The Nooksack Tribe has been informed that ANY actions taken subsequent to their illegal (Nooksack Constitution) election, would not be recognized by the Bureau of Indian Affairs. Yet, their "jihad" against the Nooksack 306 KNOWS NO BOUNDS!
Not to be stopped, they are issuing EVICTIONS of their ELDERLY members, WHO HAVE NOT BEEN disenrolled. KATRICE ROMERO, you are a pig.

DeleteAll bands have rights. Most bands follow custom and tradition similar to ICRA/ Indian Civil Rights Act. Why would individual members of the tribe have less rights than the band it's enrolled in? Mostly it's because bands who practice disenrollment, dishonor what their Ancestors went through to be recognized by the invaders. All recognized bands believe in ICRA, All bands should believe individual members share the same rights.
ReplyDeleteThe ICRA is meaningless. Congress passed it to make the U.S. feel better about all the harm that has been inflicted on Indians through the centuries. Here we have an Act of Congress from 1968 that has failed every judicial test and has given zero protections to the Indians for whom it was supposedly created. It is a useless piece of legislation, and tribes that incorporate it into their governing documents endorse the charade that the federal government wants to protect the rights of Indians.
ReplyDeleteOh yeah, let Congress revisit it. Maybe they will repeal it and leave us with nothing. If tribes don't care about civil rights for Indians, why should Congress? At this point what is really necessary is an entirely new law that actually protects the civil rights of Indians, not the ICRA. It is shameful that Congress ever pretended that this legislation would operate to protect Indians.
First Congress created an Act that was useless on its face. Then the Supreme Court ruled that a useless Act, supposedly designed to protect the civil rights of individual Indians against harm inflicted by tribal leaders actually gave permission to tribal leaders to destroy members of tribes by disenrolling them. Nice twist on that one. Such laws are supposed to be interpreted in favor of Indians. Really. It is a principle of statutory interpretation that the Supreme Court set in Worcester v. Georgia.
So the joke is on us Indians. We have a useless Act that Indians incorporate into their governing documents, that is ignored by Congress and tribes, and which the Courts use against Indians. Let's set it aflame in a bonfire and show our level of respect! It is less than trash at this point.
