DESCENDANTS OF FREEDMEN OF THE FIVE CIVILIZED TRIBES ASSOCIATION 8TH ANNUAL CONFERENCE GOES VIRTUAL 

The Descendants of Freedmen of the Five Civilized Tribes Association and the African Indians of the 5 Civilized Tribes Foundation will host a virtual conference on Saturday, November 7, 2020, from 10 a.m. to 4:30 p.m via Zoom. This year’s conference theme is Freedmen Origins of Greenwood:  Tribal Enslavement, Sovereignty, and Citizenship. The conference is sponsored in part through a grant from the  1921 Tulsa Race Massacre Centennial Commission & WPX Energy. 

National and International speakers and presentations will cover the history of Black Native citizens in the formation of Tulsa’s Greenwood district. Attendees will walk away with a deeper understanding of the social and cultural identities of victims of enslavement by tribal citizens and the challenges faced by many of their descendants today. Presenters will address the ongoing struggle for the enforcement of the 1866 Treaty Rights.

Pechanga Casino BANS Certain MASKS. KNOW before you go, or STAY HOME

 



Pechanga Resort & Casino in Temecula has announced a MASK BAN in their casino.  Pechanga has lost one tribal member to Covid 19 and recently reopened the sports complex on the reservation after a Covid scare.

Bandanas, neck gaiters and masks with vents will NO longer be allowed in their casinos beginning Tuesday.   A study finds those face coverings do little to stop the spread of corona virus.

"The enhancement to the resort/casino's comprehensive safety measures is put in place for the health and safety of guests, team members and the community. The new face mask requirement will be enforced at all times,'' Pechanga officials said.

Kaysera Stops Pretty Places; NO PEACE for Her, as Justice is Elusive in Hardin Montana


One year ago on August 14, Kaysera celebrated her 18th birthday. She played basketball and football, ran cross country, and performed in several school theatre productions. She had dreams of becoming an actress and a performer. She had a lot to look forward to.

Ten days later, on August 24, 2019, she went missing in a suburban neighborhood of Hardin, Montana, less than a half mile off of the Crow Reservation. Her body was found in the same neighborhood where she was last seen alive, on the morning of August 29. Law enforcement, however, did not inform the family that Kaysera’s body had been found until almost two weeks later, on September 11.

PALA CASINO Crimewatch: Man Dies after Early Morning Fight

Sad News from the Pala Casino, a tribe that has been in the news for arrests on it's reservation.  Now, another death.  Looks like security was unavailable. 


A man died after he was believed to have been in a fight in the parking lot at Pala Casino Spa & Resort, San Diego County Sheriff's officials said Saturday, Aug. 22.

The man was taken by ambulance from the 4700 block of State Route 76 to a local hospital, where he was pronounced dead at 7:50 a.m. Friday.

Upon further investigation, the victim was believed to have been in a fight with another man in the parking lot of the casino at about 6:30 a.m., according to Lt. Thomas Seiver of the Sheriff's Homicide Unit. The victim apparently left the scene and deputies found him about six miles west of the casino.

Elizabeth Warren's Address to Native America Was Pure Stagecraft.

After decades of appropriation of Native ancestry exposed by Cherokee genealogist Twila Barnes and detailed on her Polly's Granddaughter's website, the Native American Caucus of the Democrat Party invited her to speak.

WTF?  There weren't enough prominent Native Americans to speak? Before she took the stage, the chat room for the DNC remote-video event warned viewers to not criticize Warren over her heritage.  NO "High cheekbones" references?  LOL
Are we REALLY to believe Senator Warren cares about Natives?  Where has she been on the #stopdisenrollment issue, the stripping of tribal ciizenship of Native people

Native Americans can forgive. Elizabeth Warren apologized to Native Americans for appropriating and benefiting from the Native heritage she falsely claimed.  She took CHEROKEE heritage, yet didn't apologize to CHEROKEE until later.  That's admission she thinks "all Indians are alike" in my book.

