Report:BIA Director Amy Dutschke's CONFLICT OF INTEREST Wilton Rancheria DOES NOT QUALIFY for Restored Lands Exemption and Thus, NO Casino in Elk Grove

The group Stand Up for CA and some disenrolled members of HRVMI (Historical River Valley Miwok Indians) have some bad news for the Wilton Rancheria.  They don't qualify for land into trust.

GUESS WHOSE tentacles are in this issue?  If you say...AMY DUTSCHKE, you'd be right.  First and foremost, as a result of this research, we are able to document that Regional Director Dutschke has multiple family relatives in the membership of the Wilton Rancheria. These family relations raise a clear conflict of interest.   OH....my.....goodness....

Based on news stories at the time .....

Stand Up requested that Regional Director Dutschke recuse herself for this reason from supervising BIA’s  processing and consideration of the Rancheria’s fee-to-trust and casino project by comment letter dated January 6, 2014. Regional Director Dutschke has not done so, and, even after a review of the “applicable documents in the record”

Even assuming that the BIA has the requisite statutory authority to take land into trust for the benefit of the Rancheria—and that the Rancheria is a valid “restored” Indian tribe eligible for gaming under IGRA—the historical
record establishes that the Elk Grove site does not qualify for gaming as restored lands  Pursuant to 25 C.F.R. 292.12, the Rancheria must demonstrate a “significant historical connection” to the land, meaning the land is “located within the boundaries of the tribe’s last reservation under aratified or unratified treaty,” or the tribe can “demonstrate by historical documentation the
existence of the tribe’s villages, burial grounds, occupancy or subsistence use in the vicinity of the land.”

This issue MUST be shared....

  1. I guess Wilton Rancheria didn't fill the plain brown envelopes with enough cash. Ione, Lower Lake, and Tejon all moved forward with the most meager of connection to the land. They know how to fill an envelope.

  3. Stand Up For California is opposing land into trust for Wilton Rancheria? Isn't Stand Up for California a non-profit organization that gets the majority of its funding from gaming tribes? From my understanding Robert Smith and the PBMI is a big contributor. Could it be a sign of a deteriorating relationship between the Regional Director who wears conflict of interest on her sleeves, and the fat Chairman who likes to throw his weight around?

  8. If I were her, I would sue the shi* out of Original Pechanga Reporter and the Stand Up for CA group. Their wording is being misconstrued and its almost reverse psychology. I would like to see and actual article with quotes of the who said she said...

  10. Where is the "documentation" that she is related to the people of Wilton Rancheria?

    I just read the Stand Up document you have up here. It makes lots of allegations about the Tribe's history but doesn't "document" her relatives. It just makes the allegation again and then a footnote names one family but doesn't describe the connection.

    Have the people on this site claiming that is what the document describes, even read the document?

    This site and it's fake news fits right in to Trump's new america. Well done.

It doesn't talk much about Amy, but it does deny the continuing and continual existence of Miwok peoples in the Sacramento Valley. So, it seems like you've teamed up anti-Native people who respect you so much they don't even think you're Indian. Oops. Seriously, why would you get in bed with people who would question your identity? Gross.
