a management contract. The manager was Jerome Turk. His role was to get the operation up and running and then to manage it thereafter. There are all kinds of jobs that need to be done to get a licensed gaming enterprise operational. In exchange he was paid a lot of money. There is no way of knowing how much it really was. Some say as much as 30% of the revenue. Was that gross revenue or net revenue? I don't know. Only an audit will tell.
But Jerry Turk is gone. He left with a rumored $120 million in cash. But think about it. Without him taking his cut, there was a lot more money available for per-capita distribution. What happened to that money?
Then the EC disenrolled 164 members. There were some minors, but a conservative estimate of the amount of money that was freed up for per-capita is $18 million a year. If there are 1000 members that should have been a $1500 per month increase for each member. What happened to that money?
Then Howard Dickstein and the Pala EC parted ways. Kilma Lattin says Dickstein was paid a 5% share of casino revenue in cash. That could be anywhere between $25 million and $40 million a year. That also freed up money for per-capita distribution. What happened to that money?
According to the IGRA (Indian Gaming Regulatory Act) the Casino is supposed to be under the sole proprietorship of the Band, and must operate exclusively for the benefit of the Band. That means that all the net revenue is supposed to be accounted for and distributed according to the RAP (Revenue Allocation Plan) submitted to the BIA.
If the Pala EC was acting in accordance with the law, then there should have been increases directly related with each of these events, and the increases should have sustained over time. Instead there have been decreases.
The Band's money has been diverted.
Some of it is being spent on unauthorized legal fees. This is an absolute fact because the General Council was just asked to approve the contracts of a bunch of lawyers.
Some of it is being spent on lobbying. This is an absolute fact because there are watchdog agencies tracking the contributions of the Pala Band. The numbers I saw were $26 million between 2000 and 2010. You can expect that number to be higher between 2010 and 2015 as Robert Smith has spent lots of the Band's money lobbying for legislation to approve internet gaming in California.
It has been spent on Pala Interactive. Over $100 million for a joint venture, and the Band's deep pockets are providing all the financing and operating costs. The Pala EC members sit on the Board of Directors and collect salaries. To date no other Pala Members have seen any financial report, received any money, or have any financial share of Pala Interactive.
It has been squandered on the Pala Jets, lavish parties, travelling to golf tournaments and vacations, and splurging on personal luxuries. This doesn't even take into account the comped Pala Suite and food and bar bills at the Casino that are just considered to be a deduction from gross revenue and never would become part of per capita distribution.
The Pala EC are a bunch of crooks stealing the Band blind. If the greedy Pala members stood by their words they would be asking the hard questions instead of taking hush money and spying for Robert Smith.
There is a huge amount of missing money. It could be for the benefit of everyone. Instead the Chairman and his minions stealing all they can get their hands on, and a lot of Pala members either don't care, are scared of retribution if they oppose the Chairman, or like it this way because they get something out of it.

Pete seems to be more of a people person also which is a big plus for the Members.
And how long has it been that we have had an Elder or a Senior sit on the EC committee. The Elders and Seniors need a voice on the EC to fight for what they need and for what they stand for.
This is where Pete will be most helpful on the EC, supporting the Seniors and the Elders of the Tribe which is a must in today living.

Seems like the real Cupeno's are the ones that have to fight to stay Members of their own Tribe.
Robert wants Eric so he can disenroll a list of people including the Lugo family, and then when Eric is done disenrolling, Robert will bring in another Kronie to get rid of Eric, because he never belonged in the first place and Robert knows it, so it will be easy to oust him. Pretty soon there will be no one left except of course The Honorable Robert Smith and his sidekick Theresa Nieto.

After making my rounds here today on the Reservation and talking to some of the Tribal Members has inspired me even more than before.
ReplyDeleteMost were glad that I stopped and talked with them and I really had a good time talking about the good old day with them.
I even had a hard time leaving some of them because they had a lot of things on their minds.
I intend to go back out again tomorrow and do the same thing, so if you see me coming please don't run and hide from me because what you have to say is very important to me.

ReplyDeleteTomorrow is the big day. spend a little time alone before you go to vote and ask your self which ones would be a better choice for the Pala Band. Run it through your head and put all the positive things that the Candidates have done for you as a Tribe. Put those things in your head and then try to remember any negative things that involved the Candidates and make you best choice.
Either way, please don't forget to Vote tomorrow at the old Tribal hall. Your vote can make a difference.

ReplyDeleteIf you want to leave a good legacy for you kids, then make things right in Pala again and do what you said you would do and re-enroll the members that have trashed. This was one of your big promises when you were asking for votes the night you were put in as Vice at that special meeting to replace Miranda.
Do what's right just like your Father would do.
Your Father is a man of his word and always did what he said he was going to do. So if you want to carry the name Maxcey then do it with pride and do the right thing. Some of these disenrollies were your good friends and still defend your ass saying that you will do the right thing, so don't put you friends aside by letting them down.
Are you a man of his word? or a puppet.Here is your chance to gain the Respect of all the Tribes Membership. We are counting on you Howard, and if you can't do this let us know so we can take whatever action that we need to so we can resolve this issue so we can move on as a Tribe.At least do that much if nothing else.