But the VERY next day, the day apartheid supporting Kamala Harris was nominated for Vice President,  Senator Warren spoke at a school, with many visual (subliminal) product placements, You can read all of them at this Twitchy post,  NOT ONE reference to Native Americans,  NOT ONE,  Even in the artwork by kids...is their an expiration date on her political opportunism?

All the evidence says yes.   So, it was stagecraft with the Native American caucus, but epic stagecraft fail the very next day.

Apartheid supporter?  You bet.  CA's junior Senator Kamala Harris accepted the endorsement of Pechanga Band of Luiseno Indians Chairman Mark Macarro, a tribe from Temecula, who runs an apartheid reservation.  More on that down post.

We are dismayed by the lack of sensitivity to tribal issues and to Native Americans as individuals that we see in our announced candidates. Their comments and actions provide little assurance that they grasp the government-to-government relationship guaranteed by the U.S. Constitution.
When Kamala Harris first became Senator, we sent her a letter that scared even the crickets from chirping, the silence was so deafening.

Dear Senator Harris,

As you assume office and begin the job of familiarizing yourself with the various issues and concerns of your constituents, please take notice of the unique problems facing Southern California Indian Country. American Indians have long suffered unfair and discriminatory treatment from the U.S. Government, and since the passing of the I.G.R.A. (Indian Gaming Regulatory Act) individual Indians have been assaulted by “elected” leaders that pursue wealth and power to the detriment of the general welfare of the people.

Attorney General Kamala Harris submitted a brief in a lawsuit that seeks to diminish the boundaries of the reservation of the Colorado River Indian Tribes.

Indian Gaming Groups were unsure of her as Indianz.com reported

She’s just failed to take positions on some critical issues … and that causes alarm,” Steve Stallings, the chairman of the California Nations Indian Gaming Association, told The Los Angeles Times. “Unfortunately, what it looks like is politics.”


As attorney general, Harris opposed at least 15 tribal land-into-trust applications, Dave Palermo reported for Pechanga.net in February 2014. Her office also tried to stop the Big Lagoon Rancheria from opening a casino on land that was placed in trust more than two decades ago.

Disenrolling Tribes Please Come home to The NATIVE WAYS of Our Ancestors

 In over 13 years of fighting against tribal disenrollment, starting with the Pechanga disenrollments of two families, I’ve placed all of my time, energy and righteous anger on the nightmare of this paper genocide .
This scourge defames our ancestors, abuses our elders, and rips the heritage from our children. 

 For all of these years, I’ve neglected to speak about what it truly means to be an American Indian. Today, I want to briefly share my experience of the Native Way, with the beautiful native people of Northern New Mexico.

While driving from Upland, California to Chama, New Mexico to visit my brother, who had just relocated to the small New Mexican town, my wife and I experienced that community, and their actions touched me to my core.

I was trying so hard on that trip, to keep our Mazda CX-9 at the speed limit. It was unfamiliar territory and we were visiting in the dead of winter. There was this white stuff everywhere that this Californian was unfamiliar with. I'm certainly not used to driving through snow or ice, so I was trying to keep it safe by keeping under the 55 MPH speed limit.

Four deer would have been hit.

East of Bloomfield, New Mexico passing the mile marker 102 sign, I crested a small rise, could not see the road, and quickly came across a herd of deer crossing the road.  I stood on my brakes, they worked well, but one deer was not concerned about her safety. The collision was not catastrophic to my wife or me, but at 100 pounds, the doe wasn’t so lucky. She damaged our nearly new car, rendering it inoperable, and in the process didn’t survive.  Stuck, in what to us a desolate stretch of highway between the Navajo Nation and Jicarilla Apache reservation, other motorists were few and far between.

We got to the side of the road, and my wife had enough cell signal to reach AAA. They promised to have someone out ASAP, but given our location, they warned it might take a couple of hours.  Thankfully, I had supplies in the car, water, snacks, and hand warmers (why are you laughing?).

With almost all the facts revealed, the Brittens are now in bunker mode. It is simply a matter of waiting for the appropriate agencies and courts to take action against the crooks of Pala. What have we learned and what have we been able to teach the BIA and the general public about the horrific crimes of Robert Smith, Andrew Smith and their cronies?

We have learned through many sources that the Smiths are quite capable of committing murder.
The BIA via Amy Dutschke, is willing to go to any length to protect Robert Smith even if those actions are illegal.

The Lugo family is from Morongo and the BIA forced the Warner Ranch Evictees to accept them as part of the Band.
  • The Constitution of the Pala Tribe is illegal no matter what Amy Dutschke says about it. She will be arguing the validity of the Pala Constitution from her jail cell.
  • There has not been a legal election on Pala since 1990 due to the corrupt actions of Robert Smith.
  • The County of San Diego will spend millions of dollars at tax payer expense and send out a militarized force to protect Robert Smith from the Warner Ranch Evictees.
  • Robert Smith is the chairman of the Pala Band of Luiseno Mission Indians, California (Old Pala) and that the Pala Band of Mission Indians is not published in the Federal Register and therefore the Pala Band of Mission Indians is not a tribe.

At best, Plaintiffs’ claim is that the government officials acted wrongfully or erroneously by rejecting Plaintiffs’ enrollment request, and by failing to provide notice to Plaintiffs. The allegations at issue here are not claims that any of the Individual Defendants acted or failed to act in excess of their statutory authority. Dalton v. Specter, 511 U.S. 462, 472 (1994) (executive actions in excess of statutory authority are not ipso facto unconstitutional). Indeed, the allegations do not suggest that Individual Defendants acted outside the scope of their duties. Secondly, in any event, the doctrine of ultra vires does not apply to situations in which claimants seek monetary relief against the government officials. See E.V. v. Robinson, 906 F.3d 1082, 1090–91 (9th Cir. 2018) (holding that the ultra vires doctrine “does not apply in suits for damages.”). That is the case here and as such, the ultra vires doctrine does not help waive sovereign immunity

ONLY 9% of Murders of Indigenous Women SOLVED in CA vs. 60% of Greater Population

 



Great for Native America that the mainstream media has "discovered" the #MMIW and #MMIWG issue.  Is that something that Trump's new task force can credit?

There are more indigenous people in California than any other state in the U.S., with 700,000 Native Americans calling the state home. According to the report, only nine percent of murders of indigenous women in the state have ever been solved, compared to 60% in the greater population, meaning homicides of Native American women in the region are around seven times less likely to be solved than the murders of all other victims.

Lying about your tribal identity could land you in trouble on the 
Muscogee (Creek) Nation, whose reservation boundaries were reaffirmed last month in a historic U.S. Supreme Court decision.

With the state of Oklahoma finally barred from exercising "unlawful" jurisdiction on the reservation, tribal and federal authorities are stepping in. They are prosecuting criminal cases, not just of Creek citizens, but those involving citizens of other Indian nations.

Sovereign Tribal Nations Should FOLLOW their OWN LAWS

 Why is doing the right thing so hard for some tribes?



Pechanga: OUTSIDE their constitution:

The Pechanga Appeal Procedures state that the purpose of the appeal is in identifying any infraction to the disenrollment procedure or any unfair and/or partial handling of a disenrollment case pursuant to Procedures § 9, page 4. The Enrollment Committee committed numerous errors or infractions of fundamental Pechanga law and procedural Pechanga law as follows:


1. Knowingly violated the will and intent of the General Council by continuing disenrollment proceedings after General Council’s vote to suspend all disenrollment;
 
2.. Violated the Pechanga Band Constitution by imposing a more restrictive membership standard than contained in Article II: Membership;
3. Ignored the Official Enrollment Book of 1979 as the original source document for determining Membership as stated in the Constitution;
4. Violated the Pechanga Band Enrollment Committee Guidelines by conducting disenrollment procedures without a lawful quorum and by reviewing disenrollment cases out of order for the purpose of stacking the Committee;
5. Contradicted previous actions and decisions of the Enrollment Committee;
5. Failed to indicate any mistakes or irregularities in the Appellants enrollment and failed to conduct the review of the Appellants’ case in a fair and/or impartial manner;
6. Violated the Indian Civil Rights Act by retroactively applying 1996 Enrollment Application to Appellants;
7. Violated Constitution and Disenrollment Procedures through application of more restrictive standards;
8. Acted negligently in the review of the Appellants case.

it is very clear that Pechanga elder Dolores Tortuga included my ancestor Paulina Hunter in the inclusive "we Pechanga Indians" when she tesitfied in the 1915 probate hearings by saying in response to the examiner's question below:

"Were you acquainted with the deceased Pechanga Indian allottee Paulina Hunter?"

Tortuga responded by saying, "yes, I knew her as a neighbor when WE PECHANGA INDIANS lived on the Pauba Ranch near Temecula, California."

Win River Casino Tribe Flexes It's WALLET in Political Race in Redding

  Patrick Jones has landed another big campaign donation in his race to unseat Shasta County District 4 Supervisor Steve Morgan.

A former Redding mayor, Jones earlier this week received $20,000 from Win-River Casino and the Redding Rancheria. It comes about a week after he got $100,000 from former Shasta County winery owner Reverge Anselmo — believed to be the largest single campaign donation ever in local politics.

Jones sees Win-River Casino’s plan to relocate to freeway frontage property just south of Redding as an issue in District 4, despite the fact the project site is not in the district.

MORGAN's Statement:

I have always run community-based campaigns because I am here to represent my community. Period. I will not criticize my opponent because that's not who I am, but the people of Shasta County and my District know that I am always accountable to them, I'm there to represent them, and I'm excited to ask for their vote this November,” Morgan wrote.

Pechanga Recreation Center Slowly Reopens after Covid 19 Scare, Shutdown.

Looks like the coast is clear at the Pechanga Recreation Center at the Temecula Indian Reservation.  The gym and pool are slowly reopening

They had been closed due to one of their employees contracting Covid 19 as per his social media. 

The remaining employees have been protected, via the affected employee's no longer working there.  Good watching out, right?   WASH YOUR HANDS, clean your equipment.

Is this story of Pablo Apis' descenats being told at Pechanga?  True descendants who belong in the tribe, eliminated because of POLITICS. Other Apish descendants are still in the tribe, what made #Pechanga terminate her?

For centuries, the Pechanga/Temecula people lived in peace with one another. 
Despite occasional differences, we have always struggled and survived as a unified community. Indeed, under the leadership of Chief Pablo Apis and others, our common ancestors literally fought and died for the land which was set aside by Executive Orders in 1882 and 1893 for the use and benefit of the “Temecula Band or village of Mission Indians“. 

HISTORY: The Temecula Indian village, from which our ancestors were forcibly expelled from in 1875, was located within the tribe's aboriginal territory on land which was deeded to Chief Pablo Apis as the Little Temecula Rancho and which was to be set aside for the Temecula Indians by the Treaty of Peace and Friendship. The treaty, which was signed at Chief Apis' adobe in the Tribe's village, was never ratified by the US Congress. The land on which the Pechanga Resort and Casino is located is actually a corner of Chief Pablo Apis‘ original land grant.

While primarily known has a "men's magazine" Playboy also kept up with the issues of the day.  Playboy's April 2008 included a story on ousted Seminole Chief James Billie, with the article focusing on  Billies' fall from power as Chairman of the Seminole Nation and his eventual banishment by an opposing faction of the tribal council.

 San Manuel Band of Mission Indians, who, along with other Indian Tribes in California, have no problem opening their casinos during the coronavirus, defying Governor Newsom’s request for a temporary closure.

On their website and in their advertising, they boast that everything is safe and outline the steps they have taken to keep patrons of their casinos from contracting the coronavirus.

But apparently those good hygiene practices used to lure gamblers into their casinos does not work at San Manuel events tribal members attend.

Two days ago, the San Manuel Band of Mission Indians announced that they were canceling their annual pow wow stating, “this [cancellation] is the best and most responsible decision as we want to protect the health and safety of our Tribe and our guests.”

#FacesofDisenrollment PAULINA HUNTER of Pechanga Band of Luiseno Indians

Paulina Hunter, Pechanga Band of Luisento Indians died in 1899. Never getting a chance to defend herself as she was defamed by disenrollment in 2006, She would have been almost 170 years old. Her descendants still live on her allotment, given to her as head of household in 1895.  20 acres, allotment 62.  How many can say, they are descended from ORIGINL PECHANGA people

Here is part of Dr. John Johnson's letter to the Pechanga Enrollment Committee, which hired him to investigate Paulina Hunter:

Paulina Hunter was not an original Pechanga Temecula person,” is incorrect. I have already pointed out that my report presented evidence that Paulina’s father was the only Indian listed in the early San Luis Rey mission records who was actually born at Pechanga. Furthermore, the reasoning presented in Conclusion 5 is entirely based upon a misinterpretation of the evidence. John Miller, Paulina Hunter’s grandson, stated on his enrollment application (authorized by the 1928 California Indian
Jurisdictional Act) that his “Grandmother and Great Grandparents were San Luis Rey Mission Indians.” The Record of Decision incorrectly concludes that “the correct tribal ancestry of Paulina Hunter was San Luis Rey” and therefore not Pechanga Temecula.


DNA Tests in Indian Country: Elizabeth Warren and Lorena Butler of Redding Rancheria


So many times in discussions with people about disenrollments and belonging.  People say, "WHY don't you take a DNA test?" 
 

DNA may prove Native ancestry, but it usually doesn't prove tribal belonging, but in the Lorena Butler matter, that is not so.

Elizabeth Warren, who claimed Cherokee ancestry, was exposed as a fraud, by Cherokee genealogist Twila Barners, on whose website Thoughts from Polly's Granddaughter you can find the six pages of work.   She is NOT a Cherokee member.  In fact, her test proved Sen. Warren was between 98.44 percent and 99.9 percent not Native American, much less Cherokee

In the Lorena Buler matter, the challenge to her descendants,  the Foreman family dates to June 2002, when the tribal council received two letters alleging that Virginia Timmons bore no children. The letters, which were written by an elderly tribal member named Dorothy Dominguez shortly before her death, implicitly attacked the bona fides not only of Timmons' only child, Lorena Butler (who was born in 1916 and died in 1995), but of Lorena's five children, their 17 offspring and the two generations that have followed.

Premiere Indigenous Law Firm Galanda Broadman has a good capture of yesterday's events with #stopdisenrollment in Indian Country politics.  Both the NCAI and Rep. Haaland spoke/wrote about tribal disenrollment in the SAME DAY, thanks to CAM FOREMAN, grandson of the honorable Bob Foreman, who has been going like gangbusters on social media.  HOW hard?  Well, Fawn Sharp BLOCKED him on Twitter!  LOL

CA Governor Newsom Ok's Compact With BIA DIRECTOR's TRIBE

SHOCKER!!



Governor Gavin Newsom today announced that he has signed tribal-state gaming compacts between the State of California and the Ione Band of Miwok Indians, the Mooretown Rancheria of Maidu Indians, the Paskenta Band of Nomlaki Indians, the Shingle Springs Band of Miwok Indians, the Tolowa Dee-ni’ Nation and the Tule River Indian Tribe of California.

Bobbi La Mere Pechanga Committee Chair, Supports Original Pechanga Blog with Share of Important Post

Bobbi La Mere, then chairman of the Pechanga Enrollment Committee, which disenroll my family, and was the victim of a warning shot fired at her home, to make sure she followed the plan.  She later got her family enrolled, during a moratorium, in a Quid Pro Quo, while hundreds remained trapped.

Imagine my surprise when I found she had shared one of Original Pechanga Blog's post of Facebook.  Maybe she's a Trump supporter?

The post IS important enough to share, and has generated over 500,000 page views in under a week.  I want to thank Bobbi for this small suppoort, even as her actions of disenrollment, has caused such trauma to my entire family.
